Covington Ranked World’s Top Life Sciences Firm
Covington & Burling LLP announced today it was awarded worldwide first place firm rankings by the Practical Law Company in both the Life Sciences Industry and Life Sciences Regulatory categories for the second consecutive year. The Life Sciences Industry Super League and Life Sciences Regulatory Super League law rankings, published in the Practical Law Company’s Cross-border Quarterly Handbook for April-June 2007, are based on an independent survey of industry and private practice lawyers. The overall life sciences rankings assess a broad range of legal services, including corporate partnering, IP, competition and antitrust, product liability, regulatory, and commercial law.

The article states that Covington “is one of the few firms to have developed a genuinely transatlantic full-service life sciences practice, with hubs on both the East and West Coasts of the US, and in London and Brussels.” The firm was singled out in the categories of regulatory work, commercial and partnering, competition/antitrust, corporate, intellectual property, and product liability. Twenty-three of the firm’s lawyers are named as leaders in their field.

Covington has consistently been one of the leading law firms in the area of life sciences. Over 160 firm lawyers, drawn from the different legal disciplines, are experienced advisers to the life sciences industry.

Manesh K. Rath, Keller and Heckman Partner, Featured on CSPAN
Manesh K. Rath, a Partner at the law firm Keller and Heckman LLP, participated in a panel discussion at the National Press Club that was televised on CSPAN 2. The participants talked with reporters about both sides of the April 18 U.S. Supreme Court case, BCI Coco Cola Bottling Co. of Los Angles vs. EEOC. This case involves federal anti-discrimination laws. The other panelists included leading experts from the Lawyers' Committee for Civil Rights Under Law, The National Partnerships for Women and Families, Workplace Fairness, and The University of Maryland, School of Law.

Mr. Rath was featured on the panel due to his involvement in the BCI Coca-Cola Bottling Company case. On February 20, 2007, Mr. Rath filed an amicus brief in the landmark U.S. Supreme Court case BCI Coca-Cola Bottling Company of Los Angeles v. U.S. Equal Employment Opportunity Commission on behalf of the Society For Human Resource Management (SHRM). The case examines the circumstances in which an employer is liable under federal anti-discrimination laws based on a subordinate supervisor's discriminatory bias where an employee was actually terminated by a neutral, unbiased decisionmaker.

Stephen Peters, an employee of BCI Coca-Cola Bottling Company, was asked to work over a weekend. Mr. Peters refused. His supervisor informed his human resource manager of Mr. Peters' refusal. The human resource professional asked several questions, examined Mr. Peters' personnel file, and then decided to terminate Mr. Peters. Mr. Peters sued, and submitted evidence that his supervisor was racially biased against African Americans.

The Tenth Circuit, adhering to holdings in several other federal circuits, held that an employer is liable for discrimination under Title VII if a biased supervisor's report was the cause of the HR manager's decision to terminate. The Tenth Circuit further held that the employer can avoid liability by conducting an adequate investigation prior to deciding to terminate, and that, at the least, that investigation should include asking the employee his side of the story.

Manesh Rath argued on behalf of SHRM that Title VII does not permit the courts to require an HR professional to conduct a full investigation for every termination. Mr. Rath and SHRM further argued that HR professionals should be allowed to use professional experience and business judgment to determine the appropriate action to take based on the circumstances at hand in order to achieve fairness and compliance.

Gide Loyrette Nouel Casablanca advised Capital Invest, a subsidiary of the Moroccan group, BMCE, on the creation of its second investment fund (EUR 35 million)
The Gide Loyrette Nouel Casablanca office advised Capital Invest, a subsidiary of the Moroccan bank, BMCE (Banque Marocaine du Commerce Extérieur), on the structuring and creation of the group's second private equity investment fund, which is its first "onshore" fund.

This new EUR 35 million fund, known as "Capital North Africa Venture" (CNAV), is the first fund in Morocco to include LBO transactions in its investment strategy. It will focus on large and medium-sized companies, mainly in the Moroccan market.

CNAV will involve European institutional investors (the European Investment Bank, Averroès Finance, the Belgian Investment Company for Developing Countries, the State Secretariat for Economic Affairs (Switzerland)) and Moroccan institutional investors.

The Gide Loyrette Nouel legal team advising BMCE for the purposes of this transaction included Hicham Naciri, partner, and Julien David, associate.

Four Briggs Attorneys on L & P Top 40 Employment Law List
Attorneys of the firm Briggs and Morgan, Professional Association comprised 10 percent of Minnesota Law & Politics’ latest “Top 40” list of leading Minnesota employment law attorneys. Four shareholders from the firm’s labor and employment law section are named in the April/May 2007 issue: Scott Davies, Michael J. Galvin Jr., Ann Huntrods and Gregory J. Stenmoe.

