MARY CARTER ANDRUES TO JOIN HOWREY IN LOS ANGELES
"Howrey LLP has announced that Mary Carter Andrues will join the firm as a partner, effective June 4, 2007. Ms. Andrues is currently the Chief of the Public Corruption and Civil Rights Section, Criminal Division in the United States Attorney’s Office, Central District of California, Los Angeles, California.

“We are pleased that Mary has agreed to join our Securities Litigation, Government Enforcement & White Collar Defense practice,” firm Chairman and CEO Robert F. Ruyak said. “Much of her 14 years in the US Attorney’s office in LA has been devoted to prosecuting complex white collar criminal cases, particularly in the areas of public corruption, defense contractor and procurement fraud, government program fraud, tax fraud, health care fraud, customs and commerce fraud, immigration fraud, counterespionage violations, improper political contributions and federal export violations. She provides added clout as we continue to build this practice on the West Coast.”

As Chief of the Public Corruption and Civil Rights Section, Ms Andrues is responsible for evaluating and accepting cases for prosecution within the Public Corruption & Civil Rights Section. Some of her recent significant case supervision include United States v. Paul Richards et al., CR 04-1416-RGK (public corruption); United States v. Albert T. Robles et al., CR 04-1594(B)-SVW (public corruption); and United States v. Douglas Dowie et al., CR 05-27(A)-GAF (fraudulent billing practices to public entities).

She also served as Health Care Fraud Coordinator, responsible for reviewing and tracking all federal criminal health care fraud cases within the Central District of California, and a member of Health Care Fraud Task Force. That task force included members from the California Attorney General’s Office, Bureau of Medi-Cal Fraud and federal and state law enforcement agencies investigating Medicare and Medi-Cal fraud and abuse. She served as a member of the Department of Justice, Attorney General’s Advisory Committee, Health Care Fraud Subcommittee.

Robert Gooding, Co-Chair of Howrey’s Securities Litigation, Government Enforcement & White Collar Defense practice, joined Ruyak in welcoming Ms. Andrues to Howrey. “We are pleased to have her join us here in Southern California as we build this West Coast practice. She joins more than 21 former federal and state prosecutors including 10 former Assistant US Attorneys at Howrey to provide the strongest defense practice available to clients.” Former AUSA’s in Howrey’s Los Angeles office include Terree Bowers and Jan Handzlik.

Joanne Caruso, Managing Partner of Howrey in Los Angeles, and herself one of California’s top litigators, noted, “Mary Andrues brings the skills and drive to the job which are typical of Howrey litigators. She will feel very much at home at Howrey. We intend to keep her very busy.”

LSU's Brooks A. Keel and Peter J. Kelleher To Be Honored - Adams and Reese Hosts Welcome Reception with Special Presentation by LSU Chancellor Sean O’Keefe
"Louisiana State University’s Brooks A. Keel, Ph.D. and Peter J. Kelleher, Ph.D. will be honored at a welcome reception sponsored by the law firm of Adams and Reese on Tuesday, April 17 at the Shaw Center in Baton Rouge. Keel is the newly appointed Vice Chancellor for the Office of Research and Economic Development and Kelleher is the university’s new Associate Vice Chancellor for Intellectual Property Commercialization and Development.

As part of the National Flagship Agenda, LSU has moved over the past few years to optimize its role as an economic engine in the state and region. The addition of Keel and Kelleher realized critical goals outlined in the agenda.

Keel, formerly associate vice president for research at Florida State University, has held positions at the University of Texas Medical School, the University of South Dakota School of Medicine and the University of Kansas School of Medicine-Wichita, where he established the Women’s Research Institute and the Reproductive Medicine Laboratories.

Kelleher came to LSU from the University of Texas Medical Branch in Galveston, where he served as senior technology manager for the Center for Technology Development. He has more than 25 years of experience in developing and promoting intellectual property and evaluating the commercial potential of a broad range of early-stage university discoveries and technologies.

According to B. Troy Villa, partner in charge of the Baton Rouge office of the law firm of Adams and Reese, “We have had a long-standing relationship with LSU and we appreciate the opportunity to work with Chancellor O’Keefe and others to help the university accomplish their goals as a national flagship institution.”

Pillsbury Winthrop Shaw Pittman Launches Subprime Industry Group
Leading law firm Pillsbury Winthrop Shaw Pittman today announced the formation of a multidisciplinary group to advise clients and prospects affected by the collapse of the subprime mortgage market. Pillsbury is the first AmLaw 50 firm to announce the creation of a formal group to specifically address this issue.

“We will work as a coordinated unit, drawing on lawyers primarily from our bankruptcy, real estate, litigation and banking practices to analyze, advise and help clients plan before subprime-related issues arise and respond efficiently and effectively to specific legal challenges at any point along the subprime mortgage spectrum,” said Pillsbury bankruptcy and insolvency partner Rick Antonoff who is heading the team. “As needed, we will also consult with lawyers in our structured finance, securities, tax and derivatives practices, recognizing that a range of clients in the transactional, regulatory and litigation arenas are affected by this issue.”

