District Court preliminarily approves settlement in BAR/BRI Antitrust Class Action.
If you purchased a bar review course from BAR/BRI anywhere in the United States anytime from August, 1997 through July 31, 2006 (the “Class”), you may be affected by a proposed settlement of a class action lawsuit pending in the United States District Court for the Central District of California called Rodriguez, et. al v. West Publishing Corp., d/b/a BAR/BRI, and Kaplan, Inc., Case No. CV-05-3222 R (MCx). This is to inform you of the nature of Plaintiffs’ claims, the Court’s preliminary approval of a proposed settlement and your right to participate in this Class (“Class Member”).

Federal Circuit Affirms Summary Judgment Ruling for Finnegan Henderson Client ProSlide
The Federal Circuit has affirmed a summary judgment ruling of noninfringement in favor of ProSlide Technology, Inc., a Finnegan Henderson client and manufacturer of theme park waterslides. ProSlide was sued for patent infringement in 2004 by a competing manufacturer, Water Fun Products, Inc., in the District Court for the Central District of California. Following a year of discovery, the district court granted summary judgment in ProSlide's favor, finding a number of limitations missing in the accused waterslides. The Federal Circuit affirmed that ruling in a Rule 36 per curium order.

Andrews Kurth Partner Receives ‘Women of Spirit’ Award
Andrews Kurth LLP partner Kathleen J. Wu will receive the "Women of Spirit" award from the American Jewish Congress Southwest Region. The award recognizes women who have been diligent and spirited in their pursuit of social justice.

The award will be presented on the evening of Thursday, May 10 at a ceremony at the home of Fred Baron and Lisa Blue. Fellow recipients are Brenda Brand, Gloria Campos, Vivian Castleberry and Mamie McKnight.

"I'm humbled to be in such great company, and I deeply appreciate this recognition from the American Jewish Congress," says Ms. Wu.

Ms. Wu writes a regular column on issues facing women in the legal profession for Texas Lawyer newspaper, and she frequently speaks about the benefits of diversity in the workplace and the challenges confronting women in every profession. At Andrews Kurth, she is the driving force behind the firm's bi-annual Executive Women's Retreat, which brings together the firm's women lawyers and their female clients for a weekend of networking. In recognition of her efforts on behalf of women professionals, she recently received the Louise B. Raggio Award from the Dallas Women's Lawyers Association.

Ms. Wu is recognized as one of the top real estate and finance lawyers in Texas. She is consistently included on the "best lawyers" lists published in D Magazine and Texas Monthly. In addition, Texas Lawyer newspaper named her one of six "Go To" real estate lawyers in the state. She has held several management positions at Andrews Kurth (including Dallas Managing Partner) and has for the last six years served on the firm's Policy Committee.

"Kathleen Wu is representative of the best and the brightest our firm, indeed, the whole legal profession, has to offer," says Andrews Kurth Managing Partner Howard Ayers. "The 'Women of Spirit' Award is further validation of that."

In 1993, AJCongress began recognizing women whose grassroots efforts made an impact on society, says Marcy Helfand, President of the AJCongress Southwest Region.

"We decided to name the award 'Women of Spirit' because these are women who are not stopped by obstacles that can defeat most people, but continue to advance their agendas despite the many problems that may stand in their way," Ms. Helfand says. "They are rooted in the community and their contributions lead to the growth of new community endeavors. We believe Kathleen Wu personifies the mission of AJCongress and the Women of Spirit Award."

The Women of Spirit Awards are presented by AJCongress to women from diverse community backgrounds who have been diligent and spirited in their pursuit of social justice, women's and minority issues, and community development. Their grassroots efforts have contributed enormously to improving the quality of life for everyone.

Attorney Bruce Gordon Elected to Board of Tampa Bay Estate Planning Council
Shumaker, Loop & Kendrick, LLP, is pleased to announce that Bruce H. Gordon, Partner in the Tampa Office, has been elected to serve on the Board of the Tampa Bay Estate Planning Council.

Mr. Gordon is an accredited Estate Planner and is the Department Head of the Trust and Estates Practice at Shumaker, Loop & Kendrick, LLP. Mr. Gordon was a member of the tax department of a Big Six accounting firm for six years prior to practicing law and has lectured at various Florida Bar CLE courses and at meetings of trust companies and professional associations. He was a member of The Executive Council of the General Practice Section of the Florida Bar from 1988-1994 and served on the Continuing Legal Education Committee during that time. He received his J.D. from Case Western Reserve University in 1973 and his B.A. from Miami University in 1970.

MODRALL SPERLING LAWYERS GET CONSERVATION EASEMENT TAX CREDIT SIGNED BY GOV. RICHARDSON
Because of the stewardship of two associate attorneys at Modrall Sperling, Gov. Richardson signed into law Conservation Easement Tax Credit (House Bill 990) on Wednesday.

Ethan Epstein and Leslie Padilla undertook the effort to modify existing laws currently providing for tax credit for conservation easement grants. These modifications make these credits saleable and more than double the credit limits. The end result will be the conservation of more New Mexico land.

HB 990 more than doubles the tax credit available for conservation easement and allows those credits to be sold. As an example, if a rancher grants an easement to his ranch saying that his ranch can only be forever used as a ranch, that action is going to create a tax credit relative to the reduction in value of the ranch because of its limited use constraint (i.e., the easement). That credit can be sold. Typically, these credits sell for $.90 on the $1. So, if the rancher in the above example gets the maximum conservation easement credit of $250,000 for his grant, then he can expect to sell that credit inventory for $225,000. This results in the rancher getting $225,000 without changing the use of the underlying property.

There are land development implications (i.e., developers can take advantage of the higher credit limit) and estate planning uses as well (i.e., valuable land can be donated to conservation to get that value out of an estate which lowers the estate tax burden). Additionally, any business or person can benefit from this because they can buy the credits at a discount. Assuming an infinite inventory of these transferable credits, New Mexico taxpayers could expect to lower their overall tax obligation by 10% based on the market information which these credits exchange in Colorado.
