Markert Joins Lewis and Roca
Lewis and Roca is pleased to announce that Diane Markert has joined the firm’s Las Vegas office as an associate in the firm’s Real Estate practice group. She will contribute her experience in both lender and purchaser commercial real property loan financing, opinion letters for commercial real property financing, and bond and asset purchase transactions. Her practice also includes experience with business entity formation and reorganization documents.

Ms. Markert received her J.D. from the J. Reuben Clark School of Law, Brigham Young University (2004), her M.A. from the University of Chicago (1991) and her B.A. in English from San Diego State University (1988, summa cum laude).

Prior to joining Lewis and Roca, Ms. Markert was an associate with Jones Vargas.

Kaye Scholer Receives Law Firm Honoree Award from NYLAG
The New York Legal Assistance Group (NYLAG) will present Kaye Scholer LLP with its 2006 "Law Firm Honoree" award for the firm's on-going commitment to pro bono. The award will be presented at NYLAG's annual Pro Bono Recognition Event on April 19, 2007. NYLAG provides free civil legal services to low-income New Yorkers who would otherwise be unable to afford or receive legal advice or representation.

MATTHEW NEUMEIER & SCOTT SCHUTTE JOIN HOWREY IN CHICAGO
"Howrey LLP has announced that Matthew M. Neumeier, one of the nation’s outstanding class action defense lawyers in the areas of products liability, mass tort and financial services, will join the firm’s Chicago office, effective immediately. Mr. Neumeier joins from Jenner & Block LLP, where he was Co-Chair of the Firm’s Class Action Litigation Practice and its Products Liability and Mass Tort Defense Practice. Mr. Neumeier will be joined by his fellow partner Scott T. Schutte.

Howrey Chairman and CEO Robert F. Ruyak announced the appointment to the firm noting, “Matt Neumeier is one of the most dynamic, effective class action defense lawyers practicing in the fields of products liability, financial services and complex torts today. His skills and legal experience, along with Scott Schutte’s, mesh perfectly with ours, especially our IP, Global Litigation and Insurance Recovery practices. He and Scott are an important addition to our Chicago office. We welcome them to Howrey.” At Howrey, Neumeier will join the Global Litigation Practice Group and head the Products Liability and Mass Tort Class Action practice. He will be a part of the management group of the Chicago office.

Mr. Neumeier’s clients include global consumer product manufacturers and consumer financial services clients involved in nationwide class actions and state attorney general investigations and enforcement actions. His recent work includes the defense of the nation's largest tax preparation firm and some of the largest residential mortgage lenders in a variety of nationwide class actions involving RICO, Truth-in-Lending, predatory lending, contract, fiduciary duty and state consumer fraud claims. In the area of products liability and mass tort defense, he has represented global clients facing nationwide claims involving personal computers, claims-adjusting software, medical devices, beverage alcohol, and a variety of industrial chemicals used in medical device, food packaging and industrial applications. Mr. Neumeier has also represented clients in variety of high-stakes TRO and preliminary injunction proceedings, particularly disputes involving intellectual property or technology, such as trade secret, trademark infringement and Lanham Act unfair competition claims, domain name disputes, and disputes involving partnership or non-compete agreements. Prior to beginning private practice, Mr. Neumeier was a law clerk for Chief Justice Warren E. Burger of the U.S. Supreme Court. Mr. Neumeier is co-author of treatises on Electronic Discovery and Directors' & Officers' Liability: Prevention, Insurance & Indemnification.

Mr. Schutte’s practice focuses primarily on class action defense, insurance coverage litigation, and complex business litigation. Mr. Schutte has defended numerous consumer services and product manufacturers in class actions throughout the U.S., and has pursued claims for insurance coverage on behalf of policyholders in a range of settings in the United States and throughout the world.

WilmerHale Earns Favorable Ruling For Guam’s Attorney General
WilmerHale achieved a victory in the US Supreme Court on behalf of the Attorney General of Guam in a dispute over the interpretation of a debt limitation imposed on the territorial government by Congress.

The Court held that the federal statute limiting public debt to 10% of the “aggregate tax valuation” of property on Guam should be interpreted to mean the assessed valuation of property used for taxation purposes, rather than the full appraised value, as argued by the Guam Governor. The decision reversed a judgment of the Guam Supreme Court upholding the legality of a 2003 bond issue.
