Texas District Court Dismisses Patent Claims Against Sony Electronics Inc.
"Kenyon & Kenyon LLP successfully represented Sony Electronics Inc. in the U.S. District Court for the Western District of Texas, dismissing the patent claims by Wireless Agents, LLC against our client with prejudice. While other defendants still remain in the case or paid to settle the case, our dismissal was granted without any payment to plaintiff. The technology involved in the case is related to handheld electronic communication devices.

E. Todd Wilkowski to Serve as General Counsel of Baker Concrete Construction
"E. Todd Wilkowski, partner at Keating Muething & Klekamp, has recently accepted an offer to serve as General Counsel of Baker Concrete Construction at the company’s corporate headquarters in Monroe, Ohio. He will also serve as General Counsel to Baker Concrete’s three subsidiary companies.

Mr. Wilkowski has extensive arbitration and mediation experience in the construction industry. He has spent the majority of his career defending companies from claims of negligent workmanship/construction defect claims, fraud claims, breach of contract claims and ERISA breach of fiduciary claims. Mr. Wilkowski received his J.D. from Regent University School of Law, magna cum laude (1998), his M.A. from Regent University School of Public Policy, with honors (1998) and his B.S. from the United States Air Force Academy, with military honors (1989).

Baker Concrete, the largest concrete construction company in the United States, also has operations in Texas, Florida, Colorado, and Arizona. 93 Lateral Attorneys Expand Hunton & Williams’ Texas Presence
"Hunton & Williams LLP today announced it has added 93 new lateral attorneys which significantly grows the firm’s presence in Texas. The attorneys joined from Jenkens & Gilchrist’s offices in Dallas, Austin, and Houston. Of those joining, 87 will be in Dallas, five in Austin, and one in Houston. The firm will open a new Austin office.

With these additions, Hunton & Williams will have nearly 1,000 lawyers in 19 offices worldwide and will be one of the largest non-Texas-based law firms in Dallas. The Dallas office will grow from 70 lawyers to 157.

The attorneys are enlarging the following practice areas: financial institutions, corporate, financial services, real estate, litigation, bankruptcy, tax, and estate planning. “Hunton & Williams has had a substantial presence in Dallas since 2002. We have always been interested in increasing the depth and breadth of our practice in Dallas, specifically, and Texas, more generally, if the situation was right,” said Wally Martinez, managing partner of Hunton & Williams. “These high-quality lawyers align with our current national practices. Coupled with our strength in the energy sector, these additions will allow us to provide major capabilities in the energy lending arena.”

Patrick E. Mitchell, one of the new partners, will serve as the Dallas office managing partner and Curtis G. Carlson, long-time Hunton & Williams partner, as the office administrative partner. They will also be administratively responsible for the Houston office. In Austin, Chet A. Fenimore will serve as office managing partner and Jeanne “Zonnie” P. Breckinridge will serve as office administrative partner.

“All of the attorneys have explored several options over the past few months. It was important to everyone to find a firm that was compatible in terms of clients, practice areas, and culture,” said Mitchell, new Hunton & Williams’ Dallas office managing partner. “Each of these excellent lawyers ultimately decided Hunton & Williams was the best fit, and we are extremely pleased to join the firm."

Firm Advises S.A.C. in Successful Proxy Contest for Take-Two
It was announced that a group of key shareholders, including Willkie client S.A.C. Capital Management LLC, successfully replaced the board of directors of Take-Two Interactive Software, a video–game publisher that is currently beset with a host of legal, regulatory and accounting problems. S.A.C., together with OppenheimerFunds Inc., D.E. Shaw Valence Portfolios LLC, and Tudor Investment Corp., succeeded in removing the board and replacing it with six new directors. Additionally, the number of board seats was increased to seven from six in order to reappoint the recently-ousted Grover Brown as the seventh director. The newly elected board immediately nominated a new chairman and named an acting chief executive.

The investor group owns a collective 46% of the outstanding shares of Take-Two. As reported widely in the press, including The Wall Street Journal, this was an unusual maneuver as it involved the cooperation of several hedge funds and mutual funds. The contest came on the heels of the company’s founder and former CEO pleading guilty to falsifying records in a stock option backdating scheme. Take-Two publishes the widely popular Grand Theft Auto game franchise, the backbone of the company.

