More than 20 JW attorneys named "Rising Stars"
"Jackson Walker congratulates the more than 20 attorneys from its statewide offices who were voted ""Texas Super Lawyers — Rising Stars"" by Texas Monthly magazine. The award is based on a three-part system that determines the top 2.5 percent of the state's up-and-coming lawyers. First, over 65,000 Texas lawyers are surveyed and asked to nominate the best lawyers that they have personally observed in action. When the surveys are in, Texas Monthly conducts independent research of the nominees' credentials, and then carries out a final selection process. Rising Stars are attorneys who are either 40 years old and under or who have been practicing 10 or fewer years.

Garnes Appointed to N.J. Supreme Court Committee
Stradley Ronon attorney David T. Garnes was recently appointed to the New Jersey Supreme Court’s Ad Hoc Committee on Continuing Legal Education. The committee, which was selected to reflect a broad spectrum of backgrounds and experience, will be tasked with examining the suitability of the current CLE requirements and will submit a final report to the N.J. Supreme Court by June 1, 2008.

As an associate in the firm’s litigation department, David T. Garnes concentrates his practice in commercial litigation, business torts and securities litigation. He currently serves as president of the Barristers’ Association of Philadelphia and is a member of several chambers of commerce, including Washington Township, Gloucester County and Southern New Jersey.

Sills Cummis Epstein & Gross P.C. Announces First Charles J. Walsh Scholar
Sills Cummis Epstein & Gross has selected Asha Abraham, a first-year student at Rutgers School of Law–Newark, as the first Charles J. Walsh Scholar. Sills Cummis Epstein & Gross established the Scholar Fund on behalf of the family, friends and colleagues of the late Judge Charles J. Walsh who, prior to his appointment to the Superior Court of New Jersey, Bergen County, was a valued Member of the Firm for 17 years. Judge Walsh was also an adjunct professor at the law school.

Ms. Abraham was chosen for her academic promise, leadership qualities, interest in pursuing a career in complex litigation, and long-standing desire to be a lawyer. "I have an intense sense of right and wrong and have always recognized that lawyers have a special ability to defend justice and change the world," she explained. "I also feel that my law degree will help me to be actively engaged helping people in the community." Ms. Abraham graduated with highest honors from Rutgers College in May 2006 with a B.A. in psychology and political science and was elected to the National Society of Collegiate Scholars.

The Charles J. Walsh Scholar Fund will provide financial and other assistance to Ms. Abraham in the form of scholarship support, summer internship stipends, active mentorship during law school and career guidance.

Gross, Managing Partner of Sills Cummis Epstein & Gross, stated: “We take great pride in honoring Chuck Walsh by creating this scholarship fund and encouraging and supporting Rutgers School of Law by assisting and mentoring students such as Ms. Abraham. GRAY HAILE LLP AND DAY PITNEY LLP FORM STRATEGIC ALLIANCE
Gray Haile LLP and Day Pitney LLP announced a strategic alliance that will enable each firm to expand its client base and provide clients with a team of diverse lawyers with sophisticated business law experience. The strategic alliance is an innovative way to accomplish two important goals for law firms: (i) attaining manageable growth and (ii) meeting the expectations of corporate clients who are emphasizing the need for law firms to increase the retention and promotion of minorities.

Gray Haile, which was formed in 2006, is a boutique minority-owned transactional law firm based in Washington, D.C. that focuses on mergers, acquisitions, divestitures, leveraged buyouts, joint ventures, corporate financing transactions, private security placements and venture capital.

The firm traces its origin to an effort to build a top-flight corporate law practice comprised of experienced attorneys who had practiced at some of the country’s premier law firms.

Day Pitney, created on January 1, 2007 through the merger of two prominent east coast law firms (Day, Berry & Howard and Pitney Hardin), is one of the country’s 150 largest law firms with approximately 400 lawyers in 9 offices, including a Washington, D.C. office which opened last year. Day Pitney is a full service law firm that maintains a strong corporate practice with approximately 50 lawyers focusing on mergers and acquisitions for public and private companies.

Gray Haile benefits from the strategic alliance by: (i) expanding its capabilities and depth to allow the firm to quarterback larger and more complex transactions for its clients and (ii) sharing the knowledge base and information resources of a much larger organization. The two firms will remain separate entities but will co-counsel on transactions when appropriate and jointly pursue new business opportunities. In addition, effective on or about June 1, 2007, Gray Haile will share office space in Day Pitney’s offices on New York Avenue in Washington, D.C., providing their attorneys with full access to Day Pitney’s resources.

Most importantly, existing and prospective clients of each of the two firms will be able to receive the benefit of engaging experienced, diverse and creative teams of legal advisors.

Pepper Hamilton Expands New York Office With Addition of Pharmaceutical and Commercial Litigation Partners
Pepper Hamilton LLP announced that it has expanded its New York office with the addition of Kenneth J. King and Samuel J. Abate, Jr. as partners in the Health Effects Litigation Practice Group. Mr. King and Mr. Abate are experienced in pharmaceutical and medical device litigation, as well as commercial litigation.

“Ken and Sam are welcome additions to both the New York office and the health effects litigation practice,” said Nina M. Gussack, chair of Pepper’s Executive Committee and chair of the firm’s pharmaceutical and medical device litigation and counseling practice. “Both are highly regarded attorneys, and their expertise provides our pharmaceutical and commercial litigation practices with a strong foothold in New York. We’re excited that they have chosen to join Pepper.”

