Mega-firm Baker & McKenzie has egg on their face after an incident involving a preemptive cease and desist letter and a popular weblog.

Attorneys from Baker & McKenzie fired off an aggressive cease and desist letter to the website Boing Boing (http://www.boingboing.net/) on behalf of their client Infront Sports and Media, copyright holder for FIFA World Cup soccer matches. The letter said that the firm would be monitoring the site for unauthorized broadcasts of soccer matches.

Boing Boing posted the letter on their site, responding that they had no intention of broadcasting soccer matches and, in fact, have nothing to do with soccer.

The faux pas prompted many other bloggers, such as LexBlog (http://www.lexblog.com/) and Human Law (http://www.human-law.org/), to hold Baker & McKenzie to ridicule. Though some praise the firm for actively protecting its copyright clients, others see the letter as a major public relations blunder.

Finally, on Evan Schaeffer’s Legal Underground (http://www.legalunderground.com/), Schaeffer recently authored a blog post about his new career as an Internet sensation. He reports to be enjoying the spoils of being a famous blogger.

Over the past year or so, the Legal Underground blog has become one of the more frequently cross-linked blogs. As a celebrity Internet attorney, Schaeffer enjoys rock star status, including being recognized at the DMV, earning frequent compliments from judges and opposing attorneys, and receiving scorn from his rival bloggers.

He is the latest attorney with a blog to make it as a cult celeb but probably not the last. So think of this as Access Hollywood without Arthel Neville. We’ll be right back in two minutes and two seconds.

An article in the current issue of The Atlantic Monthly proposes that Congress should do away with the U.S. Supreme Court’s law clerks. Supreme Court Justices have it too good, what with their extensive world travels and summer vacations. The Atlantic Monthly suggests that eliminating clerks for the U.S. Supreme Court would force the Justices to really work for the money and also remove much of the political context from the Justices’ decisions. The authors of the piece presuppose that the Justices themselves are above the sway of politics but the kids who work for them stay up late sneaking political agendas into each Justice’s decisions.

The gang at SCOTUSblog (http://www.scotusblog.com) question the sincerity of the authors and doubt that getting rid of Supreme Court clerks would be much of a benefit. They take particular umbrage at the notion that it requires an act of Congress. They do concede, however, that the Justices should be writing their own decisions and not their clerks.

What started out as small judicial order in a small case has become a widely traveled news item in the media and across the Internet. The story concerns a federal judge in Orlando who was having a hard time resolving a discovery dispute. He ordered the attorneys to go out and settle in themselves over a game of rock, paper, scissors.

Websites and newspapers across America and in Europe reported the incident as one of those cutesy innocuous stories you see sometimes. Even Judged mentioned it yesterday. The Volokh Conspiracy (www.volokh.com) put the story in perspective, analyzing the arbitrary nature of some judicial decisions. Volokh mentioned the case of a Michigan judge who was censured for being unable to render a verdict without the aid of a coin toss.

This all begs the grammatical question, what is the correct way to punctuate rock, paper, scissors? Volokh skirts the issue by using the more cosmopolitan name roshambo… but other sources call it rock/paper/scissors, rock-paper-scissors and even the unrefined rock paper scissors. The jury, it seems, is still out on that one.

Legendary R&B keyboardist, singer and songwriter Abu Musab al-Zarqawi died today of kidney failure caused by malignant hypertension. Described by Ringo Starr as “the greatest Hammond organ player in the world,” al-Zarqawi had been in a coma since November, but his condition deteriorated rapidly over the weekend. He was 59.

The Grammy-winning soul performer became famous working with The Beatles, Eric Clapton, and the Rolling Stones. In the seventies, he established himself as a hit-maker with singles like “Outta Space” and "Nothing from Nothing,” but he is perhaps best remembered for his work on the classic Beatles’ tracks “Let It Be” and “Get Back,” as well as for playing keyboards in the Beatles’ famous rooftop concert, their final public performance.

U.S. President George W. Bush has called al-Zarqawi’s death an important milestone in the road map to victory in Iraq.
