The Deal Quotes Partner Jim Carr as a Top Bankruptcy Lawyer
Partner James Carr is quoted in The Deal on bankruptcy trends, including the effect of subprime lending. In the article titled "A Mortgage Future, The Crises In Subprime Lending Could Finally Pull Bankruptcy Professionals Out Of The Doldrums," Mr. Carr states that the subprime fallout could affect retailers. In addition, he comments on how private equity firms which overpaid for companies may end up resolving business issues in bankruptcy court. The article mentions that Mr. Carr had 170 active assignments in the second quarter of 2007, placing him in the top five for leading bankruptcy attorneys.

Special Counsel John T. Delacourt was interviewed by The Metropolitan Corporate Counsel about the Supreme Court’s recent decision in Leegin Creative Leather Products, Inc. v PSKS, Inc.. Mr. Delacourt discusses the longstanding antitrust prohibition on minimum resale price maintenance (“RPM”) at the center of contention in the Leegin case, and offers his analysis on the implications of the Supreme Court’s decision to overturn the prohibition on minimum RPM and make it subject to the rule of reason.

Matthews of Fox Rothschild Quoted in American Lawyer Article
James A. Matthews, III was recently quoted in "Desperately Seeking Seniors." The article by Elizabeth Goldberg appeared in the September 7, 2007, edition of The American Lawyer.

Matthews added his thoughts to a report on the growing trend to recruit senior talent. Many firms are snapping up older attorneys — and the networks of contacts they keep — to help grow offices and contact lists. The trend has split the legal industry – with many firms maintaining mandatory retirement, and other seeking senior talent. Matthews voiced the view of firms on the mandatory retirement side.

Counsel Anthony Sabino Featured in the Latest Issue of Long Island Business News.
Attorney Anthony Sabino, Counsel to the firm, is featured in the latest issue of the Long Island Business News. In the article, Mr. Sabino offers commentary concerning the rules and regulations surrounding apprenticeship programs.

Offering his opinion on the skill level of union laborers, Sabino concludes “There is no question, based on my experience, that most union labor is very well trained and efficient in what they do. However, there are inefficiencies built into contracts for their industry.”

Mr. Sabino concentrates his practice in the areas of land use, real estate, environmental issues and municipal law. He comes to the firm having served as partner in one of Long Island's oldest law firms, in addition to serving as partner in a real estate development company. He is also a former Deputy Town Attorney for the Town of Oyster Bay.

Phoenix-based Gallagher & Kennedy, P.A., a full service business law firm, is pleased to announce the following three associates have been elected to shareholder effective Jan. 1, 2008: Jennifer A. Ratcliff, Brian J. Zavislak and Anthony J. “T.J.” Trujillo.

Ms. Ratcliff practices in the area of general litigation, with an emphasis on condemnation and valuation matters. In addition to sitting on the board of directors for the Maricopa County Bar Association, she is currently president of the Association’s Young Lawyers Division. Ms. Ratcliff earned her juris doctor from the University of Arizona in 2000. She completed her bachelor’s degree with highest honors at St. Mary’s College of California in 1997.

Mr. Zavislak practices real estate law. He represents local and national developers in connection with real estate acquisition, construction financing and commercial real estate development. Mr. Zavislak’s recent experience includes financing transactions for the development of retail, commercial and residential projects in Arizona, Texas and California. He completed his juris doctor with honors in 2000 and bachelor’s degree in 1997 at the University of Notre Dame.

Mr. Trujillo practices governmental affairs law, environmental and natural resources litigation, and general commercial litigation at Gallagher & Kennedy’s Santa Fe, N.M. office. His recent experience includes litigating cases regarding environmental issues, contracts, employment law, civil rights, torts and personal injury before appropriate federal and state, and administrative tribunals. Mr. Trujillo earned his juris doctor in 2000 from the University of Arizona. He also received his M.B.A in 2000 from Western New Mexico University and his bachelor’s degree in 1995 at the University of Arizona.

Temporary Injuction Requested by Fitzpatrick Cella Granted by Federal Circuit
Novartis obtained a temporary order from the U.S. Court of Appeals for the Federal Circuit prohibiting Teva Pharmaceuticals from selling its generic version of the antiviral medicine Famvir® on September 7. Representing Novartis was Fitzpatrick, Cella, Harper & Scinto.

Novartis holds valid US patents until 2015 for Famvir®. The injunction remains in effect until a decision by this court.

The Fitzpatrick Cella team was led by: Robert L. Baechtold, Hugh C. Barret, Nicholas N. Kallas, Nina Shreve and Simon D. Roberts.
