Stephen Oleskey To Receive ABA’s 2007 Pro Bono Publico Award
Partner Stephen Oleskey has been selected to receive the American Bar Association’s 2007 Pro Bono Publico Award, an award the firm also received in 1998. The Pro Bono Publico Awards program, presented by the ABA’s Standing Committee on Pro Bono and Public Service, seeks to identify and honor individual lawyers and law firms, government attorney offices, corporate law departments and other institutions in the legal profession that have enhanced the human dignity of others by improving or delivering volunteer legal services to our nation’s underprivileged. Steve, recognized for his lifetime dedication to providing such legal service, will be presented with one of five ABA Pro Bono Publico Awards to be given at the ABA Annual Meeting on August 13, 2007 in San Francisco, CA.

Since joining the firm almost forty years ago, Steve has been dedicated to high profile pro bono cases of national and international importance, as well as to smaller cases for disadvantaged clients in local communities. He has been an integral part of the firm’s Pro Bono and Community Service Committee since 1969. Steve has not only made pro bono representation a priority in his own career, but has also been an inspirational leader, encouraging others in the firm and legal community to become involved in pro bono services.

The firm congratulates Steve, alongside two other individuals, Robert E. Borton of San Francisco, California and Patricia Yoedicke of Minneapolis, Minnesota, as well as the firms Derfner, Altman & Wilborn of Charleston, South Carolina and Sidley & Austin of Chicago, Illinois for this outstanding honor and award for pro bono excellence.

Law Firm Helps KCPD Win Employment Case
A former investigative typist has no basis for her claims alleging disability discrimination, invasion of privacy and intentional and negligent infliction of emotional distress against the Kansas City Missouri Police Department. These claims arose after the Police Department asked its former employee to partake in a fitness-for-duty evaluation. On April 3, 2007, the United States Court of Appeals for the Eighth Circuit affirmed a lower court’s ruling granting summary judgment on all of the plaintiff’s claims, meaning the case was resolved in favor of the Department as a matter of law and there was no need for a trial. The case was appealed, and the Eighth Circuit affirmed.

Shughart Thomson & Kilroy, P.C. attorney Jim Sullivan represented the Kansas City, Missouri Police Department. “This decision is important because it establishes a very sound and understandable standard as to when an employer can require an employee to go through a fitness for duty evaluation to determine if an employee can perform the job. Employers can require such examinations when the examination is both job-related and consistent with business necessity,” said Sullivan.

A brief history:

The Kansas City Police Department asked the employee to take a fitness-for-duty evaluation
after a physician told her she was experiencing job-related stress, which caused her to miss several weeks of work. She was eventually placed in the department’s sick leave
pool. The employee then agreed to take a Fitness-For-Duty evaluation but then refused to
provide the needed medical records. Because she was a typist for the Police Department’s
Juvenile Unit, her job performance was a public safety issue.

“The police department can ask for a fitness-for-duty evaluation. This includes when the employee reports that job-related stress is adversely effecting attendance or where a medical or psychological condition may impact the safety of the employee or the public at the work place,” said Sullivan.

Sheppard Mullin Nabs New York Fashion Law Duo
Theodore C. Max has joined the New York office of Sheppard Mullin Richter & Hampton LLP as a partner with the firm's Fashion Apparel team. Special counsel Charles LeGrand will be joining Max on the move to Sheppard Mullin. Both most recently practiced with Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C. in New York.

Max focuses on IP litigation, transactional and licensing matters in the fashion industry, combining his skill and experience as a trial attorney with his knowledge of copyright, trademark and intellectual property law. He has counseled clients on and litigated numerous cases involving issues on the cutting edge of copyright and trademark law. Max has assisted clients in identifying, protecting and preserving their intellectual property assets, including seeking registration of rights in the United States and internationally and taking action against infringements of copyrights, trademarks and trade dress. He also has experience developing and implementing anti-counterfeiting programs and pursuing civil and criminal enforcement remedies.

Max has counseled representatives of some of the world's finest designers of fashion apparel and accessories with respect to their intellectual property concerns and problems, including Louis Vuitton Malletier, Emilio Pucci, Celine, Marc Jacobs, Kooba, Hollywould, LeTigre, Tarina Tarantino and others. He has actively litigated intellectual property issues, as well as licensing disputes, and the rights of publicity and privacy.

"Ted will play a key role in the expansion of our fashion industry capabilities, bringing an international who's who of clients which rivals our current list of global fashion designers and apparel corporations," said Bob Darwell, chair of the firm's Entertainment, Media and Communications, and Fashion Apparel groups. New York is the global fashion center, and Ted and Charles add significant depth to our industry specialization on the East Coast."

Max earned his B.A. in political science, summa cum laude, from Hobart College in 1980, with high honors. While at Hobart, he was elected to Phi Beta Kappa and was selected as a Rhodes Scholar Finalist. Max received his J.D. from New York University School of Law in 1983, where he served as editor-in-chief of the New York University Review of Law and Social Change and, with his partner, won the NYU Moot Court Competition.

The Fashion Apparel team is a global interdisciplinary practice which houses expertise of particular importance to the fashion industry, including legal specializations such as employment, entertainment, intellectual property, litigation and transactional. The team's client's include Abercrombie & Fitch, Taylor Made Golf Company and The Gap Inc. The team will be launching its own industry blog this month at www.fashionapparellawblog.com.

SCHIFF HARDIN LLP WELCOMES ROBERT J. MUETHING TO THE TAX GROUP IN THE ATLANTA OFFICE
Schiff Hardin LLP has added Robert J. Muething as a partner in the Tax Group in the Atlanta office. Mr. Muething joins the firm from Hunton & Williams LLP (Atlanta), where he was a partner.

Mr. Muething focuses on federal income taxation matters. He has extensive experience in planning, structuring, negotiating, and documenting transactions, including corporate merger and acquisition, joint venture and partnership, real estate, and structured finance transactions. He also has significant experience in tax controversy matters, including IRS Appeals Office work, and tax litigation.

Mr. Muething received his undergraduate degree (A.B., 1979) from Harvard University and his law degree (J.D., 1982) from the University of Notre Dame Law School. He is admitted to practice in Georgia.

Vanessa L. Whiting Joins Roetzel & Andress as a Partner in the Cleveland Office
The law firm of Roetzel & Andress is pleased to announce Vanessa L. Whiting has joined the Cleveland office as a partner in the Public Law group.

Ms. Whiting's principal practice areas are economic and community development law, real estate law including acquisition, development and leasing and financing, tax credit law, public finance and banking law. She also functions as a business consultant to her clients in the real estate, corporate, public finance and tax credits areas.

Moreover, Ms. Whiting is an active participant in the community, serving on the Boards of Trustees of numerous organizations throughout her career.

Ms. Whiting earned her juris doctorate from the University of Illinois College of Law, serving as a Department of Justice Honors Intern during that time. She received an M.S. in Urban Affairs Policy Analysis from Southern Illinois University and an A.B., cum laude, in Public Policy Sciences from Duke University.

The article explores the difference between a trade secret and a patent, and how the hiring, employment and departure of employees can impact the integrity of these secrets.
