Fisher & Phillips Enters Philadelphia Market
Fisher & Phillips LLP announces its expansion into Philadelphia with the addition of three Partners, Christopher P. Stief, David W. Erb and Michael R. Greco, who join Fisher & Phillips from Saul Ewing LLP. The effective date for their move is March 26, 2007.

Stief, Erb and Greco have a national practice focusing on litigation of employee defection and recruitment matters involving non-compete agreements, trade secrets and related issues. Their addition is a natural complement to Fisher & Phillips, one of the nation’s largest labor and employment law firms, which exclusively represents management. Fisher & Phillips now has 190 lawyers in 18 cities. Stief, Erb and Greco are joined by Of Counsels Susan M. Guerette and Risa B. Boerner and Associate Heather Zalar Steele.

Fisher & Phillips Chairman Roger Quillen said, “The addition of some of the top attorneys practicing in the growing area of non-competition and protection of trade secrets strengthens both our offerings to our clients and our presence in the Northeast. We have deliberately, but carefully, sought attorneys who focus their practice on protecting companies’ intellectual assets, a growing area of need for our clients. Fisher & Phillips already has one of the strongest groups of labor and employment lawyers in the country. This exciting move adds tremendously to the depth and breadth of our experience and knowledge, which is great news for all of our clients.”

Stief will be the regional managing partner in the new Fisher & Phillips’ Philadelphia office. Together with Erb and Greco, the trio have litigated more than 800 employee defection and recruitment matters in virtually all fifty states, as well as Washington, D.C., Puerto Rico, and international matters from Asia, Europe, and the Middle East. Their representation of clients span a variety of industries including securities brokerage, health information technology, medical practice, temporary and permanent staffing services, online retailing, insurance brokerage, insurance agencies, computer hardware/software sales and distribution.

In addition to their litigation practice, Stief, Erb and Greco provide counseling on employee defection and recruitment issues involving covenants not to compete, non-solicitation and non-disclosure agreements, unfair competition, employee raiding, trade secrets, duty of loyalty, and statutory issues under the Computer Fraud & Abuse Act, the Espionage Act, and various state trade secrets and unfair competition statutes. They help their clients balance the need to coordinate programs to protect their competitive assets against employee defections, on the one hand, with the need to minimize the risks that arise when hiring employees from competitors, on the other hand.

Stief said, "Numerous firms were interested in our growing practice. We wanted to be part of a forward-thinking firm that understands the increasing importance of a practice such as ours. Once we met with Fisher & Phillips, we quickly realized this firm has a vision that matches ours. We are leading the development and growth of what we believe to be the nation’s strongest practice group in the area of employee defection and recruitment.”

Erb added, “The national reach of Fisher & Phillips with its strategically located offices will be a great enhancement to our national practice, and our current and new clients will benefit from the expansive knowledge base of the firm’s labor and employment attorneys.”

“It is a perfect fit,” said Greco. “Our extensive experience protecting trade secrets meshes perfectly with Fisher & Phillips’ extensive experience in all matters of labor and employment law. One of our immediate goals is to add to our ranks in Philadelphia with top notch labor and employment attorneys.

DREIER LLP FILES CLASS ACTION LAWSUIT AGAINST USANA HEALTH SCIENCES, INC.
Dreier LLP (www.dreierllp.com) today announced that a class action lawsuit was commenced in the United States District Court for the District of Utah, on behalf of purchasers of the common stock of USANA Health Sciences, Inc. ("USANA" or the "Company") (NASDAQ:USNA) during the period July 18, 2006 through March 14, 2007, inclusive (the “Class Period”). The complaint alleges violations of the federal securities laws, including Section 10(b) of the Securities Exchange Act of 1934.

If you purchased USANA common stock during the Class Period, you may be a member of the proposed Class. You must move the Court on or before May 25, 2007 if you wish to serve as Apr-07 lead plaintiff. Lead plaintiffs must meet certain legal requirements. To learn more about this lawsuit or if you are interested in serving as a lead plaintiff, please contact plaintiff’s counsel, Lee A. Weiss (classlaw@dreierllp.com) of Dreier LLP at 800-952-8897. Class members may retain counsel of their choice and move the Court to serve as a lead plaintiff, or may choose to do nothing and remain absent class members.

USANA is a health sciences company engaged in the manufacture and sale of nutritional and personal care products headquartered in Salt Lake City, Utah. The Complaint alleges that, throughout the Class Period, defendants issued materially false and misleading statements regarding the Company’s business and financial results and failed to disclose, among other things, that: (1) the Company’s multi-level marketing system was operating as a pyramid scheme; (2) the majority of the Company’s Associates did not sell to consumers, but sold to other Associates; (3) the Company was experiencing an exceedingly high Associate attrition rate, resulting in an unsustainable sales force; (4) 74% of the Company’s new Associates were failing within the first year; and (5) 87% of the Company’s Associates were losing money. The Complaint further alleges that, as a result of these false statements and omissions, USANA common stock traded at artificially inflated or distorted prices. On March 15, 2007, the Fraud Discovery Institute issued a press release and The Wall Street Journal published an article concerning a three-year investigation by the Fraud Discovery Institute that had revealed that USANA’s multi-level marketing system was an unsustainable pyramid scheme. In reaction to this news, the price of the Company’s stock declined $8.92 per share, or 15%, to close on March 15, 2007 at $49.85 per share, on unusually heavy trading volume. Plaintiff seeks to recover damages on behalf of all members of the proposed Class.

Six Williams Mullen Lawyers Named "Super Lawyers" In D.C. Office
Six Williams Mullen lawyers have been named "Washington, D.C. Super Lawyers" in a recent study by Law & Politics magazine. The results have published in the March 2007 Washington, D.C. Super Lawyers magazine and in a special advertising supplement to The New York Times (Washington, D.C. area distribution).

* Francis "Tom" Coleman
* Warren L. Lewis
* Mary Ann Mancini
* Thomas B. McVey
* Jimmie V. Reyna
* Robert F. Riley

As part of the selection process, Law & Politics magazine conducts a regional survey of lawyers who have been in practice for at least five years, asking them to nominate the best attorneys they've personally observed in action. In addition, the Law & Politics attorney-led research department reviews the nominees' credentials based on a set of evaluation criteria, including confirmation of their license and any history of disciplinary action (which would remove them from consideration). To ensure a diverse and well-balanced list, the research staff considers factors such as firm size, practice area and geographic location.

Washington, D.C. Super Lawyers is published annually in March in Washington, D.C. Super Lawyers magazine, which is delivered to 39,000 readers - Washington, D.C. lawyers, the lead corporate counsel of the Russell 3,000 companies and all ABA-approved law school libraries. Washington, D.C. Super Lawyers is also available to 357,000 readers of The New York Times (Washington, D.C. distribution) in an annual special advertising supplement in March. Super Lawyers identifies the top five percent of attorneys in Washington, D.C. The 2007 Washington, D.C. Super Lawyers is based on a survey of more than 35,000 lawyers across the District of Columbia.
