Dorsey & Whitney Nationally Ranked Among Most-Retained Securities Litigation Firms
As reported by the Star Tribune, Dorsey & Whitney LLP was ranked by Portfolio Media Inc. among the top 10 most-retained securities litigation defense firms in the country for 2006. Dorsey entered the top 10 based on 19 new securities cases taken on during 2006.

Portfolio Media, Inc. conducts the annual independent business litigation trends study (Law360 Litigation Almanac) based on securities fraud cases brought in federal courts in 2006, as reflected by U.S. district court dockets.

Cozen O’Connor Members Mark H. Gallant and John R. Washlick Present at 13th Annual Health Law Institute
Cozen O’Connor members Mark H. Gallant and John R. Washlick recently served as faculty members at the 13th Annual Health Law Institute, sponsored by the Pennsylvania Bar Institute (PBI). Gallant was a keynote panelist for the opening session on “The Health Law Year in Review” and also presented “Out of Network Payments: The What’s, When’s and How’s of Payment,” and Washlick addressed “Exposing and Examining Vendor Relationships.” The two-day event, held at the Pennsylvania Convention Center in Philadelphia on March 13 and 14, 2007, was comprised of 45 substantial workshops and offered 12 CLE credits.

Gallant, resident in the Philadelphia office and co-chair of the firm’s health law practice group, concentrates his practice in client counseling and litigation involving state and federal regulation of health care providers and third-party payers. He served as the deputy chief counsel to the health care financing administration in Washington, D.C., where he managed all litigation under the national Medicare and Medicaid programs for the federal government. He also served 10 years with the civil division of the U.S. Justice Department and has served as counsel of record in litigation and other matters for major health care institutions and for national and state trade associations representing hospitals, pharmacy chains and long term care providers. He has served as a core member of the National Legal Committee of the American Association of Homes and Services for the Aging and as vice chair of the American Bar Association’s Medicare Reimbursement Committee.

Gallant is a recipient of Martindale Hubbell’s highest rating, was designated a Pennsylvania Super Lawyer by his peers and was selected for inclusion in the health care law category of the 2006 edition of The Best Lawyers in America. He has authored numerous articles and lectured widely for various healthcare associations. He is the author of the Medicaid reimbursement section of the American Health Lawyers Association’s (AHLA) (Clark, Boardman, Callaghan) three-volume Health Law Practice Guide and speaks regularly at AHLA and Pennsylvania Bar Institute programs on healthcare reimbursement and fraud issues.

A resident of Bala Cynwyd, Pa., Gallant earned his undergraduate degree from Rutgers University (B.A., 1972) and his law degree from the Georgetown University Law Center (J.D., 1975). He is admitted to practice in Pennsylvania and the District of Columbia, and before the U.S. Supreme Court.

Washlick concentrates his practice in health law and practices in the firm’s HIPAA and corporate compliance practice from the Philadelphia and Cherry Hill offices. He advises hospitals, physicians, entrepreneurs and health care organizations on a variety of corporate, tax and health care regulatory matters, serving as both general and outside counsel for health care mergers, affiliations and joint ventures, including planning and developing hospital/physician integration and incentive compensation arrangements.

Washlick is a member of the American Bar Association, Pennsylvania Society of Health Care Attorneys and the health and hospital section of the New Jersey State Bar Association. He is past chair (2003-2006) of the Hospitals and Health Systems Practice Group of the American Health Lawyers Association, co-chair of the Health Law Committee of the Camden County Bar Association, and serves on the health care law committee of the Pennsylvania Bar Association and the health law and non-profit committees of the Philadelphia Bar Association. He is listed in The Best Lawyers in America and was selected a “Pennsylvania Super Lawyer” by his peers, appearing in Philadelphia Magazine and Pennsylvania Super Lawyers. He is the author of the first edition of the portfolio “Joint Ventures Involving Tax-Exempt Organizations” and of the first and second edition portfolio, “Nonprofit Healthcare Organizations: Federal Income Tax Issues,” both of which are published by Tax Management Inc.

Washlick is an adjunct professor of law in the health law LL.M. program at Widener University School of Law and an adjunct professor of law in the graduate tax program at Villanova University. A certified public accountant, he was a tax manager in the national office of a Big Four accounting firm before practicing law. He is admitted to practice in Pennsylvania and New Jersey.

Cozen O’Connor Member Ned E. Tolbert Presents at Combined Claims Conference
Cozen O’Connor member Ned E. Tolbert recently presented at the 19th Annual Combined Claims Conference in Industry Hills, Calif. Tolbert spoke on “Unveiling the Mystery of Workers’ Compensation Subrogation.” He discussed the identification of third parties and the recovery of workers’ compensation payments from them, as well as the theories of recovery and the amount recoverable under California law.

Resident in the firm’s San Diego office, Tolbert practices with the subrogation and recovery department. He concentrates his practice on casualty and property recovery, as well as workers’ compensation subrogation. Prior to joining Cozen O'Connor, Tolbert maintained a private practice in Sacramento, Calif., practicing civil litigation and insurance subrogation from 1988-2001. He is a certified mediator through the California Alternative Dispute Resolution Programs Act and has served as a judge pro tem in Sacramento and Yolo Counties.

Tolbert earned his undergraduate degree from the University of the Pacific (B.A., 1978) and his law degree from the University of San Francisco School of Law (J.D., 1983). He served as a judicial clerk for the Third District Court of Appeals in 1981 for the Hon. George Paras.

