Arthur B. Muir Joins McGuireWoods Chicago Office
McGuireWoods LLP is pleased to announce the appointment of Arthur B. Muir as a partner in its Chicago office and member of the law firm’s Capital Markets Department. Most recently with Neil Gerber & Eisenberg, Muir has been principal counsel on transactions for loans and credit lines up to $1 billion for major clients in the United States and Canada.

Muir joins McGuireWoods with more than 25 years of experience in real estate lending and development and in commercial finance, representing large asset-based and other secured lenders, private bank lenders and mezzanine lenders. He also represents companies in corporate transactions ranging from mergers and acquisitions, capital fundraising, commercial transactions and strategic business alliances, to general corporate governance issues.

“Art has a strong reputation, both in Chicago and nationally, in financial transactions, especially bank financings,” says David L. Richardson, chair of McGuireWoods’ Capital Markets Department. “He has strong relationships in the national bank and money centers, so his joining McGuireWoods is strategic to our continuing growth in the firm’s banking practice, not only in Chicago, but also as an asset to our growing national practice.”

Muir is recognized in Best Lawyers in America (2007) and America's Leading Lawyers for Business (2005) and is AV rated by Martindale-Hubbell. He received his J.D. from Northwestern University School of Law. Among the client industries he has represented are manufacturers of railroad engines, airplanes, ships, printing equipment and pharmaceuticals. He has represented lenders secured by specialty security interests such as oil and gas collateral, pipeline rights, perishable goods and intellectual property rights.

McGuireWoods’ Capital Markets Department provides legal advice on a broad variety of credit and equity products for lenders and borrowers. The firm has extensive experience representing issuers, underwriters, placement agents, initial purchasers and other credit parties in complex public and private placements of high-yield, mezzanine, investment-grade, tax-exempt and other debt securities, as well as bridge financings, and in restructuring and refinancing transactions for high-yield securities, including exchange and tender offers and consent solicitations.

Supreme Court Ruling Favors Covington Client Wachovia in Federal Preemption Case
The United States Supreme Court ruled today that attempts by the states to license, examine, and supervise the banking activities of national banks or their operating subsidiaries are preempted by the National Bank Act. The 5-3 ruling in Watters v. Wachovia Bank, N.A., No. 05-1342, is an important victory for national banks and their subsidiaries. Covington partner Robert A. Long argued for Wachovia in the Supreme Court; with him on the briefs were Covington lawyers Stuart C. Stock, Keith A. Noreika, and Emily Johnson Henn.

Basha V. Hicks joins Carlton Fields in the Miami Office
The law firm of Carlton Fields is pleased to announce that Basha V. Hicks has joined the Miami office as an Associate in the Firm’s Real Estate & Finance Practice Group. She represents commercial clients in corporate, real estate and financing transactions. Hicks also represents major lending institutions in transactions for both real estate and asset based lending, developers and retail businesses in lease transactions, and commercial clients in acquisitions and sale transactions, including due diligence, zoning, and land use issues.

Prior to joining Carlton Fields, Hicks practiced with Akerman Senterfitt. She served as the Purchasing Agent as well as the HR Manager and Compliance Administrator for Benada Aluminum of Florida, Inc. Her additional past experience includes work in the nursery industry, serving as Legal Counsel for Plants In Design, Inc., and also practicing law with Ruden McCloskey and Shutts and Bowen, all in Miami.

Hicks received her Ed. D in 1986 from the University of Massachusetts, J.D. in 1985 from Harvard Law School and her B.S. in 1972 from the University of Michigan.

Erin Kinney joins Carlton Fields in the Miami Office
The law firm of Carlton Fields is pleased to announce that Erin Kinney has joined the Miami office as an Associate in the Firm’s Appellate Practice and Trial Support Practice Group.

Prior to joining Carlton Fields, Kinney served as a law clerk for Judge David M. Gersten and Judge Richard J. Suarez where she has assisted with civil, criminal, and administrative matters including direct appeals and extraordinary writs. She has represented the State of Florida in criminal appeals and post-conviction matters before the Florida Supreme Court, Third District Court of Appeal, and Eleventh and Sixteenth Judicial Circuit Courts of Florida. Kinney received her J.D. from the George Washington University Law School in 1998 and her B.A., with highest honors, from the University of Florida in 1995.

Carlton Fields Ranks in the 2007 Top 100 Law Firms for Diversity
Carlton Fields was recently named in MultiCultural Law’s 2007 Top 100 Law Firms for Diversity list. The ranking is based on a Diversity Survey of Minority and Women Shareholders and Associates as a percent of the total number of attorneys, providing diversity totals for the firm. The survey was completed by 200 law firms nationally.

MultiCultural Law is “The Magazine for Diversity in the Legal Profession” and is distributed to more than 40,000 professionals in the legal community including 500 general counsels and all ABA-approved law schools. Distribution includes a variety of legal organizations, such as the National Bar Association, National Asian Pacific American Bar Association, National Hispanic Bar Association, and a host of other regional minority and women’s legal organizations.

Carlton Fields’ goal is to recruit, retain and promote attorneys who are racially and ethnically diverse. The firm’s Diversity Committee is co-chaired by Miami shareholder Jason M. Murray and Tampa shareholder Nancy J. Faggianelli.

David Higgins Appointed to Fill 30th District West Virginia House Seat
Governor Joe Manchin III announced that David Higgins would fill the 30th District West Virginia House of Delegates seat formerly held by Jon Amores.

The governor praised Higgins for his contributions to West Virginia as a community leader and city council member.

Higgins will be sworn in during a ceremony in the House chamber at the West Virginia State Capitol on April 18.

PHILLIPS LYTLE LLP PARTNER MARK J. MORETTI ELECTED SECRETARY OF NEW YORK STATE BAR ASSOCIATION TRIAL LAWYERS SECTION
Mark J. Moretti a Partner with Phillips Lytle LLP, a full service law firm with statewide coverage, was elected secretary of the New York State Bar Association Trial Lawyers Section and will continue to serve as a member of its executive committee. He most recently served as treasurer of the section and is on the leadership progression to be president of the Trial Lawyers Section in 2009.
