Flaster/Greenberg Relocates Trenton Office To Accommodate Expanding Legal Team At The American Metro Center
Flaster/Greenberg P.C. continues its growth as a regional law firm with the recent relocation and expansion of its Trenton office to the American Metro Center, 200 American Metro Blvd., Suite 126. The firm has offices in Delaware, New Jersey and Pennsylvania and expanded its Philadelphia office last year.

The Trenton office is located in a historical building, which opened in 1925 as a pottery plant that later manufactured “sanitary earthenware” for American Standard Corporation. The office will accommodate approximately 15 attorneys and support staff, including a new shareholder, T. Sandberg (Sandy) Durst, a member of the firm's Family Law Practice Group. A well-known attorney in the Trenton area, Durst represents clients in cases of alimony, equitable distribution, custody, imputation of income, parenting time, domestic violence, prenuptial agreements and grandparent's rights.

In addition to Durst, Flaster/Greenberg's growing Trenton legal team includes: Matthew S. Burns, who concentrates his practice in Construction Law; Intellectual Property law attorney Dennis J. Helms; James A. Kozachek, who concentrates his practice in Construction and Real Estate Law; Elaine J. Petruzziello, a member of the Estate Planning and Administration Practice Group; and Michael S. Simon, who concentrates his law practice in Alternative Dispute Resolution and Construction Law.

“As Flaster/Greenberg continues to expand, our new Trenton location is an opportunity to provide a stronger platform for our existing clients and cement our commitment to the greater Delaware Valley region. We are excited to be in this office, not only for the geographic location, but to also be in an environment with such a unique history that has been preserved through modern renovations,” said Managing Shareholder Peter R. Spirgel.

The completely restored and modernized World War I era buildings feature the original architecture frames and tunneled kilns resting on railroad tracks which are encased in glass to display the historic pottery the kilns first fired. The distinct architectural décor includes exposed red brick walls and ceilings, and skylights enhance this non-traditional, creative office environment.

The American Metro Center is situated in the southern end of the Princeton/Route 1 Corridor Office Market, providing key access to Philadelphia, Princeton and New York City. It is also adjacent to New Jersey Transit's Hamilton Station.

Goh Mei Lin and Damian Adams of the Singapore office of Watson, Farley & Williams LLP (WFW) acted for The Bank of Tokyo-Mitsubishi UFJ, Ltd., Singapore Branch and Bayerische Hypo- und Vereinsbank AG, Singapore Branch (BTMU) as lenders of a US$250,000,000 secured revolving credit facility to FSL Trust Management Pte Ltd, in its capacity as trustee-manager of First Ship Lease Trust (FSL Trust), a Singapore registered business trust established under the Singapore Maritime Finance Incentive Scheme and specialising in non-tax driven leasing services to the global shipping industry. It is the second such trust to be listed on the Singapore Stock Exchange having successfully completed its IPO on 27 March 2007.

The purpose of the facility is to grow FSL Trust’s portfolio by financing the acquisition of additional vessels to expand its initial fleet of 13 vessels comprising product tankers, chemical tankers, containerships and dry bulk carriers, all on bareboat charter to various operators including James Fisher and Sons plc, Evergreen, Berlian Laju Tanker and Siba Ships.

WFW’s involvement on this transaction represents its second successful representation of BTMU as agent for senior lenders to the FSL group, following a US$44,800,000 term loan facility closed in December 2006 in relation to sale and leaseback transactions worth US$56,000,000 in respect of two 47,000 dwt dry bulk carriers operated by Siba Ships Asia.

WCM Achieves Favorable Result in Suffolk County, NY Trial
Senior Partner John Mulcahy achieved a favorable result in a Suffolk County, New York, personal injury trial. In the case of Linick v. Bornstein, et. al., the plaintiff, a motorist, collided with a mound of topsoil that had been placed in the middle of a public roadway by our client, a landscaper who was re-landscaping nearby property. As a result of the collision, the plaintiff alleged traumatic brain injury as well as various disc herniations.

Before the bi-furcated trial began, the plaintiff’s bottom line settlement demand was $300,000 – a number significantly higher than our best offer. The trial therefore commenced.

During the liability phase of the trial, we questioned plaintiff’s credibility and highlighted the open and obvious nature of the defect that caused the accident. As a result, at the close of the liability trial, the jury returned a verdict that assessed 50% liability against our client and 50% against the plaintiff.

In light of this verdict, before the damages trial began, the plaintiff accepted our offer of $162,500 – or some $140,000 less than his bottom line pre-trial demand.
