Limestone Approves Tax Increment Financing Plan for Cogen Plant at Loring
Officials with the Town of Limestone, Loring BioEnergy, LLC, and the Loring Development Authority announced the approval by the town of a tax increment financing plan in connection with a major 55-megawatt cogeneration project planned for Loring Commerce Centre. The 55-megawatt cogeneration development will generate electricity, produce steam for Loring Commerce Centre businesses and enable the 185-mile Searsport-Loring pipeline to deliver natural gas to Aroostook manufacturers. Preti Flaherty's Corporate and Energy Groups represent Loring BioEnergy on multiple matters related to the project.

According to Loring BioEnergy Principal, Hayes Gahagan “The fifteen (15) year tax increment financing arrangement is a critical tool for moving forward with a project that has many positive direct and indirect benefits to Limestone as well as the Aroostook County region. The project will provide in the order of 700 peak construction jobs and more than 40 direct and indirect permanent operating jobs and will take advantage of available facilities at the former Loring Air Force Base. The availability of steam from the cogen plant can significantly enhance the profitability of other businesses that happen to be located nearby.”

Limestone Town Manager Donna Bernier stated, “We’re happy to support this major new investment in facilities at Loring. The town will gain new tax base and employment opportunities for its residents. To date, the successes at Loring have largely taken place within existing structures. The cogen plant would represent the first major investment in new plant and equipment since before Loring’s closure. It’s a clear indication of the great potential for additional industrial development at Loring.”

Carl Flora, President & CEO of the Loring Development Authority stated, “The town’s support of this project may well prove to be a key milestone to Loring’s continued redevelopment. Once built, the cogen plant will not only be a reliable source of power generation for the region, but it will represent a key piece of industrial infrastructure for Loring Commerce Centre. Steam produced by the plant will be a source of low cost heat for the many large buildings at Loring and process steam will be available to support new manufacturing endeavors.”

In addition to constructing a new state-of-the-art plant with the latest environmental controls, the project will result in the conversion of the Searsport to Loring pipeline for the transmission of natural gas. This would represent the first time natural gas has been available in Aroostook County. It is possible that gas can be provided to support the operations of other industrial facilities either at Loring or at various industrial sites along the length of the pipeline.

The Loring Development Authority is charged with the redevelopment of the former Loring Air Force Base which closed in 1994. Loring Commerce Centre, located in Limestone, is now the home of more than 20 new employers which now provide employment for 1500 Aroostook County residents, with operations occupying 1.7 million square feet of existing building space. Opportunities exist for additional businesses in manufacturing, telecommunications and data-based services, education, aviation and housing.

The TIF requires Loring BioEnergy to pay the Town a series of reduced property tax payments, rising incrementally over the 15 – year life of the TIF. The TIF disappears totally after year 15 with property taxed at its full valuation.

Loring BioEnergy is the entity formed to pursue the project and is led by Gahagan & Associates, LLC, an industrial developer based in Presque Isle, Maine, with other co-venturers.

DuPont Recognizes K&L Gates’ Progressive Policies and Legal Performance
Kirkpatrick & Lockhart Preston Gates Ellis LLP (K&L Gates) is pleased to announce that it has received DuPont Legal’s 2006 “Meeting the Challenge” award. The DuPont Legal Model, a comprehensive and integrated process that takes a business-focused and results-oriented approach to the law, helps law firms and corporate law departments improve the quality, cost and efficiency of legal services. DuPont created the Meeting the Challenge award to recognize the outstanding legal work and involvement and support from its law firms. This is the fifth such award DuPont has bestowed upon K&L Gates.

DuPont’s Senior Vice President, General Counsel and Chief Administrative Officer Stacey J. Lathrop & Gage Attorney Admitted to Exclusive Legal Association