Scott Davies has focused his practice on defending corporations in all aspects of employment litigation for the past 25 years, though his trial experience spans more than three decades. He often serves as Apr-07 mediator in employment disputes. In 1997, Davies was honored as a fellow of the American College of Trial Lawyers.

Davies is admitted to practice in Minnesota state and federal district courts; the 8th, 9th and 10th circuits; and the U.S. Supreme Court. He received both his B.A. and J.D. degrees from the University of Minnesota, and joined Briggs in 1975.

Michael Galvin Jr. practices principally in the areas of labor, condemnation, municipal and employment law. He has tried cases in state and federal courts, and argued cases before the Minnesota Supreme Court and the 8th Circuit Court of Appeals. In addition, he is an arbitrator and mediator for the Minnesota Supreme Court.

Galvin counsels employers on discipline and discharge issues, litigation prevention, and assessment. He provides training to managers and employers on labor law issues, such as union campaigns for recognition, negotiation of collective bargaining agreements, unfair labor practices, and administration of labor contracts, including mediation and arbitration of labor disputes.

Galvin received his B.A. from the University of St. Thomas and his law degree from the University of Minnesota Law School. He joined Briggs in 1957. Ann Huntrods’ practice includes employment litigation and employment law counseling and training.

Huntrods has handled cases in state and federal court, and argued before the Minnesota Court of Appeals and the 8th Circuit Court of Appeals. She frequently assists employers in responding to charges brought before the Minnesota Department of Human Rights and U.S. Equal Employment Opportunity Commission (EEOC). She also serves as Briggs’ employment law attorney.

Huntrods has completed more than 30 hours of training in mediation and is listed as a neutral by the Minnesota Supreme Court. She graduated with highest distinction from the University of Iowa and received her law degree from the University of Minnesota cum laude. She received her M.A. in English and completed her course work for a Ph.D. in American studies from the University of Minnesota.

Huntrods joined Briggs in 1983. Gregory Stenmoe practices in the areas of employment litigation, non-compete agreements and restraining orders, employment law counseling and training, and internal corporate investigations. In his employment litigation practice, Stenmoe represents a number of high-profile clients and closely held businesses in the Twin Cities, providing counsel on discipline and discharge issues, litigation assessment and litigation cost analyses, and serves as a corporate trainer on issues such as litigation prevention, as well as sexual harassment awareness and prevention.

He has litigated cases in state and federal court and in numerous jurisdictions across the United States. In addition, Stenmoe has represented employers in cases appealed to the U.S. Supreme Court. He frequently prepares responses to charges brought before the Minnesota Department of Human Rights and the Equal Employment Opportunity Commission. Stenmoe is an honors graduate of the University of Minnesota. He received his law degree cum laude from William Mitchell College of Law. He joined Briggs in 1983.

Briggs’ John Degnan to Present at Annual Dental Association Meeting
John M. Degnan, a shareholder in the firm of Briggs and Morgan, Professional Association, will speak at Minnesota Dental Association’s annual state convention, the Star of the North Meeting 2007. He has been a featured presenter at the event for more than 10 consecutive years.

Degnan’s presentation, “Charting the Course,” will use case examples to explore proper recordkeeping and how new technology is changing the way dentists document and maintain patient records. It is a presession seminar scheduled for April 27.

John Degnan is an accomplished trial lawyer. He has more than 30 years of experience handling medical malpractice claims, prescription drug and pharmacy matters, product liability and issues relating to the Emergency Medical Treatment and Active Labor Act (EMTALA) and the federal False Claims Act.

Degnan is a frequent mediator in business disputes and employment, commercial and injury cases. He is a fellow of the American College of Trial Lawyers, as well as the American Board of Trial Advocates. He received his B.A. from the University of Minnesota and his J.D. from William Mitchell College of Law.

Minnesota Dental Association’s Star of the North Meeting 2007 will be held April 27-30 at the Saint Paul RiverCentre.

WHITEFORD, TAYLOR & PRESTON AMONG LEGAL 500
In its four-volume edition evaluating U.S. lawyers, the highly respected European publisher Legalease has ranked Whiteford, Taylor & Preston’s (WTP) Technology and Intellectual Property section as one of the leading IT practices in the United States. WTP is one of only 18 firms chosen nationwide.

Saul Ewing Associate Comments on "Salary Wars" Among Law Firms
Indira K. Sharma, an Associate in the Firm's Litigation Department in the Baltimore office, was quoted in this article about how law firms compete for first-year associates and the resulting escalation of first-year attorney salaries.

Ms. Sharma said that while salary is an important factor when deciding which law firm to join, other factors, such as a good quality of life and the opportunity to do meaningful work, are equally important.
