St. Louis Circuit Court Defense Verdict
Blackwell Sanders attorneys Randy Thompson and Errin Braddock celebrated a complete defense verdict for client Forest Pharmaceuticals, Inc. in the St. Louis Circuit Court. In 2003, a chemist at Forest’s laboratory filed a whistleblower suit against the company claiming wrongful termination. Discharged for performance reasons, the plaintiff filed a whistleblower claim, alleging he was discharged for internally reporting, and threatening to report to the FDA, purported violations of FDA regulations. The company vigorously denied that any FDA violations occurred, citing multiple inspections by the FDA without any such violations found.

The jury returned a verdict in favor of Forest, agreeing with the defense and finding no FDA violations.

Forest Pharmaceuticals, Inc., headquartered in Earth City, Mo., is a wholly-owned subsidiary of Forest Laboratories, Inc.
