Nationally Recognized Class-Action Attorney Joins Hagens Berman Sobol Shapiro
"Reed R. Kathrein, a nationally recognized complex litigation attorney announced today he has joined the class action and large-scale litigation firm Hagens Berman Sobol Shapiro (HBSS), and will head up HBSS's new San Francisco office.

According to managing partner Steve W. Berman, Kathrein's deep experience in securities fraud, consumer and antitrust class actions will be a strong addition to HBSS.

""We are all very excited to welcome Reed to HBSS,"" said Berman. ""Reed's experience matches perfectly with our work, and we are very fortunate to have him lead our new San Francisco office.""

Kathrein's 30 year practice has been dedicated to protect the rights of individuals and institutions through consumer and antitrust class actions. He has been the lead or co-counsel on many significant rulings over the years including a recent win involving a $1 billion settlement with Tenet Healthcare, a case he shared with HBSS.

""Practicing law is always more rewarding when you work alongside like-minded, talented people, and I have found that in HBSS,"" Kathrein said. ""I am excited about helping the firm expand its practice, and to expand the firm's presence by leading its new San Francisco office.""

HBSS is headquartered in Seattle, with offices in Cambridge Massachusetts, Chicago, Phoenix, Los Angeles and now San Francisco.

""We are doing more and more work representing consumers and others in California, and it made sense to strengthen our presence there,"" Berman added. ""Reed's familiarity with the courts in California make him even more of a potent ally for the firm, and for our clients.""

Among Kathrein's other notable successes include a $259 million settlement for shareholders against 3Com Corporation involving accusations the company defrauded investors by hiding a $160 million loss, a case that was then one of the nation's largest securities class-action settlements. Kathrein was also instrumental in the 2003 settlement in the largest investment manager fraud case in U.S. history against Capital Consultants, which resulted in a $300 million settlement on behalf of labor pension funds.

Kathrein served as co-chair of the Securities Working Group in California, tasked by Chief Justices Marilyn Hall Patel and Vaughn Walker to propose and assist in revising the Court's local securities fraud class actions rules. He also served on the executive committee of the National Association of Securities and Consumer Law Attorneys, the Private International Law Committee of the American Bar Assocation and acted as an advisor to the U.S. State Department's Advisory Committee on Private International Law."

Hagens Berman Sobol Shapiro Opens San Francisco Office
"Hagens Berman Sobol Shapiro (HBSS), a Seattle-based class-action and complex litigation firm, today announced the opening of a San Francisco office that will be led by class-action attorney Reed R. Kathrein, formally of Lerach Coughlin Stoia Geller Rudman & Robbins LLP.

HBSS's managing partner, Steve Berman, sees it as another large step in the firm's continued growth and strong national presence.

""San Francisco is a hub of activity and a growing area in our legal landscape,"" Berman said. ""Our new office allows us to work more effectively with our clients and helps position us as a leader in class-action and litigation cases.""

HBSS currently has an office in Los Angeles and looks to the new San Francisco office to continue growth in one of the most vibrant parts of the country.

""California is at the forefront of using the law to hasten important social and governmental change, and we want to be part of it,"" said Berman. ""By having Reed join us in San Francisco it gives us the power and resources to make that happen.""

Reed R. Kathrein has made a very strong name for himself both in California and nationally with several significant settlements and court victories over the past few years. Notably is a recent consumer fraud case involving Tenet Healthcare, which he worked along side of HBSS and resulted in a $1 billion settlement for uninsured patients. Kathrein was also responsible for the successful litigation and mediation in a case involving 3Com Securities, which settled with $259 million price tag, the second-largest settlement in a securities litigation case to date.

The San Francisco office, located at 425 Second Street, will also include attorneys Jeffrey Friedman, Shana Scarlett and Sylvia Keller, also formerly of Lerach Coughlin. All three attorneys specialize in large class action cases and have been integral participants in large settlements over the years.