Sheppard Mullin Lands Land Use Partners
Judy V. Davidoff and Arthur J. Friedman have joined the San Francisco office of Sheppard Mullin Richter & Hampton LLP as partners in the firm's Real Estate, Land Use and Environmental practice group. Davidoff and Friedman most recently practiced with Steefel, Levitt & Weiss in San Francisco.

Davidoff's practice emphasizes land use, environmental and development law. She focuses on all aspects of state and federal land use and environmental matters, including CEQA/NEPA compliance, natural resources, air and water law, public trust and coastal matters, endangered species, cultural and historic resources, initiatives and referendums, public land permitting, and administrative proceedings and litigation.

Friedman has extensive experience litigating real estate, land use and various commercial matters. He also has significant experience practicing before the California Courts of Appeal, which resulted in a number of recently published decisions concerning the interpretation of CEQA and the Subdivision Map Act.

"Judy is a star in the area of land use law. Her talents, combined with Art's litigation experience, will significantly enhance our real estate practice, which is already one of the best in California," said Guy Halgren, chairman of the firm.

Davidoff received her B.A., summa cum laude, from the State University of New York, Albany in 1973 and her J.D., with honors, from Boston College in 1977. Friedman received his B.A., cum laude, from Yale University in 1989 and his J.D., with honors, from the University of Texas, Austin in 1992.

SCHIFF HARDIN LLP EXPANDS ENERGY PRACTICE WITH KEY ADDITIONS IN THE WASHINGTON, D.C. OFFICE AND IN BOSTON
Already a major player in the Energy/Federal Energy Regulatory Commission (FERC) law field nationwide, Schiff Hardin LLP has significantly expanded its capabilities in this practice with the addition of eight attorneys and one legislative affairs specialist, formerly with Sullivan and Worcester LLP. Six attorneys and the legislative affairs specialist have joined Schiff Hardin's long-established Washington, D.C. office along with two more attorneys who are establishing a Schiff Hardin office in Boston.

Sherry A. Quirk
Ms. Quirk was recently named one of the Top Fifty Women Lawyers in Washington, DC. She concentrates in energy law, and her career has included extensive involvement in numerous regulatory, transactional, and legislative issues. She has significant experience in representing an Independent System Operator, rural electric cooperatives, and municipal systems before the Federal Energy Regulatory Commission, the courts, the Department of Energy, and the Congress. She is also heavily involved in issues related to the Federal power marketing program. She began her legal career at the Federal Energy Regulatory Commission as a law clerk in the Office of Administrative Law Judges and also served as an opinion writer at the agency. She received her undergraduate degree (A.B., 1976) from Mount Holyoke College and her law degree (J.D., 1982) from Washington College of Law, American University.

Regina Y. Speed-Bost
Ms. Speed-Bost concentrates in energy administrative and regulatory law. She advises electric utilities on matters related to the operation of regional transmission organizations, retail gas electric and gas competition, Open Access Transmission Tariff (OATT) operations, standards of conduct compliance, and the interplay of federal wholesale regulation and state and local retail regulations. Previously, Ms. Speed-Bost was the legal advisor for natural gas and oil pipeline matters to Commissioner William L. Massey of the Federal Energy Regulatory Commission and earlier served as both an advisory attorney in the Commission's Office of General Counsel and as a trial attorney in the Commission’s Enforcement Division. She received her undergraduate degree (A.B., 1987) from Dartmouth College and her law degree (J.D., 1990) from the Georgetown University Law Center.

Thomas B. Ingoldsby
Mr. Ingoldsby is a transactional lawyer participating in financings of infrastructure projects for state and local governments. The financings have been in the form of tax exempt and taxable bonds, leases, and other forms of securities. He has a national reputation for his work in tax exempt lease purchase financings and in-depth knowledge of the issues and the practices in the marketplace relevant to the financing of large infrastructure projects. Before entering into private practice, Mr. Ingoldsby was a trial attorney with the Office of Chief Counsel of the Internal Revenue Service in Denver, Colorado. He received his undergraduate degree (B.A., 1967) from Brown University and his law degree (J.D., 1970) from the Duke University School of Law.

