James T. Blaine Lewis Named Partner
Woodward, Hobson & Fulton, L.L.P. announced today that James T. Blaine Lewis has been named a partner in the firm. Blaine joined the firm’s Louisville office in 1998 and concentrates his practice in the areas of product liability, FELA and railroad defense, trucking, professional liability and general tort litigation.

Blaine has an active trial practice and has tried several cases to verdict during his career. He has argued before the Kentucky Court of Appeals, the Kentucky Supreme Court and the Sixth Circuit Court of Appeals. He is admitted to practice before all state and federal courts in Kentucky, as well as the Sixth Circuit and United States District Court for the Southern District of Indiana.

While in law school at the University of Kentucky, Blaine was editor-in-chief of the Journal of Natural Resources and Environmental Law, authoring the article, The RCRA Citizen Suit Provision and the Private Remedy of Restitution After KFC Western, Inc. v. Meghrig and Furrer v. Brown: Reasonable Minds May Differ, 11 J. Nat. Resources & Envtl. L. 155 (1995-1996).

Blaine has served for two years on the Louisville Legal Aid Society Campaign for Justice. He is a 2003 graduate of the International Association of Defense Counsel Trial Academy and is a member of the American, Kentucky and Louisville Bar Associations. Blaine is also a member of the National Association of Railroad Trial Counsel, the Defense Research Institute and the Brandeis Inns of Court.

JMBM Expands Into Orange County
To better serve its existing Orange County client base, Jeffer, Mangels, Butler & Marmaro LLP (JMBM), one of California’s foremost full-service law firms, today announced the opening of a full-service office in Costa Mesa, California. Gordon A. Schaller, a prominent Orange County tax and estate planning attorney, will manage the office.

"Since our inception over 25 years ago, we have been fortunate to have a loyal client base in Orange County," said Bruce P. Jeffer, managing partner of JMBM. "Opening an office here will enable us to provide a more personal level of service to existing clients while offering excellent legal and business representation to new clients."

Focusing on mid-market companies, JMBM's new office offers full-service capabilities. Mr. Schaller, along with select attorneys from the Firm's existing offices in Los Angeles and San Francisco, will provide extensive experience in corporate transactions and representation, intellectual property issues, mergers and acquisitions, litigation, labor and employment, environmental, real estate and tax planning.

Immediately prior to joining JMBM, Schaller was the founder and managing shareholder of Greenberg Traurig's Orange County office.

Partner Advises Use of Waiver in Employment Applications
Most employers go to great lengths (and expense) to reduce their exposure to employment-related claims. Bryan Cave LLP Partner Bill Wortel says including an express waiver that contractually shortens the applicable limitations period for certain types of employment-related claims is a simple, inexpensive way to help limit an employer’s potential liability.

Wortel outlines the advantages of including an express waiver in an employment application, which claims should be included in the waiver, which should be excluded and how the waiver should be implemented in the March issue of the Employment Law Strategist.

Wortel recently was appointed to the Editorial Board of the Employment Law Strategist. He has represented management in a variety of litigation at the administrative level, in state and federal courts and in the U.S. Court of Appeals. His experience includes defense of actions alleging violations of Title VII of the Civil Rights Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Family and Medical Leave Act, ERISA and the Illinois Human Rights Act. He also has defended employers against claims of retaliatory discharge, breach of contract, defamation, intentional infliction of emotional distress, negligent retention, negligent supervision, public disclosure of private facts and intrusion upon the seclusion of another.

Wortel also helps employers develop, implement and apply personnel policies and employee handbooks. He has presented client seminars on topics that include harassment, proper employee evaluation, discipline and termination in light of state and federal employment laws.

Amy Stipe and Brad Welsh Elected Shareholders

In the Oklahoma City office, Amy Stipe has become a shareholder. She received her Juris Doctorate (with honors), Order of the Coif, from the University of Oklahoma in 1999 and her undergraduate degree in Psychology in 1995. Ms. Stipe’s legal practice is in the areas of Civil Litigation.

In the Tulsa office, Bradley W. Welsh has become a shareholder. He received his Juris Doctorate from the University of Texas in 1999 where he was the Articles Editor for the Texas Law Review. He earned his master’s degree in Economics in 1996 and an undergraduate degree in Government from the University of Oklahoma in 1994.
