Former Palmetto Behavioral Health CEO Joins Nelson Mullins Health Care Team
The former chief executive of Palmetto Behavioral Health System has joined Nelson Mullins Riley & Scarborough's health care team and will be based in its Charleston office.

Daniel J. Body, of counsel to the Firm, brings considerable health care experience to the Firm's clients. He has more than 15 years experience serving in executive positions at several health care facilities across the country.

"We are honored that Dan Body has chosen to join our dynamic health care team," said Stuart M. Andrews, who heads the Health Care Practice Area for the Firm's four South Carolina offices. "He brings with him the benefit of a concentrated focus on corporate issues surrounding health care facilities that will assist our current and future health care clients." Nelson Mullins' health care practice, with its 33 attorneys, is ranked No. 15 in the nation by the American Health Lawyers Association.

Mr. Body will represent health care providers with organizational and operational issues, mergers and acquisitions, managed care contracting, business management and planning, health policy, certificates of need, licensure matters, general contract negotiation, Medicare and Medicaid reimbursement, and state and federal fraud and abuse issues.

Mr. Body also has more than 15 years experience as a health care executive, having served as the chief executive officer for several behavioral health hospitals throughout the country. Before relocating to South Carolina, he practiced in health care and corporate law with a national law firm in St. Louis and Washington, DC.

Admitted to practice in South Carolina, Illinois, and Missouri, Mr. Body is also a member of the American Bar Association (Health Law Section), the American Health Lawyers Association, the American College of Healthcare Executives, the Bar Association of Metropolitan St. Louis, and the Charleston County Bar Association. He is currently a participant in the Riley Institute of Furman University’s South Carolina Diversity Leadership Academy, an Honorary Commander of the 437th AW/PA at Charleston A.F.B., and a member of the Trident United Way Board of Directors.

Mr. Body earned a Juris Doctor from the Saint Louis University School of Law with a Certificate in Health Law in 2003. During law school, he served as a lead editor of the Journal of Health Law, was awarded a St. Louis 2004 Renaissance Award for his work in the establishment of the St. Louis Regional Health Commission, and was a member of Alpha Sigma Nu. In 1984, Mr. Body earned a Master of Business Administration and a Master of Public Health from the University of Missouri. He earned a Bachelor of Science in 1982, also from the University of Missouri.

Elise Redmond Joins Nelson Mullins in Financial, Real Estate Practices
Elise Ann Redmond, a former assistant general counsel for Bank of America, has joined Nelson Mullins Riley & Scarborough LLP in its Charlotte office to practice principally in the areas of financial institutions and real estate. Ms. Redmond is joining Nelson Mullins’ existing Real Estate Finance Practice Group (with team members in Charlotte, Atlanta, Washington, and Charleston), which represents major financial institutions in structuring and closing commercial mortgage loans intended for securitization.

Ms. Redmond is of counsel to the Firm and brings extensive experience in commercial real estate lending, with an emphasis on Class-A office buildings, retail shopping centers, and mixed-use properties. Ms. Redmond’s transactional representation of institutional lenders includes loan structuring, origination, servicing, participation and syndication with respect to securitized, construction, mezzanine, portfolio and development loans secured by real estate located throughout the United States and Canada. Ms. Redmond also represents real estate developers and other clients in the acquisition, disposition, development and leasing of commercial properties. In addition, Ms. Redmond’s practice includes borrower representation in commercial loan transactions.

Prior to her tenure as in-house counsel at Bank of America, Ms. Redmond practiced in the real estate finance groups of two major national law firms in their Washington, D.C., and Charlotte offices.

Ms. Redmond is admitted to practice in North Carolina, the District of Columbia, and the United States Supreme Court. She is a member of the American Bar Association, the Mecklenburg County Bar, Women in Business, the North Carolina Real Property Section and the Real Property Council.

In 1996, Ms. Redmond earned a Juris Doctor from Mercer University School of Law. While in law school, Ms. Redmond was the 1996 Class President, a committee chairperson and committee co-chairperson of the Student Bar Association, Southern Conference Client-Counsel Champion, and Georgia’s Governor Campaign Section Leader. She earned a Bachelor of Business Administration degree, with a major in Human Resources/Personnel Management, from the University of Georgia in 1993.

Mayer, Brown, Rowe & Maw LLP Advises Nestlé S.A. on $5.5 Billion Acquisition of Gerber Products Company and Gerber Life Insurance Company
A multidisciplinary team of Chicago- and New York-based lawyers from Mayer, Brown, Rowe & Maw, LLP has advised Nestlé S.A. on its $5.5 billion acquisition of Gerber Products Company and Gerber Life Insurance Company from seller Novartis AG. The acquisition was announced earlier today.

