Dickstein Shapiro LLP Hosts Industry Leaders for the “2007 Business Growth Summit” Diversity Conference
Dickstein Shapiro LLP is again proud to support the Business Growth Summit Diversity Conference—a unique, one-day diversity conference, to be held May 3, 2007 in its Washington, DC office. Now in its second year, the Business Growth Summit Diversity Conference will bring together minority business societies and trade associations to discuss the importance of diversity and its role in growing American companies.

The theme for this year’s conference is “Moving Beyond Inclusion To Competitive Advantage.” Stedman Graham, Chairman and CEO of S. Graham & Associates will present the keynote presentation. Additional speakers including, Michael L. Barrera (President and CEO, U.S. Hispanic Chamber of Commerce), Carl Brooks (President and CEO, The Executive Leadership Council), Robert L. Greene (President and CEO, National Association of Investment Companies), Tracey G. Jeter, (President, Virginia Minority Supplier Development Council), Nick A. Medina (Global Inclusion and Diversity Manager, ExxonMobil), and Luke Visconti (Partner and Co-Founder, DiversityInc Media, LLC), will present at the conference, in addition to several Dickstein Shapiro attorneys, including C. Elaine Arabatzis, Emanuel Faust, Jr., Deborah P. Kelly, and Andrew J. Sherman.

Federal and state policymakers, public and private sector human resources executives, regional economic development organizations, entrepreneurs, senior level executives, and professional advisors and consultants to growing companies are among the many individuals encouraged to attend.

The Business Growth Summit Diversity Conference is organized by Grow Fast Grow Right LLC, an educational and training company for business executives and leaders of growing companies. Sappington Honored for Dedication to BBBS
Jacob Sappington has been selected as Missouri’s “Big Brother of the Year.” After reviewing applicants from across the state, an independent outside committee chose Sappington based on his exemplary ability, demonstrated relationship, and his positive impact and outcomes in the development of his "Little Brother." Big Brothers Big Sisters will present Sappington with a plaque at an Appreciation Celebration on May 1.

Sappington, along with other states’ Bigs of the year, is now a candidate for the National Big Brother year. The National office will make their decision at the end of April.

Big Brothers Big Sisters is the oldest, largest, and most effective youth mentoring organization in the U.S. It has been the leader in one-to-one youth services for more than a century, developing positive relationships that have a direct and lasting impact on the lives of young people. In 2005, Big Brothers Big Sisters served 240,000 children, ages 6 through 18, in all 50 states. The national offices are located in Philadelphia, PA.

Teleconference on Social Networking Featured Morris, Manning & Martin’s Paul Arne as Panelist
Morris, Manning & Martin Partner Paul H. Arne was a featured panelist for a nationwide teleconference titled “IP and Employment Issues of Online Social Networking.”

Panelists addressed intellectual property and employment liability issues relating to electronic mailing lists, blogs, online social networking websites such as MySpace and Facebook, and other “Web 2.0” technologies and business models. It also covered intellectual property rights on the Internet, employee privacy, harassment and other Internetrelated issues.

The 90-minute live teleconference was sponsored by the Legal Publishing Group of Strafford Publications.

The explosive growth of online communication and Internet networking provides a new set of liability issues that many companies are unprepared to handle. Employers are now faced with employees regularly posting information online about bosses, co-workers and company practices. The boost in public online forums has also increased the number of opportunities for confidential information to be made public.

Employers are also faced with complex decisions regarding potential hires and current employees as they gain more access to a growing amount of personal information available on the Internet. Employers are no longer limited to hiring an employee based on the credentials printed on a resume. Personal Web sites and online social networks provide companies with access to a new kind of background check that was impossible before the advent of the Internet.

Arne, a veteran attorney who is the co-chair of the firm’s Technology Group and Privacy and Security Group, offered teleconference participants insight into best practices for avoiding Internet liability issues. Arne has an extensive background in assisting technology companies and large end users with complex issues such as international transactions, outsourcing, open source software, privacy, university technology transfer and revenue recognition. As Apr-07 frequent speaker and writer on technology, he has given more than 60 speeches and has been quoted in prestigious national and local business publications.

Arne and his fellow panelists discussed specific issues during the teleconference such as possible areas of risk for infringement of copyright and trademark on the Internet, ethical issues attorneys must address regarding online information sharing and best practices for companies managing and regulating their employees’ use of online social networks. Teleconference participants will learn how to take full advantage of all the Internet has to offer while avoiding major legal pitfalls and liabilities.

