Once Again, Canadian Corporate Counsel Have Their Say
"Davies Ward Phillips & Vineberg LLP and the Canadian Corporate Counsel Association (CCCA) release the third annual In-House Corporate Counsel Barometer, an online survey created in conjunction with Ipsos Reid to uncover the opinions and attitudes of Canadian in-house corporate counsel.

The survey was distributed in February 2007 to CCCA members from a variety of organizations and industry sectors. Over 700 members participated in the survey.

Since the survey began in 2005, notable trends and changes include:

* General counsel’s number one role is still seen as an advisory one (vs. management or legal)
Regulatory compliance is still the top issue for general counsel
* The perception that it is important to have law firm experience before becoming an in-house counsel is stronger than it was two years ago
* Keeping overall costs down is an increasingly important challenge for in-house corporate counsel
* An increasing proportion of in-house corporate counsel are recognizing the value for money offered by outside counsel
* The use of fixed fees and percent discounts in their dealings with outside counsel is becoming more prevalent among in-house corporate counsel

In 2007, the survey explored several new topics. Highlights include:

* ""Enhancement of business skills"" was added this year as a business-specific advantage to working as in-house counsel, this item ranks third in the overall set
* Most in-house corporate counsel are working in organizations against which at least one legal dispute has been filed in the past year. And of those, one in three have been exposed to class action litigation over the past year
* One third of in-house corporate counsel say that the amount of litigation their organizations have faced in the past five years has increased; more expect further increases in the next five years
* The level of communication/responsiveness of the firm and its lawyers appears to be the most important consideration in choosing outside counsel
* The most common cost saving measures implemented over the past two years by in-house legal departments include “brought more in-house” and “require less service from outside counsel”

CCCA provides a national forum for corporate counsel to advance the development of their practice of law, professional skills and careers as corporate counsel. There are now over 8,400 regular and associate members and 11 regional chapters across Canada."

Womble Carlyle's Keith Vaughan Named One Of America's Most Admired Firm Leaders
Keith W. Vaughan, Managing Member of Womble Carlyle Sandridge & Rice, PLLC., has been named one of the country's 10 most admired law firm leaders in an independent national survey of managing partners.

According to a press release dated April 16, 2007, Edge International, a legal consulting firm, conducted the survey of more than 60 top law firm managing partners. These top attorneys were asked to identify which law firm leaders, from firms other than their own, they most admired for their management and leadership skill.

The qualities most cited in these leaders are a willingness to make change, an ability to promote ambitious agendas, the skill to deftly handle difficult matters and build consensus within the firm, and a commitment to maintaining the core values of the firm.

Other managing partners named in the "Most Admired" survey were Robert M. Dell, of Latham & Watkins LLP; Regina M. Pisa, of Goodwin Proctor LLP; Lee I. Miller, of DLA Piper US LLP; Ben F. Johnson III, of Alston & Bird LLP; Cesar L. Alvarez, of Greenberg Traurig, LLP; Bob Odle, of Hogan & Hartson LLP; Patrick McCartan, of Jones Day; Ralph H. Baxter, Jr., of Orrick and Herrington & Sutcliffe LLP; and T. Kennedy Helm III, of Stites & Harbision, PLLC.
"It is always an honor to be recognized by your peers," Vaughan said. "However, I think this recognition is due in large part to the respect people in the legal profession have for Womble Carlyle as a whole. We have many innovative programs in place here at the firm, all designed to help our clients succeed in our rapidly changing world."

Before becoming the firm's Managing Member in 2002, Vaughan served as Womble Carlyle's Litigation Practice Group Leader for 10 years. He has tried numerous jury and bench trials during his more than 30-year legal career and has been repeatedly recognized as one of the country’s top business litigators.

Firm Represents Jarden Corporation in $1.2 Billion Acquisition of K2 Inc.
It was announced that longtime Willkie client consumer products company Jarden Corporation (NYSE: JAH) signed a definitive agreement to purchase sports equipment maker K2 Inc. (NYSE: KTO) for $1.2 billion. The agreement calls for Jarden to pay $10.85 per share in cash and to issue 0.1086 of a share of Jarden common stock for each share of K2 common stock outstanding as of the closing (subject to certain adjustments). With over 20,000 employees worldwide, Rye, NY based-Jarden is a leading provider of niche consumer products used in and around the home, including popular brands Sunbeam, Mr. Coffee, Holmes and Bionaire. K2 Inc. is a premier consumer products company with a portfolio of leading brands in the action sports and apparel/footwear segments. The transaction was handled by partner William Grant and associate Mark Getachew, with assistance from partners Frank Daniele and Christopher Peters, special counsel Kim Walker and associates Michael Caplan, Stephane Huten, Katherine Schroeder, Katie Calabrese and Rebecca Gutner.

