Federal Jury Gives Maslon Client Complete Victory in Trade Secret Misappropriation Case
A team of Maslon lawyers led at trial by partners Bill Pentelovitch, Alain Baudry and Mary Vasaly recently completed a federal jury trial which resulted in complete vindication of their client, the defendant in the action. The twelve person jury found that Maslon's client had neither misappropriated trade secrets nor breached its contract to maintain the confidentiality of information. The jury completely rejected the plaintiff's claim for $110 million, which under the applicable trade secret statute could have been doubled to $220 million plus attorneys' fees.

During the three week trial the jury heard testimony from more than a dozen fact witnesses as well as from five expert witnesses. Following two days of deliberation, the jury found that the defendant had neither breached the contract nor misappropriated any trade secrets.

This is the third case tried to completion in less than two years in which a team of Maslon trial lawyers led by Bill Pentelovitch has successfully defended claims involving misuse or misappropriation of intellectual property. The total amount claimed by the plaintiffs in the three cases exceeded $400 million.

Hermes Sargent Bates Announces Victory in Employment Lawsuit
Attorneys from Hermes Sargent Bates, the eighth-fastest growing law firm in Texas (Texas Lawyer 2007), announce a successful verdict in a breach of employment contract case, with more than $113,000 in past lost profits awarded to its client, Midwest Medical Supply Co. (MMS), in the 116th Judicial District Court of Dallas County, Texas. After a seven-day trial, the jury returned a unanimous verdict in favor of MMS, finding that Mark Wingert breached his fiduciary duty owed to MMS and several provisions in his employment agreements with MMS, including his promise not to use his position with MMS for personal advantage or gain. Hermes Sargent Bates will be submitting their attorneys’ fees to the court as well.

Mr. Wingert, a former sales representative of MMS, a distributor of medical supplies, started his own medical supply distribution company while he was still employed with MMS. His new company would compete directly against MMS, and would seek to represent the same manufacturers in Texas that MMS had been representing in Texas. Attorneys for Hermes Sargent Bates demonstrated to the jury that Mr. Wingert breached his employment contracts with MMS when he established his business while employed by MMS, all unbeknownst to MMS.

“It is clear that the jury greatly disapproved of Mr. Wingert’s conduct while he was still employed for and receiving a salary from MMS,” said Monte Hurst, partner at Hermes Sargent Bates and lead counsel for MMS. “This case emphasizes that we all owe our employers a sense of loyalty so long as we work there, no matter what our future business plans are.”

HSB Partners Monte Hurst, Dan Tostrud and Hilaree Casada represented MMS at trial. Together Hurst, Tostrud and Casada have more than 30 years experience in representing various companies in employment and labor matters.

Chip Bowles Named to American Bankruptcy Institute Board of Directors
Greenebaum Doll & McDonald PLLC is pleased to announce that Chip Bowles, a Member in the firm’s Louisville office, has been elected to a three-year term on the Board of Directors of the American Bankruptcy Institute (ABI). He was elected during the ABI Annual Spring Meeting held in Washington D.C.

The American Bankruptcy Institute is the largest multi-disciplinary, non-partisan organization dedicated to research and education on matters related to insolvency. The ABI was founded in 1982 to provide Congress and the public with unbiased analysis of bankruptcy issues. The ABI membership includes more than 11,000 attorneys, auctioneers, bankers, judges, lenders, professors, turnaround specialists, accountants and other bankruptcy professionals providing a forum for the exchange of ideas and information.

Policy-makers on Capitol Hill have long relied on the input of the ABI in the evaluation of bankruptcy law and efforts to improve the system. While the ABI does not advocate policy positions or lobby Congress for legislation, it does provide a unique multi-disciplinary perspective.

Bowles concentrates his practice in the areas of bankruptcy law, distressed asset sales, professional ethics and compensation of court appointed professionals, representation of non-attorney professionals in fee matters and state law Debtor and Creditor rights. He has frequently lectured and written extensively for the ABI and other national organizations on various topics relating to bankruptcy law. Bowles is the former Co-Chair of the American Bankruptcy Institute’s Professional Compensation Committee and is currently the Chair of the American Bankruptcy Institute’s Chapter 11 Fee Study, and Co-Editor of the ABI Journal Ethics Column. He is also certified in Business Bankruptcy Law by the American Board of Certification.