One of Friedman's most recent wins included a multi-million dollar settlement with Dell Inc. on behalf of nearly one million customers. In addition to the settlement Friedman also negotiated to have Dell change its sales and compensation policies to better protect consumers.

Scarlett worked along side Kathrein and HBSS in the Tenet Healthcare case which settled for $1 billion. She was also a member of the litigation team in the Sony BMG Audio Compact Disc Litigation, where she helped plaintiffs to secure a multi-million dollar settlement for consumers and an agreement from Sony BMG to stop using harmful rootkit software that created a number of serious security, privacy and consumer protection issues on music CDs.

Keller specializes in corporate governance and securities class action litigation. Some of her most noteworthy settlements involved a $75 million payout by Krispy Kreme, a $13 million settlement with CV Therapeutics and a $7 million settlement with Cornell Companies, Inc."

Orrick Litigator Quoted on Significance of Capping Appeal Bonds
New York litigation partner Peter Bicks is quoted in this article about appeal-bond caps. Five state legislatures have passed or are considering limits on the amounts that defendants must put up as bonds in order to appeal judgments. Bicks noted that the recent reversal of billionaire Ronald O. Perleman's $1.58 billion jury verdict against Morgan Stanley emphasizes the importance of this legislation.

"The frequency with which appellate courts ... have reversed out of control verdicts shows that reasonable limitations on the amounts that have to be posted for bonding are very reasonable," Bicks said.

Laura Ariane Miller, Government Investigations and White Collar Defense

Laura Ariane Miller’s practice includes white-collar criminal defense work for corporations, corporate executives, health-care and educational institutions, public officials and high-profile individual defendants. She has extensive experience in criminal litigation, including investigations, grand jury appearances, motions practice, trials, sentencing, and post-sentencing actions, and chairs Nixon Peabody’s government investigations and white collar defense practice. Known as a “lawyer’s lawyer,” she has successfully represented many prominent attorneys—before bar counsel, in grand juries, and in trial. Just last year, she won a rare Presidential pardon for a client. Ms. Miller is a leader in the legal profession. She currently serves on the Governing Council of the ABA Section of Litigation and is an immediate past chair of the ABA Criminal Litigation Committee. She is also chair of the board of the Michigan in Washington Program. She is a Phi Beta Kappa graduate of the University of Michigan, and a graduate of Yale Law School. Laurin Mills, Technology and Intellectual Property

Mr. Mills is the managing partner of the Washington, DC, office. Ken Silverberg, Tax

Italy's Largest Power Company Enters U.S. Geothermal Market
ENEL North America, Inc (ENA), a subsidiary of Italy’s largest power company, ENEL S.p.A., announced the acquisition of AMP Resources LLC (AMP) from AMP Capital Partners and a minority investor. The international law firm of Milbank, Tweed, Hadley & McCloy LLP represented ENA in the purchase, which includes one operating and four advanced stage geothermal development projects located in Nevada, California and Utah. Marathon Capital LLC provided the financing to AMP.

Headquartered in Andover, Massachusetts, ENA is a leading owner and operator of renewable energy projects, and currently maintains a diversified portfolio including hydropower, wind and biomass in 21 U.S. states and three Canadian provinces. The purchase, a total of 115 MW, marks the company’s first foray into the U.S. geothermal market. When fully operational, the geothermal projects will provide enough renewable power for more than 100,000 households.

Edwin F. Feo, co-chair of Milbank’s Global Project Finance Group, who represented ENA commented, “There is an ever-increasing interest in the potential of the U.S renewables market from companies abroad. This will only continue as public and private pressure mounts to find viable alterative energy sources.” Mr. Feo, a Los Angeles-based partner at Milbank. The Milbank team included partner David Lamb, and associates Laurae Rossi, Rachel Fink and Ari Bessendorf in Los Angeles, and Washington, D.C.-based partner Lewis Putman and associate Yolanda Oliver.

HASKELL SLAUGHTER’S SCOTT NAMED CO-CHAIR OF AMERICAN BANKRUPTCY INSTITUTE COMMITTEE
Romaine S.