Joseph Manko and Rodd Bender of Manko, Gold, Katcher & Fox, LLP to Lead American Bar Association Teleconference on Managing Environmental Issues at Construction Projects
Joe Manko, a founding partner, and Rodd Bender, partner with Manko, Gold, Katcher & Fox, LLP (MGKF), an environmental and land use law firm, will participate in the American Bar Association’s teleconference and live audio webcast on Managing Environmental Issues at Construction Projects on Tuesday, May 15. The program is sponsored by the American Bar Association Forum on the Construction Industry and the ABA Center for Continuing Legal Education.

Environmental issues can arise at any phase of a construction project, ranging from obtaining and complying with stormwater, wetland, air and spill prevention permits and requirements, managing demolition debris, and handling “surprises” such as endangered species, cultural artifacts or historic contamination. Such environmental issues can cause contractors and developers to incur construction delays, increase costs and impose civil or even criminal liability. Manko and Bender, along with panel members E. Mabry Rogers and Rhonda Caviedes Andreen, attorneys with Bradley Arant Rose and White, LLP, in Birmingham, AL, will outline common environmental regulatory programs relevant to construction projects, point out useful regulations and guidance documents, discuss notable enforcement cases, and offer tips for negotiating relevant contract provisions, insuring against such risks and promoting compliance in the field.

Manko has 34 years of experience in environmental law and is a strong advocate and academic expert on environmental compliance and protection. He has been listed in The Best Lawyers in America since 1991. Manko has served as a lecturer-in-law at the University of Pennsylvania Law School, teaching courses on environmental law, practice and policy, and as a guest lecturer at Vermont Law School. He graduated magna cum laude from Yale University in 1961 and cum laude from Harvard Law School in 1964.

Bender joined MGKF in 1997 and focuses his practice on matters involving brownfields redevelopment and transactions, regulatory compliance and counseling (including storage tanks, spill prevention planning, community right-to-know reporting, and other programs), and environmental auditing/compliance management systems. Bender previously worked as a law clerk for a federal judge in Savannah, Georgia and had served as an analyst for the Environment and Health Systems Group, American Management Systems, Inc., performing program analysis and support for EPA. He is a graduate of Brown University, magna cum laude, and received his masters in Public Policy from the John F. Kennedy School of Government, Harvard University. He earned his juris doctor from the University of Pennsylvania School of Law, where he served as special projects editor of the Law Review.

The American Bar Association’s teleconference and live audio webcast on Managing Environmental Issues at Construction Projects will take place on Tuesday, May 15 from 1-2:30 p.m. Eastern Standard Time. Program tuition ranges from $85 to $150 and $60 for additional registrants who use the same phone line.

Clark Hill Attorney Stephanie M. Zimmerman to Speak at Challenges in Real Estate Panel Discussion April 18
Clark Hill Attorney Stephanie M. Zimmerman will participate in the “Challenges in Real Estate – Southeast Michigan and Beyond,” panel discussion on Wednesday, April 18 at the Reserve in Birmingham. The discussion is a joint event hosted by the Detroit Chapter of Turnaround Management and the Michigan Network International Women’s Insolvency and Restructuring Confederation. Additional panelists include Craig Selden of Comerica and Jim Weissenborn of Mackinac Partners. Russ Long, of O’Keefe & Associates, will moderate the panel.

The topics at the discussion include workouts of developers and builders, the impact of failing sub prime lenders and the state of the SE Michigan residential real estate market. The cost to attend is $35 and tickets and additional information are available at www.turnaround.org.

Stephanie Zimmerman is a member in the firm’s Birmingham office, where she practices in the Litigation Group. For more than 20 years Zimmerman has represented individuals, corporations, banks, partnerships, limited partnerships, trustees, and other entities in civil litigation matters involving claims and judgments to over $25,000,000 in the United States District and appellate courts.

Zimmerman’s real estate litigation experience includes construction and insurance disputes, mortgage foreclosures and defenses, receiverships, forfeitures, public bidding disputes, commercial licensing agreements, non-profit housing and neighborhood organization disputes, construction claims, liens, loan workouts, banking transactions, private debenture and municipal bond issues, OTS and FDIC negotiations, corporate acquisitions, negotiable instrument transactions, lender liability claims, and commercial business, troubled suppliers, requirements contracts, purchase and sale of industrial equipment, manufacturing and related products. Ms. Zimmerman has also acted in a general counsel capacity supervising case management and supervision for Sterling Bank and Trust, F.S.B., Seligman & Associates, and the Taubman Company Lease Compliance Division.

Zimmerman earned both her undergraduate and law degrees from Michigan State University.

