Brumberg Judges Final Round of 2007 Merhige National Environmental Law Competition
Samuel R. Brumberg, of LeClair Ryan’s Government Relations and Regulated Industries practice group, was selected to judge the final round of the Robert R. Merhige, Jr. National Environmental Law Competition, held on March 31, 2007, at the University of Richmond T.C. Williams School of Law, along with Dean Smolla and Chief Justice Carrico. The competition is held in honor of the late United States District Court Judge, a graduate of the T.C. Williams School of Law who presided over several groundbreaking cases, including the desegregation of Virginia schools in 1972 and the admittance of female students at the University of Virginia in 1970.

From the University of Richmond website..."Over the course of his thirty-one years on the bench, Judge Merhige showed a sincere commitment to the environment, imposing a $13 million fine against Allied Chemical for its pollution of the James River and Chesapeake Bay with the insecticide Kepone and encouraging the company to institute an $8 million cleanup fund. Judge Merhige retired in 1998 and returned to private practice at the law firm of Hunton & Williams. Sadly, Judge Merhige passed away in 2005. Each year, the University of Richmond Client Counseling and Negotiation Board honors his legacy through the spirit of this competition." This two-day competition draws law students from all across the United States and is hosted by the Client Counseling and Negotiation Board at the law school.

BINGHAM MCCUTCHEN ADDS NOTED ANTITRUST ATTORNEY TO BOSTON OFFICE
Thane D. Scott, former co-chair of the Antitrust Practice Group at Edwards Angell Palmer & Dodge, has joined the Boston office of Bingham McCutchen LLP as a partner in the Antitrust and Trade Regulation Practice Group.

During his 21-year tenure at Edwards Angell Palmer & Dodge in Boston and its predecessor, Palmer & Dodge, Scott advised industry leaders and litigated prominent cases that have defined antitrust law. He joins an antitrust practice at Bingham that Chambers USA ranked in the top tier among Boston law firms in 2006.
“Thane is one of the deans of the New England antitrust bar,” said Daniel Goldberg, co-leader of Bingham’s antitrust and trade regulation practice group and a Boston partner. “He brings a wealth of experience in the trial of antitrust cases and in antitrust counseling, and he is a terrific addition to an already-strong practice both in Boston and nationally.”

Bingham’s antitrust attorneys have represented several major clients, including serving as lead counsel for Intel Corp. in more than 70 coordinated federal class actions pending in Delaware and alleging that the company’s sales and marketing practices for its microprocessors hurt rival AMD. Bingham also represents the National Collegiate Athletic Association in two high-profile cases challenging rules relating to the allowable athletics-based financial aid that schools can provide to student-athletes.
Scott regularly defends business and consumer class actions involving antitrust and business tort claims, including class certification issues. He has served as lead or liaison counsel in numerous multi-district, complex or class-action cases, and he has represented major clients in government investigations.
He also litigates competitive intelligence and other cases involving business rivalry, including representing the plaintiff in a recent major federal case challenging a rival’s intrusions into the plaintiff’s management information system. In addition, Scott has served as lead defense counsel in more than 100 government investigations of mergers involving national and international companies.

Scott noted Bingham’s status in the antitrust community and international presence as key factors for joining the firm.

A graduate of Boston College Law School and the State University of New York at Albany, Scott spent four years at Nixon, Hargrave, Devans & Doyle in Rochester, N.Y., before joining Palmer & Dodge. Before joining Nixon, Hargrave, he was a law clerk for former Massachusetts Supreme Judicial Court Chief Justice Edward Hennessey.

Proskauer Rose Represents Accor in $1.32 Billion Sale of Red Roof Inns to Citi Global Special Situations Group & Westbridge Hospitality Fund
Proskauer Rose LLP, an international law firm with over 700 lawyers worldwide, represented Accor, the international hotel, tourism and corporate services company, in negotiating an agreement for the sale of the Red Roof Inn brand and over 200 Red Roof Inn hotels to a consortium comprised of Citi's Global Special Situations Group and Westbridge Hospitality Fund, L.P. for $1.32 billion.

Upon completion of the sale, the Red Roof Inn network will have 326 properties and 35,238 rooms located mainly in the East Coast and Midwest regions of the United States. The Global Special Situations Group of Citigroup Global Markets Holdings Inc. is a principal investment group that invests Citi's capital in event-driven special situation strategies worldwide. Westbridge is a partnership between Westmont Hospitality Group, one of the largest private owner/operator of hotels in the world, and a number of Canadian pension fund managers.

The Proskauer team involved in the transaction included Jeffrey Horwitz, Yuval Tal, Steven Fishman, Michael Feldman, Solomon Warhaftig, Gail Port, Steven Weinstein, Jennifer Paine, and Michael Schuman.

DLA Piper acts for Bel Group in the purchase of Shostka City Milk Factory
DLA Piper has advised Bel Group, a French cheese producer, in the purchase the Shostka City Milk Factory, a well-known Ukrainian cheese producer. The share sale and purchase agreement was signed on 2 April 2007. The transaction is being completed and the closure is expected shortly. The value of the deal is confidential.

The DLA Piper team was led by Corporate partner Margarita Karpenko, who commented: "Although, we faced a tight schedule , the deal went very smoothly. Within three months, we conducted the due diligence, obtained the approval of Ukraine's Antimonopoly Committee and dealt with other regulatory issues. The team also advised the BEL Group on corporate structure and the future structure of the factory's management."

Margarita Karpenko was assisted by Finance and Projects senior associate Natalia Fuklyeva, and Corporate associates Yulia Khomych and Natalia Dydchenko.

DLA Piper named Counsellor of the Year
Top Capital, China's leading investment and high technology publication, has awarded DLA Piper with its 'Counsellor of the Year Award'.

The rankings were based on deals closed, dollars deployed and overall market reputation.

Rocky Lee, partner and head of DLA Piper's venture and private equity practice in China, received the award on behalf of the firm. "This award is recognition of our corporate and finance practices in China which can truly service the needs of institutional clients and Chinese growth companies," said Rocky.

The Annual Top Capital Summit is one of the largest investment and financing conferences in China.