Antonoff adds that the group will work with investment banks, bondholders, bond trustees and other members of the financial community involved in warehouse loans, whole loan sales, repurchase and securitization issues as well as mortgage lending clients that may be facing bankruptcy, regulatory scrutiny, mortgage fraud claims and other litigation.

“The marketplace moves faster than the law itself, which is why we find issue-focused teams, such as our subprime industry group, so valuable to our clients,” said Pillsbury Chair Jim Rishwain.

Rishwain points out that this is the third issue-specific group that Pillsbury has recently formed to address emerging concerns and help clients stay abreast of developing trends.

“A key part of Pillsbury’s growth strategy is to be nimble and responsive to emerging trends so that we can help clients make sense of screaming news headlines and determine if they are at risk or possibly face legal challenges,” said Pillsbury Chair Jim Rishwain. “Our backdating task force formed in early 2006 resulted in several new matters by helping clients ensure they were in compliance with SEC requirements as well as those who already were under investigation. Based on that success, and realizing that global warming issues were at a tipping point, we formed the climate change group last fall to help clients negotiate the changing environmental and political landscape. By creating these multidisciplinary groups that draw on a wide range of lawyers with experience in particular industries or issues, clients receive a well-rounded perspective.

David Fialkow Joins Nelson Mullins in Boston
David E. Fialkow has joined Nelson Mullins Riley & Scarborough LLP in Boston as an associate and will focus his practice in the areas of business litigation, consumer finance litigation, government relations and administrative law, insurance, and litigation.

Prior to joining Nelson Mullins, Mr. Fialkow worked for another law firm in New York assisting banks, private equity funds and other institutional investors in connection with various investments in both private and publicly traded companies. He also has experience supporting clients in a range of lending and other corporate finance transactions. His pro bono work has included representing juveniles in immigration and family court.

Mr. Fialkow authored "The Media's First Amendment Rights and The Rape Victim's Right to Privacy: Where Does One Right End and The Other Begin?" 39 Suffolk U.L. Rev. 745 (2006). Mr. Fialkow is admitted to practice in Massachusetts and New York.

Mr. Fialkow earned a Juris Doctor, summa cum laude, from Suffolk University Law School in 2006. While in law school, he served as note editor of the Suffolk University Law Review and was awarded the Daniel J. Fern Award given annually at graduation to the students in the Day and Evening Divisions who have demonstrated academic excellence by sustaining the highest cumulative averages during their course of study at Suffolk University Law School. He earned a Bachelor of Science, magna cum laude, from Florida State University in 2002.

Energy Attorney Joins Blackwell Sanders
Shannon Pepin has joined Blackwell Sanders’ Corporate Department in the firm’s Washington, D.C., office as an associate in the Energy & Public Utility practice group.

Prior to joining Blackwell Sanders, Pepin was an attorney in the General Counsel’s office of the Federal Energy Regulatory Commission. Pepin earned her J.D. from Georgetown University Law Center in 2004, and her B.S. from Syracuse University, summa cum laude, in 1998.

Filing IRS Extension Avoids Filing Penalty Not Payment
Kansas City, MO-Taxpayers have until April 17th to file their income tax returns this year because of a federal holiday that falls on Monday, April 16th. A taxpayer is required to file an income tax return by that date unless an extension of the time to file is filed with the Internal Revenue Service on or before April 17, 2007.

“Filing the appropriate extension with the IRS will grant a six month extension to October 15th to file the return. An extension of time to file a return does not extend the time for payment of the tax and it is still due on the original date of April 17, 2007,” says Tommy Taylor, tax attorney at Shughart Thomson & Kilroy, P.C.

If taxpayers do not file for an extension by April 17th, the taxpayer is liable for a failure to file penalty plus interest as follows:

• 5% of the tax due for each month or part of the month that the tax return was not filed up to a maximum of 25% of the tax due. For example, if you owe $2000.00 and wait two months to file, you will have to pay $200 in a failure to file penalty in addition to the $2000.00 owed plus interest as set forth below.

• If the taxpayer fails to file the tax by April 17th, the taxpayer will owe interest on the balance of the tax due at the statutory rate which is currently 8% per annum.

In addition, even if the taxpayer files an extension of the time to file the return, the tax due must be paid to the IRS by April 17 or face a failure to pay penalty as follows:

• ½% of 1% for each month or part of the month in which the tax is not paid up to a maximum penalty of 25% of the tax due.

Taxpayers may also make IRA contributions for the 2006 year up to the due date of the return, which is April 17, 2007. An extension of time to file the return does not extend the due date for the payment of the IRA contributions. Taxpayers can still reduce their income tax for 2006 by making IRA contributions if they are permitted to do so under the IRA contribution rules.
