Partner appointed to Cuyahoga County Board of Elections
Ulmer & Berne LLP announced today that one of its partners, Inajo Davis Chappell, has been appointed by Secretary of State Jennifer Brunner to the Cuyahoga County Board of Elections. Ms. Chappell will fill one of two Democratic seats.

“We are proud of Inajo’s new position with the county,” stated Kip Reader, Ulmer & Berne’s managing partner. “The election process in Cuyahoga County will benefit from her appointment and we know she will help to restore public confidence in the process.”

As an attorney with Ulmer & Berne LLP, Ms. Chappell chairs the firm’s Nonprofit Group. She represents for-profit businesses as well as public institutions and nonprofit entities. Her legal expertise focuses on various aspects of corporate law, general business and real estate development, construction, financing and contracts. Ms. Chappell has served as bond and company counsel to a variety of government and corporate clients. She has particular expertise representing school districts in the provision of educational programming and services to disabled students. An active civic and community volunteer, Ms. Chappell serves on the boards of several nonprofit organizations.

STBM Named "Best Place to Work in Kentucky"
Stugill, Turner, Barker & Moloney, PLLC is honored to have been named the 2007 Best Place to Work in Kentucky in the medium-size company category. This is the third year the Lexington law firm has been selected as one of Kentucky's leaders in the medium-size company category for employers having between 25 and 249 employees. The selection process was based on an assessment of the company's employees policies and procedures and the results of an internal employee survey.

The competition is sponsored by the Kentucky Society for Human Resources (SHRM), in conjunction with the Kentucky Chamber of Commerce. The program is a multi-year initiative to motivate companies in the Commonwealth to focus, measure, and move their workplace environments toward excellence.

James W. Saxton Presents at Crittenden Medical Insurance Conference
James W. Saxton, Chair of Stevens & Lee’s Health Care Litigation Group and Co-Chair of the Health Care Department presented at the Crittenden Medical Insurance Conference held April 17-19 in Boston, MA.

As co-presenter of, “What Makes the ‘Neurologically Damaged Baby Case’ So Different?,” Mr. Saxton discussed new research on the causes of cases involving obstetricians and reviewed actual strategies for reducing the risk of malpractice claims for this high risk specialty.

Mr. Saxton lectures frequently and is an invited speaker across the country on health care issues, including liability reduction and risk management. He presents to nationally prominent health care organizations, such as the American Society for Healthcare Risk Management, the Medical Group Management Association, the American College of Surgeons and the American Health Lawyers Association.

Mr. Saxton is an active trial lawyer – a practice he has sustained for over 25 years – representing providers, including hospitals, physicians and retirement communities, in state and federal court and administrative proceedings. His practice includes litigation, licensing and medical staff issues. He uses his extensive experience as a litigator to advise hospitals, medical groups and retirement communities throughout the United States in connection with understanding and reducing their professional liability risk.

In addition to his trial practice, Mr. Saxton develops risk reduction strategies for health care providers and organizations nationwide and has created innovative strategies and educational programs to support them. This includes the creation of complete customized loss control programs and event management systems for self-insured organizations and captive insurance groups. Mr. Saxton has published more than 200 articles, several handbooks and four textbooks including most recently, Five-Star Customer Service: A Step-by-Step Guide for Physician Practices.

Victory For Fox News Network
Novack and Macey partners Steve Novack, Don Tarkington and Andrew Fleming and associates Ken Abell and John Haarlow teamed with Dori Hanswirth and Kate Bolger of Hogan & Hartson in New York to successfully defeat The Chicago Tribune's attempt to enjoin their client, Fox News Network, LLC, from using "Red Eye" in the name of its new late night television program.

The Tribune alleged that Fox News' national television show named "Fox News Red Eye with Greg Gutfeld" infringes on the Tribune's use of the trademark "RedEye" for its local Chicago newspaper. After defeating a motion for temporary restraining order, the trial team engaged in expedited discovery and briefing in preparation for a three-day preliminary injunction trial before United States District Judge Elaine E. Bucklo of the Northern District of Illinois.

After the trial, Judge Bucklo held in a 25 page written opinion that the Tribune was not entitled to a preliminary injunction prohibiting Fox News from using "Red Eye" in its name. The Court found, among other things, that the television show and the newspaper are not similar products, that there was no evidence of confusion among consumers or advertisers, and that Fox News did not intend to pass its television show off as belonging to the Tribune. The Court also held that the harm to Fox News that would result from forcing it to change the name of its show would be too great to warrant an injunction.

Six N&R Attorneys Named “Georgia Super Lawyers”
Needle & Rosenberg P.C., an Atlanta-based law firm focused on intellectual property law, today announces that six of its attorneys have been recognized as “Georgia Super Lawyers?.” The Needle & Rosenberg lawyers on this year's list are: Jeffrey H. Further, two of the six Needle & Rosenberg attorneys named also made the Top 100 Georgia Super Lawyers list. Like Needle and Nodine, Perryman and Rosenberg have made the Georgia Super Lawyers list four-years running, while Kirsch has been listed for three years.

- Jeffrey H. Brickman practices both intellectual property litigation and criminal defense. He served as the District Attorney of DeKalb County of Atlanta, Georgia prior to joining Needle & Rosenberg.

- Gregory J. Kirsch leads the firm's software, electronics and communications technology patent practice. He serves as patent counsel to numerous technology and Internet companies, ranging from large multinational corporations to small start-ups.

- William H. Needle is the founder of Needle & Rosenberg P.C., and he has practiced patent, trademark, copyright and trade secret law exclusively over his entire 36-year career.

- Lawrence K. Nodine is the managing shareholder of the firm and practices in intellectual property litigation and counseling, leading the firm’s litigation practice. For more than twenty years, Larry has served as lead counsel on a wide variety of cases involving trademarks, copyrights and patents.

- David G. Perryman practices biotech law and focuses on helping clients position their intellectual property in a manner consistent with their business goals so that costs are avoided and value is found or created. He currently serves on the board of directors for several biotechnology companies.

- Sumner C. Rosenberg provides patent prosecution, counseling, licensing and litigation legal services, focused on the computer software and hardware industries. In addition, he leads the firm’s trademark practice.

Senior Calgary Tax Lawyer Joins McCarthy Tétrault

Attorney Donna DiMaggio joins Kummer Kaempfer Bonner Renshaw & Ferrario’s Litigation Department
The statewide law firm of Kummer Kaempfer Bonner Renshaw & Ferrario (Kummer Kaempfer) is pleased to welcome Donna DiMaggio as its newest attorney in the firm’s Las Vegas office. She joins the Litigation Department.

Prior to joining Kummer Kaempfer, DiMaggio spent five years practicing law in the areas of business, commercial, medical and construction litigation. She regularly appeared before Federal, District and Superior Court, conducted bench trials and presided over numerous arbitrations and mediations.
