Marshall J. Walthew, Litigator Focusing on Complex Commercial and Bad Faith Insurance Matters, Joins Pepper Hamilton
Pepper Hamilton LLP announced that Marshall J. Walthew, an experienced commercial litigator with particular experience in the defense of insurance bad faith actions and complex coverage disputes, has joined Pepper’s Commercial Litigation Practice Group as a partner in the Philadelphia office.

“Marshall’s considerable trial skills and experience serving the insurance industry are excellent complements to our commercial litigation practice,” said Robert E. Heideck, Pepper’s executive partner. “His background in litigating fraud and other complex commercial cases will be an invaluable asset, and we’re pleased he has chosen to join Pepper.”

Mr. Walthew joins Pepper from Dechert LLP in Philadelphia, where he was a partner in that firm’s trial group and where he had practiced since 1989. He focuses his practice on complex commercial litigation, including the high-end defense of insurers in bad faith and extra-contractual policy damages claims. He has represented insurance companies in cases arising out of casualty, life, disability, and directors and officers liability policies. He also has substantial experience handling bankruptcy, real estate, fraud and corporate litigation.

“I look forward to everything Pepper has to offer,” said Mr. Walthew. “Pepper’s commercial litigation practice is one of the finest in the country, and I am excited to join it. My clients and I will integrate well into the firm, and I hope to assist existing firm clients as well.”

Mr. Walthew is a graduate of Haverford College (B.A. 1977) and the University of Pennsylvania Law School (J.D. 1988). After law school, he clerked for the Honorable Dolores K. Sloviter of the U.S. Court of Appeals for the Third Circuit. Mr. Walthew is a member of the board of directors of the Haverford College Arboretum Association.

Nutter sponsors MVVF program on venture funding
Nutter sponsored Venture Funding: How to Raise Your First Round of Financing, presented by the Merrimack Valley Venture Forum on April 18. The meeting focused on where and how to get the important first round of money. Panelists discussed how start-ups can go about raising funding from first seed sources, be it family, friends or angel investors, as well as institutional round sources such Angel Groups and Series A players in order to grow their companies.

Member John Vanarthos Joins Advisory Board of Raritan Valley Workshop
The law firm of Norris McLaughlin & Marcus, P.A. is pleased to announce that Member John N. Vanarthos has joined the Advisory Board of the Easter Seals New Jersey’s Raritan Valley Workshop.

The Raritan Valley Workshop, located in New Brunswick, is one of three Easter Seals programs in New Jersey which provides private corporations sub-contract production work. These facilities employ people with various disabilities, offering productive, meaningful work in a safe environment.

Easter Seals New Jersey creates solutions to promote independence and help improve the quality of life for persons with disabilities and special needs in all 21 counties of New Jersey by providing employment, housing, adult day care, financial support services, personal assistance, outreach case management, and camping & recreational services.

A resident of Highland Park, Vanarthos is Chairman of the Norris McLaughlin & Marcus Corporate Law Department. Since 1987, Vanarthos has devoted his practice to helping companies, both large and small, with their business legal needs.

As a business lawyer, Vanarthos regularly represents and counsels the firm's corporate clients in a wide range of commercial transactions, including mergers, acquisitions, corporate partnerships and other strategic alliances. He has a substantial amount of industry-specific experience including pharmaceutical, medical device manufacturing, chemical, information technology and health care, among others. He also advises a number of high-tech companies in the areas of technology licensing, information management and product development.

Vanarthos serves as counsel for the United States operations of a number of foreign-based corporations where he is responsible for all legal issues in the U.S., including general corporate advice, contract and tax matters, litigation management and employee relations.

Over the years, Vanarthos has represented a number of individual entrepreneurs and startup companies. He has strategically guided them from idea conception to exit strategy, solving their legal problems along the way.

Vanarthos received both his J.D. and B.A. from Rutgers University. He is a member of the Board of Trustees for the Court Appointed Special Advocates of Somerset, Hunterdon and Warren Counties (CASA of SHaW) and serves on the PR/Marketing Committee for CASA of SHaW.