Cozen O’Connor Member John R. Washlick Lectures on Health Law Matters at Recent Conferences
Cozen O’Connor member John R. Washlick recently lectured to several groups on health law matters. Washlick lectured on “Hospitals and Their Medical Staffs – Recruitment and Retention” for the Healthcare Financial Management Association 2007 Conference in Phoenix, Ariz., on February 18, 2007, and co-presented on “Vendor and Pharmaceutical Gift Giving, Marketing and Compliance,” at the American Health Lawyers 2007 Physicians and Physician Organizations Law Institute in Las Vegas, Nev., on February 5, 2007. He also participated in a teleconference on “Emerging Legal Risks for Hospital and Physician Partnerships” sponsored by Health Law Week, Hospital Litigation Reporter and the Legal Publishing Group of Strafford Publications on February 27, 2007.

These lectures discussed a range of health law issues, including the recruitment and retention of physicians; the legal implications and compliance considerations involved in pharmaceutical marketing; the risks and advantages of joint ventures between physicians and hospitals; and pay-for-performance and gainsharing arrangements.

Cozen O’Connor Attorney Justin B. Wineburgh Discusses Life as an Entertainment Attorney
Cozen O’Connor member Justin B. Wineburgh recently participated in a panel discussion on the topic of “Real Life: You’re a Lawyer” at Widener University School of Law in Wilmington, Del. During the lecture, a part of Widener’s 2007 Speaker Series, Wineburgh discussed his experiences as an entertainment attorney and provided practical advice for future attorneys. Resident in the Philadelphia office, Wineburgh counsels clients in the entertainment industry in the U.S. and abroad. He represents clients in the film, television, music, new media and sports industries in complex tort, commercial, defamation, privacy, corporate, employment and intellectual property matters. Wineburgh has represented talent, writers, distributors, retailers, managers, agents, producers, music engineers, production companies and artists in a variety of matters, including litigation, contract negotiations, transactional matters and pre-litigation counseling, and has also served as production counsel.

Wineburgh is admitted to practice in Pennsylvania, New Jersey and Florida, and before the Pennsylvania Supreme Court, Supreme Court of Florida, Supreme Court of New Jersey and the U.S. District Courts for the Eastern and Middle Districts of Pennsylvania and the District of New Jersey. He has also been specially admitted to handle cases in New York, California, Illinois, Virginia, Delaware, Massachusetts, Connecticut, Michigan and the District of Columbia, as well as before the California Labor Commission.

Wineburgh is a member of the American, Pennsylvania and Florida bar associations, young lawyers' division of the Philadelphia Bar Association, sports and entertainment law section of The Florida Bar, American Intellectual Property Law Association, Philadelphia VIP and the Jewish Federation of Greater Philadelphia. He is active in numerous civic organizations, serves as a mentor to law students and newly admitted attorneys, and regularly handles pro bono matters for a variety of organizations.

In 2006, Wineburgh was selected as a Pennsylvania “Lawyer on the Fast Track” by American Lawyer Media and was also selected as a Widener University School of Law Alumni Spotlight Honoree, an award given to four alumni of the law school each year.

Wineburgh earned his undergraduate degree in electrical engineering from Lafayette College (B.A., 1994) and his law degree from Widener University School of Law (J.D., 1997), where he was editor/administrative board member of the Delaware Journal of Corporate Law, a member of the Moot Court Honor Society and a member of Phi Delta Phi, Harrington Inn, Honor Chapter. He served as a judicial intern to the Supreme Court of Pennsylvania, and as a law clerk for the Commonwealth Court of Pennsylvania.

Energy Partner Joins Baker & McKenzie LLP’S Houston Office
Baker & McKenzie LLP is pleased to announce that Steven P. Otillar has joined the Firm’s Houston office as a Partner in its Major Projects Practice Group. He joins Baker & McKenzie LLP from Squire, Sanders & Dempsey, LLP.

Steve’s transactional practice focuses on the areas of energy and infrastructure development, with a particular emphasis on international and cross-border work. He has served as counsel to several international corporations and provided comprehensive legal assistance to clients in Mexico, Brazil, Venezuela, Chile, China, Australia, Belgium, France, England, Pakistan and India. His diverse experience representing energy clients includes advising US companies in international oil and gas exploration and production matters, assisting with the acquisition and sale of foreign entities and assets, including producing oil and gas properties and wind and natural gas fired power plants; creating investment vehicles for international oil and gas development ventures; working on project teams for the development of natural gas fired power plants in Brazil and LNG regasification terminals in Mexico; conducting in-country due diligence on infrastructure privatization projects in Serbia and Nigeria; and analyzing numerous international regulatory regimes to assess political and legal risks involved with pursuing concessions for oil and gas exploration.

Patten Appointed Chair of Colorado Hispanic Bar Committee
Denver lawyer Jack D. Patten, III, was appointed Chair of the Education Committee of the Colorado Hispanic Bar Association.

Patten, who was the past President of the Latino Law Student Association at the University of Denver, was appointed to head the Education Committee because he is viewed in the community as a strong advocate for higher education and using mentorship programs as a means to aid Latinos and other minorities in attaining their educational goals.

The Colorado Hispanic Bar Association was founded in 1977 and is committed to expanding opportunities for Latino attorneys in the Colorado legal profession and improving the life and opportunities of Latinos in Colorado.
