EG&S WINS DISMISSAL OF FIRST AMENDMENT AND AMERICANS WITH DISABILITIES ACT CLAIMS
EG&S successfully argued in the United States District Court for the Middle District of Pennsylvania for the dismissal of First Amendment and disability claims filed against the City of Wilkes-Barre and its Mayor and Fire Chief by a former Deputy Fire Chief. The plaintiff alleged that he was demoted and subsequently constructively discharged for political reasons, and due to an alleged disability. Plaintiff had originally filed a complaint with the Pennsylvania Human Relations Commission (“PHRC”) where EG&S won a PHRC finding of “no probable cause” of discrimination. Thereafter, the plaintiff commenced an action in federal court. The District Court, however, agreed with EG&S that the PHRC filing did not toll the statute of limitations on either the Constitutional First Amendment claim or the Americans with Disabilities Act claim, and dismissed the case.

John G. Dean and Paula L. Radick of EG&S’s Wilkes-Barre office represented the City of Wilkes-Barre, its Mayor and Fire Chief.