Nelson Mullins Honors Three for Pro Bono Work
Nelson Mullins Riley & Scarborough LLP has honored attorneys in Columbia, Charlotte, and Charleston with the 2006 Claude M. Scarborough, Jr. Award for their pro bono work.

Stephanie Lewis, Erik Norton, and Carrie Ryan received the award, named for Claude M. Scarborough, Jr., Nelson Mullins chairman emeritus. The award honors Firm attorneys who have made a special commitment to pro bono service. The award has been given to outstanding Firm attorneys since 1991.

Attorney Stephanie LewisMs. Lewis, a Charleston associate, won for her work with Crisis Ministries, South Carolina's largest homeless shelter. Ms. Lewis was instrumental in founding and developing the Crisis Ministries Legal Clinic and organizes attorney and law student participation and client services for residents. These services include representation to the homeless on legal issues including Social Security/disability matters, landlord/tenant disputes, domestic issues, tax issues, trusts and estates, health care power of attorney forms and restraining orders. Nelson Mullins also has provided funds to offer residents permanent, full-time legal services primarily focused on stabilizing families with children and helping them become self-sufficient. The funds established the shelter-based Crisis Ministries Homeless Justice Project, which will be staffed by a full-time attorney later this year. Ms. Lewis has been honored by the S.C. Bar and the local community with a Jefferson Award nomination.

Attorney Erik NortonMr. Norton, a Columbia associate, won for his work developing the Student Advocacy Project. Launched in 2006 to represent the legal needs of children in school administrative proceedings, the Student Advocacy Project primarily represents special needs students throughout the state. Currently 16 attorneys are participating in the project in a variety of ways, including counseling parents, lobbying the legislature for policy change, representing students in state complaint and due process proceedings, and assisting students in any other legal issues that arise. Attorneys receive referrals from a variety of sources, but work closely with lay advocacy organizations.


Attorney Carrie RyanMs. Ryan, a Charlotte associate, won for her work with families evacuated by Hurricane Katrina who were seeking reunification with the pets they were forced to leave behind. Ms. Ryan's involvement initially encompassed representing a family who was forced to leave their dog at home when they evacuated. The dog was rescued and later transferred to North Carolina where it was adopted out to a family that refused to return it to its rightful owner. Ms. Ryan's lawsuit against the adopter is pending in Madison County, N.C. and a countersuit by the adopting shelter is pending in Buncombe County, N.C. After Ms. Ryan's case garnered national media attention, Ms. Ryan became part of a larger network of attorneys who shared information and helped to find legal representation for families in similar situations across the United States.

Bradley Edmister Joins Milbank's Tokyo Office
Prominent Tokyo capital markets lawyer Bradley Edmister has joined the international law firm Milbank, Tweed, Hadley & McCloy LLP. Mr. Edmister joins the firm’s Tokyo office as Counsel.

The addition of Mr. Edmister reflects Milbank’s growth in Japanese capital markets. He has acted on some of the largest and most significant deals in Japan, including the global IPOs of Elpida Memory and NS Solutions and global stock offerings for Æon and Monex Beans Holdings. Recognized as a leading expert on global offerings of J-REITs, Mr. Edmister has handled numerous global equity offerings, including offerings for Japan Retail Fund Investment Corporation and Kenedix Realty Investment Corporation.

Gary Wigmore, managing partner of Milbank’s Tokyo office said, “This strategic hire signifies our commitment to expanding our 30-year presence in Japan. Mr. Edmister will strengthen our strong global capital markets platform to provide our clients in Japan with unparalleled service for the most important transactions.”