David A. Fitzgerald
Mr. Fitzgerald focuses his practice on representing electric utility clients with respect to transactional, regulatory, litigation, and legislative matters. His experience also includes six years working on Capital Hill. During that time, he was on the staff for Senator Howard M. Metzenbaum (D-OH) on the Environment and Public Works Committee and the Labor and Human Resources Committee, during consideration of the Energy Policy Act of 1992. Mr. Fitzgerald received his undergraduate degree (B.A., Political Economy, 1988) from Colorado College and his law degree (J.D., 1995) from the Catholic University of America, Columbus School of Law.

Montina M. Cole
Montina M. Cole's practice includes both litigation and legislative initiatives, primarily with respect to electric utility regulation. She focuses on utility industry restructuring issues. Ms. Cole represents clients before the Federal Energy Regulatory Commission (FERC), the courts, local regulators and legislators on Capitol Hill. She has extensive experience with utility holding company issues, including those arising out of the Public Utility Holding Company Act of 1935 and Energy Policy Act of 2005. She also advises clients on matters including transmission open access, regional transmission organizations, utility diversification, affiliate transactions, demand response and energy efficiency. Ms. Cole previously served as Special Counsel to the General Counsel at the U.S. Department of Commerce and on the congressional staff of former U.S. Representative Jim Slattery. She received her undergraduate degree (B.A., cum laude, 1988) from Washburn University and her law degree (J.D., 1991) from the University of Virginia School of Law.

Stanley P. Wolf
Stanley P. Wolf concentrates his practice on ISO development, particularly the development of ISO-NE. He advises various participants in the electricity and natural gas and oil pipeline industries concerning the impact of regulatory measures to increase competition and restructure the industry. Mr. Wolf also has extensive experience in corporate mergers, bankruptcy issues, oil pipeline, and natural gas certificate matters. Mr. Wolf received his undergraduate degree (B.A., cum laude, 1974) from the University of Minnesota, his graduate degree (M.A., Economics, 1977) from the University of California, Los Angeles, and his law degree (J.D., 1977) from the University of California, Los Angeles — School of Law.

Robin E. Remis
Robin E. Remis represents electric power and natural gas utility clients before the Federal Energy Regulatory Commission (FERC), appellate courts and state regulatory commissions. She also advises clients on electric industry restructuring as well as matters related to the operation of ISOs and other regional transmission organizations, including market design and development. Ms. Remis negotiates energy transactions, including contracts involving traditional as well as renewable energy resources. In addition, she has assisted municipalities seeking to form municipal electric companies and has acted as co-counsel in stranded cost litigation before both state and federal agencies. Earlier in her career, she served as an attorney-advisor at the FERC's Office of Administrative Law Judges. She received her undergraduate degree (B.A., 1991) from Union College and her law degree (J.D., cum laude, 1996) from the Catholic University of America, Columbus School of Law.

Monica M. Berry
Monica M. Berry concentrates her practice on energy regulation and litigation. Earlier in her career, she was an attorney-adviser to the Honorable Carmen A. Cintron and the Honorable William J. Cowan at the Federal Energy Regulatory Commission (FERC). Her prior experience also includes a brief tenure at a Japanese law firm and at an American investment bank in Tokyo, Japan. Ms. Berry's illustrative representations include a client before the FERC in its design and implementation of a locational installed capacity market in New England. She received her undergraduate degree (B.A., cum laude, 1998) from the University of South Florida, her graduate degree (M.S., 1999) from the London School of Economics and Political Science, and her law degree (J.D., 2002) from the Boston University School of Law.

Christopher E. Eckl
Christopher E. Eckl is a legislative affairs specialist who has served as a Washington Representative for the Tennessee Valley Authority and as a government relations representative for the American Public Power Association, a national association of municipally owner electric systems. He worked as a news reporter on daily newspapers in Northern Alabama and at the Associated Press, Atlanta Bureau, before joining the TVA Information Office. He received his undergraduate degree (B.A., Journalism, 1956) from the University of Notre Dame.
