Jim Gray Appointed to Workers’ Compensation Board of Review
James D. Gray, a member in the law firm of Steptoe & Johnson, was appointed on March 26, 2007 by Governor Joe Manchin to a six-year term on the Workers’ Compensation Board of Review in Charleston. Gray will serve as one member of a three-judge panel, which hears and decides workers’ compensation appeals from the Office of Judges.

“Jim brings extensive experience to this post. We congratulate him on his appointment and echo Governor Manchin’s confidence in his ability to serve with distinction,” states Robert M. Steptoe, Jr., CEO.

For over twenty-five years, Gray has focused his practice in the areas of workers’ compensation and commercial litigation. A decorated Vietnam veteran and former Air Force officer, Gray served as a former member of the Benedum Airport Authority. He is admitted to practice in West Virginia and Pennsylvania and has served as a member of the West Virginia State Bar Board of Governors and the State Bar Grievance Committee.

Gray received his legal education at the West Virginia University College of Law, where he was Associate Editor of the West Virginia Law Review.

Siller Wilk LLP assists Jacob K. Javits Convention Center in first phase of $1.7 Billion modernization and expansion
In August 2006, Rob Reichman and Jonathan Weiss of Siller Wilk LLP represented the New York Convention Center Operating Corporation, the state agency that operates the Jacob K. Javits Convention Center (the “Javits Convention Center”) in New York City, in connection with the Javits Convention Center’s sale of two office/industrial buildings: the Yale Building at 460 Twelfth Avenue, New York, NY, and the Lowenstein Building at 608 West 40th Street, New York, NY. The buyer was the New York Convention Center Development Corporation. Siller Wilk LLP had previously represented the Javits Convention Center in connection with the leasing of the Yale Building. The New York Convention Center Development Corporation is an affiliate of the Empire State Development Corp., the state agency which developed the Javits Convention Center. It was represented in the transaction by Skadden, Arps, Slate, Meagher & Flom LLP.

The sale of the Yale and Lowenstein Buildings is the first phase of the planned $1.7 billion modernization and expansion of the Javits Center, which is scheduled to commence in 2007. Among other things, the modernization project will increase exhibition space at the Javits Convention Center from the current 760,000 square feet to 1.1 million square feet and create a six-block-long 100-foot-high concourse, together with the city’s largest ballroom and a 1,500-room hotel.

Fowler Co-Authors War-Zone Contractor Article
SHB Partner Greg Fowler partnered with C. Douglas Goins (Lockheed Martin Corp.) and Taavi Annus (J.D. Candidate, University of Missouri--Columbia School of Law) to publish an article in the Thomson West Briefing Paper Series about "Regulating Contractors in War Zones: A Preemptive Strike on Problems in Government Contracts." This timely and comprehensive piece considers, among other matters, the layers of regulation affecting contractors who provide services to the U.S. government in war zones, the scope of contractor activities, standards for contractors and their personnel, liability issues, and contract oversight and accountability. The article also provides succinct guidelines to assist those negotiating and performing contracts for duties to be performed in war zones. According to the article, "a contractor's operation in war zones may carry with it various risks for its employees, including their losing prisoner-of-war status and their being prosecuted for war crimes when engaged in fighting or even facing prosecution under the laws of the country in which the contractor is operating." Some government contractors are occasionally called on to "perform functions that could be characterized as direct participation in hostilities . . . there is no clear demarcation between direct and indirect participation." Further risks exist if a contractor withdraws from performance or is ordered to evacuate, suspend or cancel the performance of contractual duties. The article faces these issues squarely and suggests how flexible government regulations, careful contract selection and drafting and consolidated oversight could go a long way toward addressing problems that have arisen for firms operating in Iraq and Afghanistan.

McLaughlin Appointed to Justice for Children Board of Directors
Partner Scott McLaughlin has been appointed to the board of directors of Justice for Children, a national child advocacy organization.

Scott's dedication to children's rights dates to a pro bono matter he handled for Justice for Children in 1995. It was his first pro bono case. Yavapai-Apache v. Mejia, 906 S.W.2d 152 (Tex. App. 1995).

Ms. Sterba's practice focuses on advising clients on a wide-variety of domestic and international intellectual property matters, including trademark, unfair competition, copyright, false advertising, licensing, litigation and counseling. She has experience in all aspects of federal district court litigation of intellectual property matters and in opposition and cancellation proceedings before the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office.

Mr. Tollefson focuses his practice mainly on patent matters, including preparation and prosecution of patent applications, patent infringement litigation (plaintiff and defense) and patent infringement and validity opinions. He also counsels clients on patent strategies, due diligence, portfolio development, and implementation of strategic intellectual property plans.