Attorney John B. Alfs Joins Clark Hill PLC
John B. Alfs has joined the Birmingham office of Clark Hill PLC as a member of the Litigation and Business Practice Groups. Alfs concentrates his practice in protecting the interests of business owners. He serves as general counsel to numerous entrepreneurial clients involved in commerce in many markets, including automotive supply, automotive retail, information technology and management, commercial insurance and benefits, as well as commercial construction.

Alfs consults with business owners and decision makers with respect to merger and acquisition opportunities, strategic planning, business succession, employee matters, protection of confidentiality and competitive rights as well as risk analysis and reduction.

In addition to working with firm clients daily on these critical business decisions, he has served as a speaker at seminars at regional and national levels to various trade associations on the topics of best business practices and risk reduction.

A particular area of expertise is Alfs' more than 20 years experience in representing the interests of automobile dealers. His work with auto dealers includes serving as general counsel to the dealership owners, counseling them on all aspects of their operations, including business planning, acquisition opportunities, factory disputes, employment issues, state, federal and administrative compliance, business contract negotiation and litigation.

Alfs has been trying business disputes since 1986. As lead trial counsel in state and federal courts in Michigan and elsewhere, as well as in numerous arbitration tribunals, Alfs has successfully defended his clients rights in cases involving contract disputes, premises liability and personal injury claims, products liability, covenants not to compete, shareholder claims as well as disputes arising from the purchase and sale of businesses. When firm clients' rights have been threatened, Alfs has pursued claims on their behalf for contract breaches, professional liability, supplier disputes and enforcement of restrictive covenants. Daniel P. Malone receives University of Detroit Jesuit High School Alumnus of the Year Award
Butzel Long attorney and shareholder Daniel P. Malone will be honored by University of Detroit Jesuit High School with the Alumni of the Year Award on April 25, 2007 at the Detroit Athletic Club. Mr. Malone, Class of 1971, is one of two recipients of the award. The other honoree is Walter Booker, Class of 1980. Mr. Malone and Mr. Booker will be recognized for their service to the high school. The awards presentation is part of an annual event that brings together alumni with the graduating class.

The awards were started in 1966 by the Board of Directors of the Alumni Association. To be nominated for the award, an alumnus must meet the following criteria:

• Distinguish himself through outstanding achievement in his chosen field or profession;

• Use his talents and skills for those in need, consistent with the theme "Men for Others;"

• Serve as a positive role model for U of D Jesuit students through consistent application of high moral and ethical standards

• His outstanding loyalty and support of U of D Jesuit serves as an example to all members of the U of D Jesuit community.

Mr. Malone served on the Board of Directors of the University of Detroit Jesuit High School for six years including a term as President.

"The University of Detroit Jesuit High School is so committed to our community and to developing Men for Others capable of making a difference," said Mr. Malone. "I am truly honored to receive its Alumnus of the Year Award."

Mr. Malone most recently served as Director of Butzel Long's Global Automotive Practice Group. For more than 27 years, Mr. Malone, who is listed in "The Best Lawyers in America," has focused his practice on civil litigation, particularly product liability, and automotive government compliance. Among other things, he has extensive litigation experience, including serving as regional and national coordinating counsel. He received the General Counsel's Award from a major automotive client of the firm.

In 2006, Mr. Malone received the State Bar of Michigan's Champion of Justice Award, one of the Bar Association's most distinguished honors.

More than 20 years ago, Mr. Malone established the Generation of Promise Program (www.generationofpromise.org). He has served on its Board ever since. The goal of the Program is to build a community of young leaders who celebrate diversity and are dedicated to reducing the polarization that hamstrings Metropolitan Detroit. It does so by instilling in its graduates, who now total over 1,000, a much broader concept of community than merely one's neighborhood and circle of friends. The Generation of Promise Program is guided by the belief that building relationships among many cultures and ethnicities results in a more encompassing view of our world and a higher appreciation for every individual. This innovative, yearlong experience, of which University of Detroit Jesuit is a participating school, helps to create a corps of future leaders with broader vision.

Mr. Malone has served on numerous other not-for-profit and professional boards.

After graduating from the University of Detroit Jesuit High School, Mr. Malone attended Cornell University (A.B., 1975) and then the University of Detroit School of Law (J.D., 1978) where he was Executive Editor of the University of Detroit Law Review. After being admitted to the Michigan Bar in 1978, he served as a law clerk for the Honorable Ralph B. Guy, Jr., then a United States District Judge and currently a senior status judge on the United States Court of Appeals for the Sixth Circuit. He has practiced law at Butzel Long since then.