Mr. Edmister also has extensive experience in cross-border M&A, including mergers and acquisitions, private equity and joint ventures. He has advised on major M&A transactions including the merger of Namco and Bandai, Goldman Sachs’ investment in Sumitomo Mitsui Financial Group, the recapitalization of Sanyo Electric and sale of a stake in Sanyo Electric Credit and MKS Partners Limited’s tender offer for Kanebo. He also has broad capital markets experience in Taiwan, India, Australia and elsewhere. He advised on the $3.1 billion privatization of Taiwan’s Chunghwa Telecom and the New York Stock Exchange listing of India’s Tata Motors Limited.

Mr. Edmister joins Milbank following eight years at Sullivan & Cromwell, where he began his career in the New York office. Since 2002 he has resided in Tokyo and is fluent in written and spoken Japanese.

Mr. Edmister graduated from Harvard College (B.A. phi beta kappa and magna cum laude) and Harvard Law School (J.D.).

Janet K. Parkhurst Receives Human Resources Association "Attorney of the Year" Award
The Human Resources Association (“HROA”) has honored Janet K. Parkhurst, an attorney at the international law firm Milbank, Tweed, Hadley & McCloy LLP, by presenting her with the association’s “Attorney of the Year” Award at its annual awards dinner in New York on April 17, 2007. Ms. Parkhurst works in Milbank’s Strategic Sourcing & Technology Group in the New York office. Milbank partner John K. Halvey was HROA’s 2006 “Attorney of the Year.”

HROA’s “Attorney of the Year” accolade recognizes the attorney who has made outstanding contributions to HR outsourcing in the past year. Awards were presented for 14 distinct categories, and while all the honorees work in different capacities within the industry, a common theme was their commitment to helping advance the outsourcing model, whether through thought leadership, the development of innovative solutions, or exemplary partnership. Each award winner represents what the HROA is about, and their diversity underscores the depth and breadth of our organization.

In 2006 Ms. Parkhurst was the lead attorney on three major human resources outsourcing (“HRO”) deals: Johnson & Johnson, Avon, and Cendant. She also developed ground-breaking HRO arrangements for AT&T/Aon; Home Depot/Hewitt; Synovus/ADP; Cendant/Accenture; and DuPont/Convergys.

Ms. Parkhurst is recognized by leading industry observers as a thought leader in HRO. Most recently, Chambers USA 2006 referred to Ms. Parkhurst as a young outsourcing attorney “to watch.”

Mr. Halvey, partner and founder of Milbank’s Strategic Sourcing & Technology Group, has worked with Janet for many years. Mr. Halvey said, “Janet’s award for ‘Attorney of the Year’ reflects her superior ability, her leadership skills and contributions to the HRO sector. Having worked with many of the young lawyers in the industry, I can say that Janet has distinguished herself both as an attorney and leader.” Mr. Halvey is recognized nationally as the leading outsourcing lawyer. In addition to HROA’s 2006 “Attorney of the Year” award, he was named “Mr. Outsource” by Forbes magazine and designated “one of the godfathers of the industry” by Chambers.

The HROA is the only professional membership association committed to promoting the advancement of human resources transformation in complex organizations. The mission of the HROA is to support the Human Resources Outsourcing Industry through education, advocacy and the promotion of best practices. The Third Annual HROA Awards Gala was held in New York as part of “NY HR Week”. A three day event, April 16 – 18, 2007, the fifth annual “NY HR Week” featured conferences addressing a wide range of topical sessions for executives and managers in the HRO industry.

Mark Miller to speak at University of Houston intellectual property course
JW partner Mark Miller will speak at an intellectual property course presented by the University of Houston Intellectual Property and Information Law Institute. The course, titled "Intellectual Property for the General Attorney," will be presented in Houston on April 19-20, in Dallas on April 26-27, and in Austin (via video) on May 17-18. Mr. Miller's topic is "Copyright Infringement: What It Is; What to Do if You're Accused of It."

Mr. Miller is chair of the Intellectual Property section of Jackson Walker, with a practice focusing on franchising, licensing antitrust, patents, copyrights, and trademarks. He has been named one of the "Best Lawyers in San Antonio" in Intellectual Property Law by San Antonio attorneys.