Michael Whitton Appointed to the National Law School Advisory Council
Ross, Dixon & Bell partner Michael Whitton has been appointed to serve on the National Law School Advisory Council at the University of Notre Dame. Mr. Whitton was appointed by the president of the University to a three-year term.

The Law School Advisory Council plays a key role in “the advancement of the University and its principal academic endeavors.” Members of the Law School Advisory Committee serve as representatives of the University and “assist with the identification of problems and offer solutions as well as help chart the school’s growth.

Two Phelps Dunbar Partners Receive the New Orleans CityBusiness Leadership in Law Award
Phelps Dunbar partners Kim M. Boyle and Harry Rosenberg were recently selected by New Orleans CityBusiness as recipients of the 2007 Leadership in Law award. They were recognized at a luncheon and awards ceremony in New Orleans on March 30, 2007. Fifty attorneys from the greater New Orleans area were selected for the honor based on their skills as attorneys and their accomplishments in the community.

Ms. Boyle is a partner in the New Orleans employment law group and practices in the areas of labor and employment, civil rights, constitutional law, commercial litigation and general litigation. Kim is very active in local, state, and national bar activities, having previously served as the first African-American President of the New Orleans Bar Association, Treasurer of the Louisiana State Bar Association (LSBA), a member of the LSBA Board of Governors and the LSBA’s Ethics 2000 Committee. She currently serves on the board of directors of the Federal Bar Association. Kim also serves as co-chair for the Committee for a Better New Orleans/Metropolitan Area Committee, a member of the local advisory board for the United Negro College Fund, secretary of the Greater New Orleans Foundation, trustee for the WYES-12 board of directors, a member of the Board of Directors of the Orleans Public Defenders Program, and a board member on the Bureau of Governmental Research. In addition, she is a member of the Louisiana Recovery Authority (LRA) and serves as Chair of the LRA Healthcare Committee. Kim previously served on the Bring New Orleans Back Commission, which focused upon rebuilding the city post-Katrina, and served as Chair of the Health/Social Services Committee of the Commission.

Mr. Rosenberg is a partner in the New Orleans office and the regional practice coordinator of the firm’s commercial litigation practice. He concentrates his practice in the areas of business torts, trial practice, civil rights, and criminal law. Mr. Rosenberg served as the United States Attorney for the Eastern District of Louisiana from 1990 through 1993. He is among a select group of lawyers, recognized in the categories of Litigation: General Commercial and Litigation: White-Collar Crime & Government, listed in a nationwide client survey published in Chambers USA, America’s Leading Lawyers for Business. He currently serves on the Board of Directors of the Orleans Public Defenders Program. In addition, he is a fellow of the American Counsel Association and the Louisiana Bar Foundation.

Phelps Dunbar Attorney Selected as Mississippi College School of Law Young Lawyer of the Year
Phelps Dunbar LLP is pleased to announce that Kelly R. Blackwood, an associate in the commercial litigation practice group in the Jackson office, has been selected as the 2007 recipient of the Mississippi College School of Law (MCSOL) Young Lawyer of the Year. Ms. Blackwood was honored during the annual MCSOL 2007 Alumni Reunion on Saturday, March 31, 2007 at the University Club in Jackson, Mississippi.

The award for Young Lawyer of the Year is given to a young lawyer who has made significant contributions to the advancement of MCSOL. Several law school departments nominated Ms. Blackwood for the honor, as her contributions to the school have been numerous. Ms. Blackwood coached a MCSOL team that was named a national semifinalist in the Pace Environmental Moot Court Competition. This event is recognized as the preeminent environmental law moot court competition in the United States. The competition tests skills in appellate brief writing and oral advocacy involving issues drawn from real cases, providing first-hand experience in environmental litigation. In addition, she chaired an environmental law seminar held at MCSOL and was involved in fundraising initiatives to benefit the law school.

Ms. Blackwood concentrates her practice in the area of environmental law, including regulatory matters and litigation. In addition to The Mississippi Bar, where she currently serves as Vice Chair of the Section on Natural Resources, Energy and Environmental Law, Ms. Blackwood serves as a Vice Chair for the Smart Growth and Urban Policy Committee of the ABA’s Section on Environment, Energy and Resources. She also is a member of the Air & Waste Management Association, Mississippi Women Lawyers Association, Defense Research Institute and Mississippi Defense Lawyers Association.
