Lathrop & Gage Attorney Tapped as Editor for ABA Publication
Construction managers and design professionals, as well as attorneys practicing in these industries, have a new resource to help them understand their legal roles, responsibilities and liabilities, thanks to a new book edited in part by Lathrop & Gage attorney Jerome V. Bales.

Design Professional and Construction Manager Law is a publication of the Construction Forum of the American Bar Association that addresses these two roles in the industry. Topics covered in the book include professional regulations, contractual obligations, intellectual property, potential liability, litigation, alternative dispute resolution, subcontractor arrangements, damages and remedies and professional liability insurance.

Bales has more than 30 years of experience handling many of the issues addressed in the book, including construction claims, litigation, risk management, and contract negotiation, representing design professionals, owners, contractors, sureties and suppliers. His experience as a litigator – with more than 100 cases before juries, judges and arbitrators – makes him a credible expert to lawyers and construction and design professionals alike. He also regularly presents on topics related to the construction industry.

"The ABA decided it was time for a book that took a more holistic approach to construction law," Bales said. "I'm thrilled to be a part of a project that acknowledges that the design and construction management roles are similar in many respects. This book is the only one I’m aware of that compares, defines and contrasts the laws related to each.”

Although the book is written by attorneys and is targeted primarily to lawyers representing design and construction clients, many chapters include checklists, practice tips and resource lists that make the book accessible to a wider audience.

“Our goal was to produce a book that was rich in the case law and analysis attorneys need, while at the same time offering concise information that is meaningful to construction professionals.” Bales said. “I think readers will find that the authors did an excellent job of balancing those competing objectives.

Thacher Proffitt represented Newport, N.H.-based New Hampshire Thrift Bancshares (NHTB) in their planned acquisition of First Community Bank of Woodstock, VT, in a cash and stock deal valued at approximately $15.5 million. Richard Schaberg acted as lead attorney for the agreement."

Eckert Seamans Adds Attorney in White Plains, New York Office
The national law firm of Eckert Seamans Cherin and Mellott, LLC today announced that attorney Geraldine A. Cheverko has joined the firm as an Associate in the firm’s Litigation Division. Prior to joining Eckert Seamans, she was an Associate with the law firm of Wilson Elser Moskowitz Edelman & Dicker in White Plains, New York.

Geraldine A. Cheverko concentrates her practice in general commercial litigation, including general negligence, product liability, construction litigation, premises liability, and risk management. Before going into private practice, she was a law clerk for The Honorable Joan Glazer Margolis, United States Magistrate Judge, District of Connecticut. She earned her law degree from Pace University Law School, where she graduated cum laude and served as Editor-in-Chief of Pace Law Review, and her undergraduate degree from Pace University, where she graduated magna cum laude. She is admitted to practice in New York and Connecticut and before the U.S. District Court, District of Connecticut; and the U.S. District Court, Southern and Eastern Districts of New York. Ms. Cheverko resides in Brewster, New York.

Richard W. Bell Joins Baker Donelson's Tax Practice
Baker, Donelson, Bearman, Caldwell & Berkowitz, PC, announces the addition of Richard W. Bell to its Tax Department. Mr. Bell joins the Firm as of counsel and will practice from the Firm's Atlanta office.

Formerly Senior Tax Counsel for BellSouth Corporation, Mr. Bell has been involved in multi-state tax issues that range from tax planning, utilization of tax incentives, audits and administrative practice to litigation and legislation. His experience includes income, gross receipts, excise, franchise, sales and use, license and other taxes and fees with a focus on ad valorem taxes. Mr. Bell, with his many years of state and local tax experience along with his first-hand knowledge of the telecommunications industry, will become an integral part of Baker Donelson's national state and local tax practice, which provides tax services to large multi-jurisdictional companies.

In addition to his more than 20 years as state and local tax counsel for BellSouth, he practiced with Arthur Andersen & Co. and as controller and tax counsel for several privately held investment companies. A 1981 graduate of the University of Georgia School of Law, Mr. Bell also holds an M.B.A. in accounting from Emory University. He is a member of the State Bar of Georgia Tax Section and the American Corporate Counsel Association. He has been an active member of the Council on State Taxation and has served on their Board of Directors for the last six years.

Kipp Coddington Testifies Before Senate on Carbon Credits
Kipp Coddington testified before the Senate Committee on Energy and Natural Resources concerning possible solutions to the liability issues that impede commercial deployment of carbon capture and storage technology. Kipp spoke in favor of two bills: S.731, National Carbon Dioxide Storage Capacity Assessment Act of 2007, and S.962, Department of Energy Carbon Capture and Storage Research, Development, and Demonstration Act of 2007.