Mayer, Brown, Rowe & Maw's team of lawyers included partners David A. Carpenter (Corporate), Lawrence R. Hamilton (Insurance), James R. Barry (Tax), Ariel M. Dybner (Real Estate), and Brad L. Peterson (Information Technology). Also assisting were Corporate associates John P. Boelter, Andrew E. Harwel, Bradford C. Stanley and Adrian R. Stewart, Intellectual Property associate Douglas L. Sawyer, Environmental associate Paul M. Drucker and foreign interns Miguel Jauregui Casanueva, Gunter A. Schwandt and Mateus D. Gianeti.

Nestlé's in-house legal team included Trevor Brown (Vice President, Nestlé Legal), Patrick Beringer (M&A Counsel, Europe) and Yun Choi Au (M&A Counsel, U.S.).

Commented David A. Carpenter, "Our multi-disciplined team worked in close coordination among offices and practice areas and with our client Nestlé's in-house team to reach this result. Obviously this is a tremendous acquisition for Nestlé and we're pleased to have played a role in making it happen."

This transaction follows on the heels of Mayer, Brown, Rowe & Maw's representation of Nestlé in its acquisition of the weight loss business, Jenny Craig for $600 million (which was closed during the summer of 2006) and the pending acquisition of the Medical Nutrition business of Novartis for $2.5 billion.

Nestlé S.A. was founded in 1866 and is today the world's largest food and beverage company. Based in Vevey, Switzerland, it employs approximately 260,000 people in almost every country of the world.

Luce Forward Client Eldorado Stone Awarded Over $20 Million in Trade Secret Misappropriation Case
Luce Forward client Eldorado Stone, one of the country’s leading manufacturers of artificial stone veneer used in home building, was awarded over $20 million this week by a San Diego jury in the case Eldorado Stone, LLC vs. Renaissance Stone, Inc. et al.

According to the verdict, Renaissance Stone, a company founded by former Eldorado Stone employee Alfonso Alvarez and Renaissance Stone investor Robert Hager, willfully misappropriated Eldorado Stone’s trade secrets, infringed on Eldorado Stone’s trademarks and copyrights, and intentionally interfered in the economic relationships between Eldorado Stone and its customers. Renaissance Stone’s President, Joseph Smith, was also found liable for copyright infringement.

Luce Forward Partners Callie Bjurstrom and Andrea Kimball co-represented Eldorado Stone in the nearly 3-week trial, which stemmed from a suit filed by Eldorado Stone in 2004.

“For the past 3 years, Eldorado Stone has fought to preserve the integrity of the product offering it has created,” said Kimball. “The jury in this case sent a clear message that unfair competition through the use of another manufacturer’s intellectual property will not be tolerated. We are pleased to have aided Eldorado Stone in protecting what it rightfully owns.”

San Diego-based Eldorado Stone was founded in 1969, and is recognized as an industry leader in the architectural stone veneer industry. The company is a subsidiary of Headwaters Incorporated – (NYSE: HW).

“Eldorado Stone has always valued the intellectual capital behind the unique, innovative products that we create,” said Eldorado Stone President Mike Lewis. “Our intellectual property is one of the company’s greatest assets, which has taken years and even decades to develop. We could not be more pleased with the jury's decision, or happier for our client.”

Luce Forward was aided in its efforts through the assistance of LECG, a global expert services firm. Michael Bandemer of LECG uncovered key computer evidence in the case supporting the misappropriation of trade secrets by the defendants. Cary Mack, also of LECG, provided the damages analysis in the case.

Renaissance Stone was represented at trial by a team of attorneys from the firm Quinn Emanuel of Los Angeles, California.

Klinedinst Los Angeles Welcomes Daniel S. Sandman and Serena A. Spencer
Klinedinst Los Angeles is pleased to announce that Daniel S. Sandman and Serena A. Spencer have joined the firm's growing corporate litigation team. Both are experienced attorneys who bring with them a wealth of knowledge in the areas of business litigation, professional liability, environmental, and product liability.

Daniel Sandman first started his career as a television journalist, working for WTVJ NBC 6 in Miami and WAMI-TV in Miami Beach, Florida. Mr. Sandman's coverage of breaking news stories involving legal issues, government, and media inspired him to attend law school at The John Marshall Law School in Chicago. A Dean's Scholar, Mr. Sandman was invited to contribute to The John Marshall Law Review, and worked on a post-conviction petition as a Criminal Justice Clinic volunteer.

Upon graduation, Mr. Sandman began practicing law in Chicago, where he focused on tort negligence cases, trying jury trials to verdict and resolving numerous cases through arbitration and mediation. Serena Spencer is an experienced business attorney with significant trial experience. As part of her practice, she focuses on product liability, toxic mold construction and bodily injury cases, professional liability, premises liability, and business litigation. Ms. Spencer earned her J.D. from the College of William and Mary in Williamsburg, Virginia. Ms. Spencer's path to a legal career also had some very interesting turns.
