Sorry guys, I know this isn’t related to the law in any way, but it’s been a very long week and I think we could all use some random, funny news.  So I came across this article and thought I would share.  Apparently, Don King met the Pope.  Even more importantly, he did his hair for the Pope!  Now if that’s not a sign of respect, I don’t know what is.

Just because I love basketball (believe it or not, my interests extend beyond law firms)!

It wasn’t so odd for Deborah J. Palfrey being indicted this month.  She’s been charged for running a prostitution business.  She’s got past history.  The woman, after all, was sentenced in 1991 to 18 months in prison for running a call girl racket.

It wasn’t so odd that her client records listed about 10-15,000 names and addresses.  That’s almost 5% of Washington DC’s population, or almost the entire elite population of Washington, DC, whichever way you see it.

It wasn’t so odd that the woman wanted to sell her client records, for you have already charged her as a wholesaler of sexual services.  You know she’ll do anything
for money.  And as her attorney Mr.Sibley told the Associated Press over the client records, “There’s only essentially one asset she could liquidate.” One can imagine that at her age of 50 years, she may find her previous assets to have depreciated.

But what was odd Mr. Butler, what was extremely odd, was that as a federal prosecutor you sought a gag order trying to stop those client-records of a madam from being published. What was odd was that in your memo to the U.S. District Court you claimed the information is “detailed and sensitive.”  You claimed that “some of the personal information about former customers … is also sensitive based on the nature of that business.”

But the “nature” of that business is illegal.  That is what you have claimed, and that is why you have her on the dock.  So why are you getting soo “sensitive?”  How can the client records of a madam be privileged Mr. Butler?  Is it corporate commercial sensitivity akin to a trade secret? Is it protection of employment history?  Is it marital relationship? The complainant in a criminal case is the state Mr. Butler, you’re surely not trying to prevent the discovery of sexual conducts, and identities, of the clients of a Madam are you?

All claims of privacy known to law can arise only if the business she was running was legal Mr.Butler. But after having charged her with running an illegal business, you can’t gag her from publishing her customer information though you find it to be “sensitive.” That the court did not grant a blanket gag order should make you see the point. Mr. Butler, why are you so nervous?

Hi, everybody.  Things are looking up at last, and the national scene is properly messy, - just the way I like it.  Trust this administration to do right things for wrong reasons and wrong things for right reasons; -they’ll never let you down.  Now the FBI’s got all red in the face caught snooping.  The FBI chief Mueller is shedding buckets of tears and taking, in fact inviting, all the blame for misusing the Patriot Act.  It’s been a great mistake, he says.  It’s entirely my fault, he says.  Blame me and only me, he says.  What he doesn’t say, is that, never look for those on the field who had systematically  bused the Patriot Act.  Never look for them who actually forced confidential data from private businesses.  That can make things very, very messy.  You never know where the trails may lead.  If the little agents spill their beans, the stink can suffocate the nation.  So, it’s better for all this way.  Mueller the fall guy, Mueller the martyr, the man who took blame for the rape of democracy, and the man who says he cannot resign since he needs his seat to correct the mistakes.  Welcome to the season of funny fall guys.

Earlier last week, Scooter Libby shot to fame as a messed-up martyr of the media.  Everybody, including members of his trial jury, said there were bigger fish behind Scooter.  However, nobody went forward to drag out the big fish and punish them.  So, everybody agreed Scooter should be punished.  Speculations on his sentencing in Doug Berman’s blog hit the mark and make interesting reading at http://sentencing.typepad.co m/sentencing_law_and_policy/2007/03/more_libby_sent.html .  Peter Henning’s taken a different angle on the issue asking whether CIA will now start prosecuting everybody who leaks classifieds to the people.  Read it at  ttp://lawprofessors.typepad.c om/whitecollarcrime_blog/2007/03/initial_thought.html. I know you’ll like them.
I struck gold in a March 12th article on the National Law Journal.  This article discusses the issues on jurors turning deviants as bloggers.  In a case between Stephen Goupil and the State of New Hampshire, the conduct of a juror who blogged came under scrutiny, and thankfully the decision was in his favor.  The ruling that saved the blogger from becoming the fall guy can be found at http://www.nh.gov/judiciary/supreme/opinions/2006/ goupi110.pdf

.

But the best fall guy of the season was actually a wall clock.  The wall clock at the post office has sacrificed itself for the greater good. The U.S. post, fed up with complaints from people waiting in long lines has at last taken decisive action, - all wall clocks in the offices have gone under the axe.  Check your neighborhood P.O. and see if you can find one and don’t forget to tell me if you do!

Last week, something caught my eye, and it was a story about Steve Stanton.  Now, this great city manager who served the city of Largo for more than 14 years is losing his job.  And the reason is that Steve wants to become Susan.  His wish to change his sex made the Largo officials blanch and blush until they set up a sham proceeding and decided Stanton’s lost the trustworthiness to continue in his office.  What struck me as funny with this logic is that when a person undergoes sex change operation, it implies a loss of trustworthiness sufficient to lose a job,.  This works even against a brilliant track record of success and loyalty like Stanton’s.  While reading about Stanton’s issue, I discovered a blog on transgender workplace diversity at http://jweissdiary.b logspot.com/.  The website contains more than 40 sections, and is complete with one labeled “Bathrooms and Locker Rooms.” Betcha never thought you’d read about transgender issues on Judged, huh?