John Ames Named President-elect of the American Bankruptcy Institute

Ames is Chair of Greenebaum’s Bankruptcy and Workout team and a member of the China and International teams. He works exclusively in the business reorganization process, both in Chapter 11's and state law work outs. He represents debtors, as well as creditors, both secured and unsecured. He is past Chairman of the Kentucky Bar Association Bankruptcy Section and the Louisville Bar Association Bankruptcy Committee.

Ames is listed in The International Who’s Who of Insolvency and Restructuring Lawyers and has been listed in The Best Lawyers in America each year since 1989. He is a Fellow in the American College of Bankruptcy and was in the inaugural certified class of the American Board of Certification.

WilmerHale Jumps to Top Ten in PLC's Life Sciences Super League
"WilmerHale earned a place in the top ten among 20 elite law firms in PLC’s Life Sciences Industry Super League, published in PLC Quarterly. Moving up ten places to ninth place, the firm is noted as this year’s biggest riser with “corporate and partnering transactions, and IP litigation, continu[ing] to be the most highly visible practices at the firm.”

PLC’s research is determined by the results of law firm and lawyer recommendations, as they appeared in the latest PLC Cross-border Life Sciences Handbook. The conference, “Measuring Return on Environment” will be presented by MetaVu, a business consulting firm in Denver. Featured speakers will include oil and gas industry professionals, legal counsel and Wall Street analysts. Laura Riese will lead off the April 26 segment on key legal issues surrounding environmental management with a presentation on “FIN 47—Accounting for Contingent Liabilities,” followed by John Jacus on “Improving Environmental Metrics in a Climate of Heightened Enforcement,” and John Elofson on the “Corporate Law Perspective.” The conference sessions are being held at the offices of Anadarko Petroleum in The Woodlands, Texas, with conference headquarters at the Woodlands Waterway Marriott Hotel & Convention Center.

Ms. Riese represents oil companies, developers, financial institutions, recyclers, disposal
companies, property owners and underground storage tank owners and operators on environmental issues and litigation. Mr. Jacus represents clients under all major federal and state environmental laws and regulatory programs, including RCRA, the Clean Air Act, CERCLA, and the Clean Water Act. Mr. Elofson’s practice focuses on securities offerings and compliance, and merger, acquisition and financing transactions for public and private companies.

Bell Boyd Signs Chicago Bar Diversity Initiative
Bell, Boyd & Lloyd has joined with the Chicago Bar Association as a signatory to the CBA Diversity Initiative. The initiative calls for law firms, corporate and public interest law departments and government agencies to adopt general principles of inclusion in their employment practices, as well as pursue goals for hiring, retention and promotion of minorities.

"Bell Boyd has a longstanding program with goals of hiring and promoting attorneys with diverse backgrounds. We take this commitment very seriously and were pleased to reaffirm our efforts by signing on to the CBA's Call to Action," said the firm's Managing Partner, Nancy E. Bertoglio. "We are already well on our way toward fulfilling the goals of the initiative."

The recruitment and promotion of minorities is a stated priority for Bell Boyd's recruiting program. The Chicago Lawyer 2006 Diversity Survey of Summer Associates ranked Bell Boyd among the top firms in Chicago with a 36.8% percentage of minority summer students. The firm's 2006 class of first year associates included 43% women and 42% minorities. The Diversity Committee, chaired by partner Michael Martinez, oversees initiatives and addresses issues involving hiring, retaining and promoting lawyers of diverse backgrounds.

Bell Boyd is also a signatory to the Chicago Bar Association's "Call to Action" on Women's Leadership in the Legal Profession which seeks to increase the number of women in law firm partnership and leadership positions. When Nancy Bertoglio was elected as Managing Partner in 1998, Bell Boyd joined a small number of elite firms in the country with women in top management roles.