Mr. King joins Pepper from Patterson Belknap Webb & Tyler LLP in New York, where he had been a partner since 2003. Before that, he was a partner with Brobeck, Phleger & Harrison LLP, where he served as managing partner of the New York office.

Mr. King has more than 20 years of experience defending business clients in complex litigation in the areas of product liability, commercial and intellectual property litigation. He has handled cases involving a range of issues, including fraud, RICO, breach of fiduciary duty, trademark and copyright infringement, and law firm liability claims. He has been trial counsel for a major pharmaceutical manufacturer and a major computer manufacturer.

Mr. Abate joins Pepper from the New York office of McCarter & English LLP, where he was a partner in the product liability practice group and the practice group leader for the pharmaceutical group.

Mr. Abate has served as lead counsel for major pharmaceutical and medical device manufacturers. He also has handled a variety of commercial and corporate litigation matters in the areas of breach of contract, breach of fiduciary duty and common law fraud, and numerous insurance-related matters.

“I have known members of Pepper’s litigation department for years, and its pharmaceutical and medical device practice is one of the best in the country,” said Mr. King. “I’m looking forward to working with Nina Gussack and the rest of the health effects litigation team, and to building the health effects and commercial litigation practices in New York.”

Mr. King and Mr. Abate worked together earlier in their careers, at the firms of Brown & Wood, and Beatie King & Abate in New York City.

“I’m delighted to join Pepper and to be working with Ken again,” added Mr. Abate. “Together, we have an excellent opportunity to expand Pepper’s New York office, while growing our own practices and providing additional geographic reach to the firm’s extremely strong health effects litigation and commercial litigation practices.”

Mr. King is a graduate of Dartmouth College (B.A. 1978) and George Washington University National Law Center (J.D. 1982), where he was a member of The George Washington Law Review. He is a member of the International Association of Defense Counsel and the Association of the Bar of the City of New York, where he has served on the Torts and Products Liability committees.

Mr. Abate is a graduate of Fordham University (B.A. 1977) and Fordham University School of Law (J.D. 1981). He is a member of the Defense Research Institute and several local, state and national bar associations. Mr. Abate also served as Mayor of the Village of Ardsley in Westchester County, NY, from 1997 through 2005, and was an officer and executive committee member of the Westchester Municipal Officials Association.

Community Legal Services Establishes the 'William R. Klaus Chair in Public Interest Law'
Community Legal Services, Inc. (CLS) has announced that it has established the “William R. Klaus, Esq., Chair in Public Interest Law” in honor of William R. Klaus, a chairman emeritus of Pepper Hamilton LLP who died in 2005. Mr. Klaus was one of the founders and early board chairs of CLS.

The Chair, which will memorialize Mr. Klaus’ commitment and contributions to providing legal services for low income residents in Philadelphia, is the first such chair at CLS and one of the first at any legal services organization in the country. It will be awarded to a rising, dedicated attorney engaged in the practice of public interest law at CLS for less than 10 years. The Chair will both recognize that person’s energy and creativity in the public interest field and encourage continued commitment to legal services and access to justice for all.

“Bill Klaus invested so much of himself in making access to quality legal services a reality in Philadelphia and across the nation,” said Catherine C. Carr, Esq., Executive Director of CLS. “I know he would be very proud to see his legacy recognized in this way.”

A partner and leader at Pepper for most of his life, Mr. Klaus was instrumental in founding CLS, which has become one of the leading organizations in the country providing legal services for low income residents and is nationally recognized for its ground-breaking work in this vital area of providing access to justice for those less privileged. He served as its first board chair, a position he held for 22 years, and his interest and contributions to the organization and the principles for which it stood continued throughout his life.

Pepper and CLS have joined together to launch a campaign to raise $350,000 to endow the Chair, to which Pepper has made an initial two-year, $50,000 donation. The team hopes to raise the remainder of the funds by next fall and name a rising young attorney to the William R. Klaus, Esq., Chair in Public Interest Law shortly thereafter.

Mr. Klaus was one of the pioneers in advocating legal services for the poor and served as one of the leading architects for what became the Legal Services Corporation in the early 1960s and provided federal funding for many legal service organizations throughout the country. He was also a former chancellor of the Philadelphia Bar Association and former head of the National Legal Aid and Defenders Association.

His work has left a strong legacy at Pepper. Partner Michael Pratt served as chair of the CLS board for four years, and several Pepper partners currently serve on the CLS board. The firm has collaborated with CLS on a variety of cases, including challenges to the implementation of improper welfare regulations, and a class action challenging illegal debt collection practices, which led to the criminal prosecution and disbarment of the perpetrator.

Orrick Lawyer Participates in Intellectual Property Panel Discussion
Silicon Valley IP partner Eric Wesenberg participated in a panel discussion entitled "IP Protection in China" about the changing Chinese economy, how to obtain IP rights in China and what to do if a company's rights are infringed or encroached. He explained the Chinese court system in detail, comparing it to the system in the U.S., and he gave advice on how to file a complaint if necessary.

According to Wesenberg, it is important for all U.S. companies to have a global strategy that includes China. "Even though you may not have a facility in China, there's a good chance that your products or your intellectual property will be in China," he said. "Something like 80 percent of all digitized information, such as video games or software, has been copied in China, along with 25 to 30 percent of all consumer goods. The prudent course is to get intellectual property in China, because your products and your interests may already be there.
