McDermott Partner Contributes to Antitrust Commission Recommendations
Today, the 12-member bipartisan Antitrust Modernization Commission (AMC) released its Report & Recommendations to the President and U.S. Congress. The report outlines recommendations concerning the Federal Trade Commission / U.S. Department of Justice review of mergers, the laws governing pricing arrangements and the enforcement of intellectual property rights.

One of the President’s appointments to the commission was Bobby R. Burchfield, co-partner-in-charge of McDermott Will & Emery's Washington, D.C. office and head of Firm's Complex Litigation Practice Group. Mr. Burchfield has practiced in the area of complex corporate litigation, including antitrust litigation, since 1981. He is highly rated by such services as Chambers Global, Chambers USA and other services.

"It was an honor to serve with this outstanding group of Commissioners and the exceptional staff," commented Mr. Burchfield. "Our final report is the product of extensive hearings and public comment, numerous public discussions and ongoing collaboration among the Commissioners, and intensive research by the Commission staff."

One of our most significant recommendations entails the streamlining and coordination of merger reviews among federal, state and international antitrust enforcement authorities. "The aim is to make merger reviews more efficient by encouraging greater cooperation among the various authorities," Mr. Burchfield said. Among other recommendations, the Commission also recommended legislative repeal of the Robinson-Patman Act, which prohibits certain forms of price discrimination, and legislative overruling of decisions prohibiting indirect purchasers of goods affected by price-fixing conspiracies from suing under federal law.

The Antitrust Modernization Commission was created pursuant to the Antitrust Modernization Commission Act of 2002, Pub. L. No. 107-273, §§ 11051-60, 116 Stat. 1856, to study the U.S. antitrust laws and determine whether they should be modernized. The Commission consists of four members appointed by the President, four members appointed by the leadership of the Senate, and four members appointed by the leadership of the House of Representatives.

Dykema Member Speaks At Automotive Product Liability Conference
"Sherrie L. Farrell, a member of the firm’s Litigation practice group, recently spoke on the topic of ""Freedom Of Expression On The Air"" at the 2007 Emerging Issues in Motor Vehicle Products Liability Litigation Conference at the Arizona Biltmore Resort & Spa on March 29-30, 2007. Ms. Farrell addressed the role of the news media in the law. This seminar was presented by the American Bar Association Tort Trial & Insurance Section – Products, General Liability and Consumer Law Committee and the Automobile Law Committee. She spoke on a similar topic at last year’s conference.

Ms. Farrell’s practice concentrates on commercial litigation, products liability and other business dispute matters. Ms. Farrell has represented individuals and corporations in a wide variety of matters in both state and federal courts. She also is an adjunct associate in the government policy and practice group at Dykema.

In addition to commercial litigation experience, Ms. Farrell has extensive experience in the areas of creditors’ rights, corporate debt restructuring, commercial law and as debtors’ and creditors’ counsel in Chapter 7, 11 and 13 proceedings.

Stephen M. Orlofsky Elected Vice-Chair of Legal Services of New Jersey Board
"Blank Rome LLP is pleased to announce that Stephen M. Orlofsky has been elected vice-chair of the Legal Services of New Jersey, Inc. Board of Trustees. Based in Blank Rome’s Cherry Hill office, Mr. Orlofsky serves as a partner in the Firm’s commercial litigation group.

Legal Services of New Jersey (LSNJ) is an independent, non-profit organization, which coordinates the statewide Legal Services system. As a vice-chair of the LSNJ Board of Trustees, Mr. Orlofsky will help to direct the efforts of the organization to ensure equal access to justice under the law to all people of New Jersey and to provide free legal assistance to low-income people in civil matters.

At Blank Rome, Mr. Orlofsky concentrates his practice in the areas of complex litigation and alternative dispute resolution and counsels clients on trial and appellate litigation strategy. Mr. Orlofsky served as a United States District Judge for New Jersey from 1996 to 2003. Prior to that, Mr. Orlofsky also served as a United States Magistrate Judge for New Jersey from 1976 to 1980.

In 2003, Mr. Orlofsky traveled to Iraq as part of a 13-member team jointly commissioned by the U.S. Department of Justice and the Department of State to assess its judicial system. Mr. Orlofsky spent 6 weeks in Iraq conducting interviews and gathering information to assist the Coalition Provisional Authority in reconstructing the Iraqi court system.

Mr. Orlofsky frequently lectures on various topics including Federal Practice and Procedure, Professional Ethics and Professionalism, Evidence, Electronic Discovery, Commercial and Criminal Litigation, and Appellate Techniques."

Lovita Tandy, Chair of King & Spalding’s Diversity Committee, A Featured Speaker At New York Conference on Retaining and Promoting Women Lawyers
"Lovita T. Tandy, a partner of King & Spalding, a leading international law firm, is a featured speaker at the American Conference Institute’s program Retaining & Promoting Female Attorneys in New York City May 22-23.

Tandy, who is chairman of King & Spalding’s diversity committee, will participate in a panel discussion on overhauling the assignment process to ensure an equitable division of work. Among the topics Tandy and other panelists will examine are the following:
