Baker & Daniels Becoming New Tenant in Remodeled South Bend Building
The City of South Bend has announced a new downtown revitalization effort that includes the investment of more than $7 million in the KeyBank Building and the relocation of Baker & Daniels LLP, one of the city's largest law firms, to the renovated building.

The 14-story KeyBank Building and plaza at the corner of Michigan and Jefferson streets will soon undergo an extensive interior and exterior renovation. Baker & Daniels has signed a 15-year lease for the top four floors of the building and is joining the building's owners, The Hinman Company, and KeyBank in investing between $7 million and $8 million to renovate the building.

South Bend Mayor Stephen J. Luecke is pleased with Baker & Daniels' decision to remain and reinvest in the city's downtown. "I'm excited that this landmark to our downtown skyline will benefit from a revitalization effort that will transform the building all the way out to the street level," Luecke said. "Our downtown is an important indicator of the economic strength of our local economy, and this renovation and Baker & Daniels' long-term commitment to the downtown illustrates that downtown South Bend is the business center of our community."

"KeyBank and Baker & Daniels have made a long-term commitment to their growth in the business district," added Rich MacDonald, the Hinman Company's chief operating officer. "This renovation will help preserve the KeyBank building as one of the premier venues in the downtown area and bring additional value to all of the tenants in the building."

Brad Toothaker, managing director of CB Richard Ellis in South Bend, was integrally involved with facilitating this project. CB Richard Ellis is a tenant in the KeyBank Building in addition to professionally managing and leasing space for the Hinman Company. CB Richard Ellis also will be relocating within the building and expanding its operations in response to increased activity within the market.

The lobby of the building will be renovated at the same time KeyBank reconfigures and improves its ground floor retail operation. Changes include enhancing the accessibility to the building by moving the entrance to the middle of the building's west side. The City of South Bend is supporting the project by making parking available to building tenants, supporting a real property tax abatement and assisting with entrance and plaza renovations.

"Along with a renovation that will allow us to create an even better experience for KeyBank customers, we are pleased to welcome Baker & Daniels to the building," said Jeff Stone, KeyBank district president.

Baker & Daniels signed its 15-year lease for the top four floors with options on additional space to meet future growth needs. The law firm has outgrown its existing space in the First Bank Building, 205 W. Jefferson St., where it has been a tenant since 1990.

Baker & Daniels' plans call for completely redesigning the floors it will occupy, including the creation of a multimedia meeting room and the construction of a new internal stairway connecting its floors. To design its new office space, Baker & Daniels has retained the nationally recognized, Chicago-based architectural firm of Gary Lee Partners, which also has offices in New York and San Francisco. Gary Lee Partners has designed numerous award-winning residential and commercial projects in Chicago, New York and Los Angeles. The firm also designed the Indianapolis, Fort Wayne and Washington, D.C. offices of Baker & Daniels.

Richard L. Hill, managing partner of Baker & Daniels' South Bend office, said the firm looked for office space throughout South Bend and Mishawaka. "There were clearly attractive options outside of the downtown area, but we were pulled back here. We realized that downtown South Bend remains the business and financial center of the community. It's the ideal location for growing our business in the region."

Brian Burke, chairman and chief executive officer of Baker & Daniels, said that the investment in the South Bend office supports the implementation of the firm's strategic growth plans. "The South Bend office of the firm houses a number of essential practices that serve our clients on a regional and national basis. The new South Bend office will support those practices and our attorneys and professionals who have worked so successfully to expand those practices in this region." Burke said that the new South Bend office will also enable the firm to provide the highest level of services possible to its clients.

As the hub of the 15-county Michiana area, South Bend is a regional center for commerce, culture, education and health care. Each day, more than 17,000 people work downtown, which since 2006 has been the target of more than $250 million of recent or announced development. Occupancy of high-end Class A office space – such as the KeyBank Building, Leighton Plaza, the Chase Tower and the First Source/Marriott complex – exceeds 90 percent. "Whether for business or entertainment, South Bend's downtown abounds with life and vitality," Luecke said.

Cleveland-based KeyCorp is one of the nation's largest bank-based financial services companies, with assets of approximately $92 billion. Key companies provide investment management, retail and commercial banking, consumer finance, and investment banking products and services to individuals and companies throughout the U.S. and, for certain businesses, internationally.

The Hinman Company, founded in 1977 by Roger E. Hinman, is a commercial real estate investment, development, management, and leasing company. The Hinman Company has established a diverse portfolio of office, retail, and residential properties. Today, the Hinman Company is proud to own and manage several million square feet of commercial space in the Midwest, including 2.8 million square feet in Michigan, Indiana and Illinois

Stern Honored as ‘Washington, D.C. Super Lawyer’
Schnader attorney Jonathan M. Stern has been recognized as a ‘2007 Washington, D.C. Super Lawyer’ by the publishers of Law & Politics for outstanding achievement in the practice of law, specifically in the area of Insurance Coverage. The conference covered developments in copyright, patent, trademark, design and antitrust law with regard to the European Union, European Patent Office, Asia, Japanese Patent Office, U.S. Copyright Office, U.S. Patent and Trademark Office, World Intellectual Property Organization, World Trade Organization, and Digital and Information Technology. Mr. Garrity spoke on the topic "Third Party Uses of Trademarks: Search Engines and Key Words" and moderated a panel on "Functionality and Protection of Product Configuration Marks."

Clark Hill Attorney Matthew Tolbert Smith will present a program entitled “Proper Lien Procedures,” on April 27 to a group of HVAC contractors in Grand Rapids. Smith's presentation will examine construction lien, bond claim and how to protect a construction business ' right to payment.

Smith is a member in Clark Hill’s Lansing office, where he practices in the Litigation Practice Group. Smith specializes in commercial and construction-related matters. Smith also has experience in bankruptcy, creditor’s rights, real estate and civil litigation.

Smith joined the United States Marine Corps in 1993 and has achieved the rank of Major. After receiving his law degree he practiced bankruptcy, real estate and corporations’ law. In 1995, he returned to active duty for the Marines and attended Naval Justice School in 1996, receiving certification as a Judge Advocate of the United States Marine Corps.

Smith served as government counsel, defense counsel, and as a Special Assistant United States Attorney for the Marine Corps’ Office of the Staff Judge Advocate in San Diego, California. He returned to Michigan in 1999 to practice creditors’ rights law, construction litigation, real estate and corporations’ law, while also working for the U.S. Marine Reserves.

Smith earned his B.A. degree in Financial Administration from Michigan State University in 1991, where he received several scholarships and awards. He earned his J.D. from the University of Detroit School of Law.

Statement of L. Lin Wood Regarding Representation of Howard K. Stern
After meetings over the weekend in the Bahamas, I, along with my law firm, Powell Goldstein LLP, have been formally retained by Howard K. Stern, individually and in his capacity as the Executor of the Estate of Anna Nicole Smith. My representation of Mr. Stern will focus on those individuals and entities guilty of making false accusations of criminal conduct against him related to the tragic deaths of Anna Nicole Smith and her son, Daniel. My representation of Mr. Stern as the named executor under the last will and testament of Anna Nicole Smith will focus on those individuals and entities responsible for the theft of personal property of Ms. Smith and/or its unlawful use, sale or other misappropriation in the media.

Like my other defamation clients, Mr. Stern has been falsely accused. Like my other defamation clients, Mr. Stern is an innocent individual who has never been charged with any crime but finds himself on trial in the media. The media trial of Mr. Stern has been based on constant shouts of guilty from a barrage of uninformed commentators based on totally inaccurate and often manufactured "facts." The nightly television, tabloid and Internet trial of Mr. Stern in the court of public opinion based on sensational lies, speculation, rumor and gossip is over.

There is no evidence that Mr. Stern was in any way responsible for the deaths of Anna Nicole Smith or her son, Daniel. The accusations that Mr. Stern is guilty of murder have been recklessly and maliciously invented and published by individuals and entities to advance their personal agendas with the complicity of a ratings-driven media.

With respect to the death of Anna Nicole Smith, the autopsy report prepared by the Broward County Medical Examiner's Office represents a comprehensive and thoughtful analysis of the evidence. It was prepared with input from an independent and highly-credentialed team of experts in a wide variety of forensic disciplines. In that report, the Medical Examiner concluded that the death of Anna Nicole Smith was accidental. No one has produced any evidence to rebut this conclusion because no such evidence exists.

To those considering making future false accusations against Mr. Stern, please consider the following advice: don't do it. You are not immune from suit if you are not a member of the traditional media. Redress for false attacks on reputation is available for Internet accusations as well as those published in print or uttered on television and radio broadcasts.

To those considering future misuse of estate assets, the message is the same: don't do it.

And to those who believe that Mr. Stern is hesitant to bring suit and thereby open up his life on cross examination during the discovery process, you are wrong. Mr. Stern has nothing to hide and he correctly views civil litigation not only as the forum for obtaining accountability for wrongdoing, but also as a forum for the public to learn the truth.

M. Krista Barth of Palm Beach Gardens, Florida will serve as co-counsel with Powell Goldstein in this litigation. Ms. Barth was one of the attorneys who successfully represented Mr. Stern in the Florida litigation which led to Ms. Smith being buried in the Bahamas next to her son. Powell Goldstein has also assembled a team of its First Amendment and fiduciary litigators to assist in this litigation including William V. Custer, Nicole J. Wade, Eric P. Schroeder, Luke A. Lantta and Benjamin Erwin.

Along with Ms. Barth, the lawyers at Powell Goldstein are dedicated to achieving justice for Mr. Stern and protecting the assets of the Anna Nicole Smith estate for the benefit of her daughter, Dannielynn.

Weil Gotshal Partner Comments on Employee's Discrimination Suit Against Hotel
An alleged case of narcolepsy is behind two lawsuits commenced by a former employee of the Marriott Marquis and the Ritz-Carlton. Emmanuel Okoro, who alleges he developed narcolepsy in 2001, is suing the Marriott Marquis for disability discrimination after the hotel fired him for sleeping on the job. Mr. Okoro is also suing the Ritz-Carlton for retaliatory discharge claiming that the hotel fired him only after learning that he was contesting his termination by the Marriott Marquis for sleeping on the job.

Mr. Okoro claims that he informed the Marriott Marquis about the narcolepsy and that the hotel would not allow him to take unpaid leave to receive medical attention. The hotel disputes the claim. According to Jeffrey S. Klein, a partner at Weil, Gotshal & Manges LLP and chair of the firm’s Employment Litigation practice, under the Americans With Disabilities Act, an employer must be notified of an employee’s disability in order to provide an accommodation. “An employer can’t accommodate an employee’s disability if the employer doesn’t know about it.”
