Donald H. Messinger to Receive Dauby Award From Cleveland Hearing & Speech Center
Donald H. Messinger will receive the 2007 Daniel D. Dauby Award at the Cleveland Hearing and Speech Center’s annual benefit this May. The award is in recognition of Messinger’s long-time support of the organization, which is the country’s oldest free-standing hearing and speech center. It focuses on issues regarding hearing, speech and deafness in Northeast Ohio.

Daniel Dauby, who was born deaf, was the son of Nathan L. Dauby, who served as general manager of the former May Co. Department Store for more than half a century. He also was the uncle of Robert Gries, the recipient of the first Dauby award. The award honors the legacy of the Dauby and Gries families and their involvement in and generosity to the CHSC since 1939.

“This award is an honor and a complete surprise,” says Messinger. “The Center does important work for our community and I have been pleased to serve them in a variety of roles. I know the importance of communication and the Center makes a real difference in the lives of children and adults who are deaf, or who have suffered a hearing loss, or who have speech problems. CHSC has been personally helpful to me and to my family members.”

Messinger has been involved with the CHSC for over 30 years. He is a trustee and twice served as president of the organization. He is also an active participant in numerous community initiatives and serves on the boards of many organizations including Business Volunteers Unlimited (trustee and secretary), the Cleveland POPS Orchestra (director), the Free Medical Clinic of Greater Cleveland (trustee and past president) and Senior Citizens Resources (trustee and past officer).

Messinger is a partner in Thompson Hine LLP’s Cleveland office and a member of the firm’s Corporate Transactions & Securities practice group. He has been a member of the firm’s Executive Committee and, prior to that, served as partner-in-charge of the Cleveland office.

Pillsbury Climate Change Lawyer Offers Insights into Supreme Court Ruling Against the EPA on Regulation of Automobile Emissions
Yesterday’s 5-4 decision by the Supreme Court found that states do have legal standing to sue the EPA regarding the regulation of carbon dioxide from automobile emissions. The court further ruled that the EPA has the authority to regulate carbon dioxide from automobile emissions under the Clean Air Act, and that if the agency does not want to regulate those emissions, it must give concrete, scientific reasons for not doing so.

“The Court’s reading sets unusually tight limits on EPA’s discretion to control its own agenda. Apparently, EPA can postpone regulation only if it can show that global warming science is too uncertain,” says Pillsbury Winthrop Shaw Pittman's Peter Wyckoff, a former EPA counsel based in Washington, DC, who now regularly defends companies against EPA enforcement actions under the Clean Air Act.

"While EPA may try to run out the clock until the 2008 election, the ruling could have significant ramifications, especially for new equipment burning fossil-fuels, if the agency concludes carbon dioxide is harmful. The impacts could reach beyond just the automobile industry, affecting nearly every business in the country,” Wyckoff added.

Pillsbury Winthrop Shaw Pittman launched one of the nation's first climate change and sustainability practices earlier this year. The firm's multidisciplinary practice advises clients nationally and internationally on the rapidly changing legal landscape relating to greenhouse gas (GHG) emissions. The group brings together nationally-recognized attorneys in environmental regulation, litigation, public policy, project finance, and corporate governance. As pressure to curb GHG emissions increases around the world, companies are concentrating on their sustainability policies and grappling with how to manage their own GHG emissions and related litigation risks.

Lawrence S. Chane, trust and estate partner at Blank Rome, was profiled in the spring issue of Inside magazine.

The article gives an intimate look at the lawyer and the man. Mr. Chane’s extraordinary focus and love for the law, from his teenage years to now, are revealed. Writes Sally Friedman, “law has been a calling that has involved Chane in high-level annuity trust planning, planning for family limited partnerships and a variety of sophisticated forms of estate planning and income tax solutions.”

“Chane knows that information is a powerful tool. But information without a sense of humanity and mission is far less so. ‘I try to remind people that it feels good to do good,’ said a man who lives by that anthem.”
